As luck<br />
would have it,<br />
dining at some of<br />
the areas best restaurants, in addition to<br />
discovering some of the best kept<br />
secrets, is an advantage of being a food<br />
writer. Having dined at L'Opera recently<br />
has reminded me of how lucky I am<br />
once again.<br />
From the moment we entered the<br />
bistro, I felt we were in store for a<br />
wonderful culinary experience. We were<br />
not disappointed. We were approached<br />
by a lovely host named Amy, who<br />
seated us in a very private booth, which<br />
instantaneously put us in a cozy,<br />
romantic mood. The decor was tastefully<br />
thought through. The use of dark woods,<br />
brick, and "Gold Leaf", made you feel<br />
you truly were dining at a brasserie in<br />
the center of Paris.<br />
After being seated, we were<br />
greeted by our server, Seth, a young<br />
epicurean willing to do whatever<br />
it took to make our experience a<br />
memorable one.<br />
To start off we were given some<br />
wonderful Artisan bread, with a pungent<br />
black olive tapanade. This would help<br />
with the choice of wine we selected,<br />
a Laboure-Roi Poullie Fousie (2003).<br />
This light, crisp wine was a wonderful<br />
selection that would compliment our<br />
choice of appetizer and salad. We<br />
chose a classic escargot with a garlicherb<br />
butter, and a frisee salad with<br />
beets, walnuts, blue cheese, and green<br />
apple. Both items were prepared and<br />
presented tastefully. The frisee salad<br />
was exceptional.<br />
Our choice for entrees was a
Filet de Boeuf Sauce Choron<br />
(Filet Mignon with a Choron sauce)<br />

difficult decision. With seafood choices<br />
such as Dover sole, grouper, snapper,<br />
and scallops, we decided to select a Vol<br />
au Vent de la mer, (seafood stew in puff<br />
pastry). This delectable entree consisting<br />
of puff pastry filled with lobster, shrimp,<br />
and scallops was expertly prepared, and<br />
extremely flavorful.<br />
Our second selection, a delicious,<br />
braised lamb shank with parsnip puree,<br />
roasted fennel, and tomato confit was<br />
also a winner. The preparation of the<br />
item was well thought through, with the<br />
roasted fennel complementing the flavor<br />
of the lamb, not overpowering it.<br />
The finale of the evening was a<br />
wonderfully prepared dessert "tour"<br />
which enabled us to sample several<br />
specialty desserts. All were wonderful.<br />
However, my personal favorite was the<br />
chocolate fondant, whereas my wife<br />
raved over the crème brulee.<br />
Chef du cuisine Laurent Loupiac,<br />
and Sous Chef David Desloges have<br />
much to be proud of. “Kudos’ to<br />
managing partner Roy B. Assad, (who<br />
also owns the successful Leila's, on the<br />
corner of Datura and Dixie) upon<br />
another successful restaurant. His<br />
carefully thought through brasserie<br />
would make any "Parisian" feel like their<br />
dining back home.<br />
This Choron sauce is a béarnaise with tomato puree added. To complete the dish, serve<br />
the filet over a potato gratinee with steamed broccoli on the side.<br />
The Meat<br />
Whole beef Tenderloin (any beef or steak with minimal fat content may be<br />
substituted)<br />
Kosher salt<br />
Cracked Black pepper<br />
Preheat grill to medium high. Remove all fat and membrane from the filet. Tuck “tail”<br />
under filet, and tie with string to give it a nicer shape. Season filet with salt and pepper,<br />
and place on very hot grill to allow a sear to begin. Be careful not to burn the meat. Sear<br />
on all sides, then reduce the heat to medium, and allow filet to cook for 15-20 minutes on<br />
indirect heat. Turn filet occasionally to cook filet evenly. A meat thermometer should<br />
register approximately 130 to 135 degrees for medium rare. Place on carving board,<br />
and allow to “repose” for ten minutes before slicing.<br />
The Sauce<br />
4 TB White Vinegar 1/3 cup Tomato puree<br />
4 TB Fresh Tarragon Kosher Salt<br />
1/4 cup Chopped Shallots Fresh Ground pepper<br />
1/4 cup Water 2 TB Fresh Chopped Parsley<br />
4 Egg Yolks 2 TB Fresh Chopped Tarragon<br />
8 ounce Softened Butter<br />
Place the vinegar, tarragon, and shallots in a small saucepan. Boil down the vinegar to<br />
almost nothing. Remove the pan from the heat and let cool slightly. Add the water and<br />
egg yolks, whisking constantly. Over low heat, whisk in the butter a little at a time until<br />
thick and creamy. Stir in the tomato puree. Season to Taste with salt and pepper. Keep<br />
warm in a water bath. Stir in parsley and tarragon just before serving.<br />
Carve beef into thin slices and place over potato. Pour some sauce over the slices. Pass<br />
some additional sauce on the side.<br />

Nuccio’s Pizza Parlor<br />
When I was a kid growing up,<br />
Friday night was Pizza Night. It was a<br />
family “routine” for my parents, two<br />
brothers, and I to go to our favorite<br />
Pizza Parlor, and get the traditional,<br />
round, thin crust version, or the infamous<br />
“Sicilian”, square, thick crust, pizza. I<br />
was reminded of “pizza night” when we<br />
arrived at Nuccio’s Pizza Parlor last<br />
Friday night.<br />
Having been established for less<br />
then one year, this well kept secret on<br />
the southeast corner of Lyons Road, and<br />
Lantana Road, just can’t be kept a secret<br />
any longer.<br />
Pizza is king here, of course.<br />
Although it was a difficult decision<br />
between the pizza or the calzones<br />
available.<br />
Pizza is available in 14” or 16”<br />
sizes, and the Sicilian comes in a<br />
massive 17”x17”. You can create your<br />
own combinations, and all of them will<br />
feature a crispy crust that I look for in a<br />
good pizza. The two pies my party<br />
ordered were perfectly cooked with a<br />
golden, crispy, crust. The sauce was<br />
flavorful, and the<br />
toppings were<br />
generous.<br />
Turn the menu<br />
over and you'll<br />
find other “pizza parlor” selections such<br />
as stromboli, calzones, pasta, and hot<br />
and cold submarine sandwiches on nice<br />
Italian bread.<br />
Everything I tasted here was good.<br />
The ricotta, mozzarella, and romano<br />
calzone, for instance, did not have that<br />
“precooked” or “reheated” taste. It was<br />
evident that the calzone was created<br />
moments before. In addition to pizza,<br />
Nuccio’s features flavorful pasta<br />
selections as well. The tomato sauce<br />
here is very good, which says a lot<br />
about a pizzeria.<br />
Save room for dessert. Delicious<br />
desserts such as tiramisu and cannoli are<br />
family recipes. There's also free delivery<br />
for folks who live nearby. ($10.00<br />
minimum.)<br />
I finally found it! Nothing<br />
pretentious. Nothing fancy. My Friday<br />
night Pizza haunt.<br />

OOColor is a resident of Islamorada<br />
in the <strong>Florida</strong> Keys.<br />
Frank’s company provides some of the<br />
biggest corporations in the country with<br />
large format, color and black and white<br />
printing for billboards, trade shows,<br />
packaging, and special events. Initially,<br />
Frank worked with artists to develop<br />
reproductions of their original art. His<br />
method provided the artists with the<br />
ability to duplicate their artwork, sell<br />
prints at a reasonable price, and retain<br />
the originals.<br />
One of the benefits to the artist was that<br />
their original artwork could be<br />
reproduced on materials that closely<br />

step involves you picking a material on<br />

As the lazy days<br />
of summer wind<br />
down it’s time to<br />
shop for school supplies, buy another<br />
pair of new sneakers, and get back into<br />
the routine of school. With a new<br />
school year comes new teachers, new<br />
friends, and new threats to our children’s<br />
health and safety. So, to keep them safe<br />
and healthy this upcoming school year,<br />
here are a few tips to make this year the<br />
best ever.<br />
Kids get sick. Colds, coughs, tummy<br />
bugs, and flu’s are going to happen<br />
especially in the close quarters of a<br />
classroom In general the younger the<br />
child, the more frequently illnesses<br />
occur. Now, while we can’t prevent our<br />
kids from ever getting sick we can<br />
decrease the frequency of these common<br />
bugs with a few simple techniques. The<br />
single most important thing we can do to<br />
prevent the spread of germs is to wash<br />
our hands. Encourage your child to<br />
wash his hands at home and at school,<br />
before and after meals, after using the<br />
restroom, and after playing outside.<br />
Antibacterial hand sanitizers are also<br />
good to keep in your purse, the car, and<br />
your child’s book bag. Encourage your<br />
children not to share cups or straws with<br />
their friends, and do not send them to<br />
school with a fever, a red eye, an<br />
uncontrollable cough, or a runny nose<br />
with colored discharge (these are usually<br />
due to viral infections which should self<br />
resolve, but may be due to a bacterial<br />
infection). Check with your child’s school<br />
for their specific guidelines, or call your<br />
child’s pediatrician for more details.<br />
With the start of school, a little bit<br />
of freedom and independence will be<br />
bestowed upon your child. He may be<br />
allowed to ride his bike to school, or<br />
wait at the bus stop without adult<br />
supervision. Now is a good time to<br />
establish safety rules to help prevent<br />
injuries. If your child rides his bike,<br />
rollerblades, or skateboards he must<br />
wear a helmet…period! Approximately<br />
85% of brain injuries can be prevented
with the use of a helmet so if he doesn’t<br />
want to wear one he shouldn’t get to<br />
ride his bike. When walking to school,<br />
make sure your child understands how to<br />
cross the street correctly and to use cross<br />
walks with crossing guards whenever<br />
possible. Arrange for him to walk with<br />
a buddy. For those early morning pickups<br />
consider adding a reflector to his<br />
book bag so people can see him when<br />
it is still dark. Now is also a good<br />
time to talk your child about stranger<br />
danger Remind him never to go<br />
anywhere with someone he doesn’t<br />
know, even if the person looks nice.<br />
Discuss who is allowed to pick him up<br />
from school if you are unable to,. In<br />
addition, develop a family “code word”<br />
which your child will need to hear<br />
before he can leave with anyone who is<br />
not an immediate relative.<br />
The start of a new school year is a<br />
good time to reexamine your child’s<br />
sleep habits. Poor sleep habits can<br />
make it difficult for a child to reach his<br />
maximum potential and contribute to<br />
behavioral and emotional problems.<br />
The average school age child needs<br />
9–12 hours of sleep per night, and a set<br />
routine should be followed; for example:<br />
homework, playtime, bath, quiet time,<br />
and sleep time. Your child should not go<br />
to sleep with the TV or music playing.<br />
Nature sounds can be soothing for those<br />
kids who have difficulty falling asleep.<br />
Contact your child’s pediatrician for<br />
more difficult sleep problems.<br />
Back to school is an exciting time<br />
of the year. By discussing good<br />
hygiene, safety, and sleep habits, you<br />
can start your children off on the right<br />
foot. Remember, if you ever have<br />
questions about illnesses, injuries or<br />
development your pediatrician is just a<br />
phone call away.<br />

Have you ever considered plastic<br />
surgery? Of a certainty, finding and<br />
choosing the right physician is a very<br />
individualized process, whether he or<br />
she is an internist, cardiologist or plastic<br />
surgeon. There are many factors to<br />
consider when choosing the right<br />
physician for you. First, do your<br />
homework (this involves speaking to<br />
friends who have undergone cosmetic<br />
surgery), search the Internet, and consult<br />
with plastic surgeons. In my experience,<br />
through listening to what patients tell me,<br />
it is wise to see no more than 3<br />
surgeons, as this may become extremely<br />
confusing. Next, insure that you have<br />
an exceedingly first-class rapport with<br />
not only your surgeon, but with each<br />
and every member of the staff you are in<br />
contact with. The nursing staff and<br />
administrative staff are reflections of your<br />
surgeon. From your first contact on the<br />
telephone, you should be treated with<br />
dignity, respect, efficiency,<br />
professionalism and courtesy. This will<br />
give you an indication of what your<br />
overall experience will be like, and you<br />
should insure that your experience in the<br />
office is positive, from the surgeon to the<br />
receptionist. Ask yourself, is the office<br />
clean? Are you seen for your<br />
appointment in a timely fashion? Are all<br />
of your questions answered?<br />
We suggest to patients, from start to<br />
finish, that they write questions down as<br />
they think of them, and bring the list to<br />
the office, whether it’s for their initial<br />
consultation, preop appointments with<br />
the nurse and the surgeon, the morning<br />
of surgery and all postop appointments.<br />
We stress to patients that the more<br />
informed they are, and that they have a<br />
good understanding of the process they<br />
will undergo, the easier their<br />
postoperative period will be. Another<br />
important question to ask would be: Is<br />
your surgeon board certified, and is the<br />
operating room licensed and accredited?<br />
Licensed operating<br />
rooms must adhere to<br />
certain criteria set forth by<br />
the State of <strong>Florida</strong> and<br />
other accrediting bodies.<br />
Thus, it is important that<br />
you ascertain this very<br />
important fact in choosing<br />
your surgeon.<br />
It is of the utmost<br />
importance that you trust<br />
your surgeon. Ask to see<br />
photos, and to speak with<br />
other patients who have<br />
undergone similar<br />
surgeries. Request a tour of<br />
the facility and, above all,<br />
if you do not understand<br />
what you are being told,<br />
ask as many questions as<br />
you need to feel<br />
comfortable. Remember<br />
that there are no such<br />
things as “stupid questions”.<br />
Cosmetic surgery should be<br />
considered a positive, and patients<br />
should approach it as such,<br />
remembering however, that it is surgery,<br />
and above all else, safety should be the<br />
prime consideration.<br />
You are about to embark on a very<br />
intimate relationship with approximately<br />
5 to 7 people; your surgeon, his or her<br />
nurses, the anesthesia department, and<br />

3 or 4 administrative personnel, all of<br />
whom will play an integral role in the<br />
process. Remember also, that although<br />
price is a consideration, you should not<br />
choose your surgeon by price alone.<br />
Prices vary widely throughout South<br />
<strong>Florida</strong> and some things to consider are<br />
exactly which procedures are being<br />
performed, and by which methods.<br />
Although patients may believe that they<br />
are undergoing the exact procedure their<br />
friend just underwent, it is important to<br />
remember that this also is very<br />
individualized, and one person may<br />
require more or less of a similar<br />
procedure, depending on the body<br />
habitus and the amount of surgery to be<br />
performed, thereby affecting price. Trust,<br />
dignity, professionalism, courtesy, civility,<br />
confidence and reliability are all words<br />
you should be able to ascribe to your<br />
surgeon and his or her staff, if you are<br />
undergoing breast augmentation,<br />
rhinoplasty, face lift or liposculpture to<br />
name a few.<br />
There are many, and varied<br />
reasons, why people consider and<br />
undergo cosmetic surgery; greater selfconfidence<br />
in the work place and in<br />
their social lives, especially in today’s<br />
fast-paced environment. Some people<br />
may be suddenly faced with life altering<br />
changes created by either a death<br />
or divorce, and this causes them to<br />
look more closely at their physical<br />
appearance and determine that they<br />
would like to appear more rested,<br />
fresher and less tired looking. In<br />
addition people may finally be in a<br />
position in their life when they can<br />
finally afford to improve upon an<br />
imperfection that has been bothering<br />
them for years.<br />
When all is said and done, plastic<br />
surgery can improve your life in a<br />
positive way. You should follow the<br />
guidelines listed above to help you make<br />
an informed choice. With a little work<br />
on your part you can ensure your<br />
experience with plastic surgery will be a<br />
positive one.<br />

to his father, the former Chief of Police<br />
of Riviera Beach. Sports fans will love<br />
Mr. Reynolds’ own collection of sports<br />
memorabilia that is comprised mostly of<br />
gifts from his friends and associates.<br />
The main part of the museum is also<br />
the most popular. From movie posters<br />
and celebrity pictures, to TV and movie<br />
props, to Burt’s numerous awards, the<br />
museum is an awesome display of one<br />
of Hollywood’s greatest stars.<br />
The museum is run under the<br />
direction of Executive Director, Mike<br />
Daniel and his assistant Greg<br />
Goldsbury. Mike, a treasure hunter by<br />
trade, is the explorer who discovered<br />
Blackbeard’s ship in 1996. Their<br />
dedication to the museum is felt in the<br />
warmth and admiration that they<br />
have for Mr. Reynolds.<br />
Mr. Daniel’s association<br />
with Mr. Reynolds came about in<br />
1989 when he was approached<br />
at his marine hardware store,<br />
The Sea Chest, by the art<br />
director for the B.L.Stryker movie<br />
that was shooting in town. Mike<br />
was asked to be the custodian of<br />
the show’s houseboat that year<br />
and later became the show’s<br />
marine coordinator. Mike<br />
continued to work with numerous<br />
local projects for Mr. Reynolds.<br />
While in production for The<br />
Maddening, Mr. Reynolds asked Mike<br />
and another member of the crew to help<br />
convert a horse barn on his ranch into<br />
the museum which was moved to its<br />
present location 3 years ago. “What<br />
safer place could be found to display<br />
such memorabilia than a former bank?”<br />
Mike asks with a smile as he recalls<br />
finding the present location.<br />
“Mr. Reynolds’ designed the entire<br />
museum himself,” Mike adds, “Burt did it<br />
all” Most celebrities never go back<br />
home, but Burt has<br />
always tried to give so<br />
much back to this<br />
community.” The<br />
museum is also<br />
committed to<br />
encouraging and<br />
developing different<br />
types of community<br />
programs to develop<br />
the local arts.<br />
I asked Greg<br />
Goldsbury what was<br />
to be the part of the<br />
museum that the public<br />
seemed to gravitate<br />
towards? He quickly<br />
answered, “The<br />
Smokey and the Bandit<br />
display.” And the most<br />
asked question by the<br />
public? “That’s easy,”<br />
answered Greg. “It’s:<br />

John Goodman, better known for his role<br />
as Roseanne Barr’s husband in the TV<br />
series Roseanne, stopped in a few<br />
months ago to check things out. √<br />
I highly recommend a visit the Burt<br />

Bait And<br />
Switch!<br />

When it comes to<br />
selling your home<br />
here in South <strong>Florida</strong> many sellers are<br />
being lured into listing their homes with<br />
limited service real estate providers<br />
offering to charge only 2% or 2.5%<br />
commissions. Beware of the bait and<br />
switch! When hiring certain limited<br />
service providers to list your home, the<br />
price may look enticing at face value but<br />
at what cost? Will you actually be saving<br />
money when doing business with these<br />
types of firms?<br />
When contacted for their services,<br />
they will make an appointment to view<br />
your house. You’ll soon learn that the 2%<br />
commission does not get your home listed<br />
on the multiple listing service (MLS), a<br />
computer database where realtors can<br />
review properties, nor pay for the agents<br />
of potential buyers. This will result in very<br />
limited exposure for your property. One<br />
of these providers admits in their contract:<br />
“This 2% plan can affect the extent to<br />
which your property is exposed to<br />
potential buyers.” Some firms will then<br />
add an additional 2% to place your<br />
house into MLS to expose it to other<br />
realtors and pay the buyer’s agents. But<br />
many realtors will avoid showing your<br />
house for only 2% commission.<br />
“A professional real estate agent will be<br />
able to put thousands of dollars or more<br />
into a seller’s pocket.”<br />
Sign up with these agencies, and<br />
you may be forced to use their title<br />
company and home warranty plan,<br />
neither is industry standard. These<br />
services often respond to this by offering<br />
their full service plans for “only” 7%<br />
commission. But this is 1% - 2% higher<br />
than what you’d pay for from most<br />
professional realtors. Seller, beware! This<br />
practice is commonly known as “bait and<br />
switch”.<br />
“Choosing the offer is one of the most<br />
important things that a full service<br />
provider can help sellers do.”<br />
It’s a very hot market in South<br />
<strong>Florida</strong>. Here are some tips to keep you<br />
from getting burned by the limited service<br />
providers.<br />
1. Read the listing contract that you are<br />
about to sign.<br />
If you are unhappy during the term of<br />
the listing, make sure you are able to get<br />
out of it. Many of these providers carry<br />
very hefty penalty fees.<br />
2. Check the company’s background.<br />
Are they licensed? The person coming<br />

Are You Ready For Some Football???<br />

Ahhhh, its early September. You wake<br />
up with a goofy smile on your face. There is<br />
an extra bounce in your step. The day<br />
looks bright no matter what. Food tastes<br />
better, the water fresher. You are in a great<br />
mood even though your Mother-in-Law is coming over for<br />
dinner…well, let’s not push it. All of this could only mean one<br />
thing. September is finally here and the new football season is<br />
about to begin!<br />
No matter which team you root for, everyone is tied for first<br />
place and there is fresh optimism in the air. Your team<br />
strengthened itself in the off season by adding new players<br />
through the draft and free-agency. Players from last year have<br />
worked hard to perform better in the coming season. September<br />
is the time of year when even the sourest of pessimists can find a<br />
way to believe that their team is going to the Super Bowl.<br />
While the greatest fans can convince themselves that their<br />
team is going to finish #1, the football gurus in Las Vegas use a<br />
far more sophisticated system to determine which teams actually<br />
have a better chance of making it to the Super Bowl than others.<br />
In an effort to provide some unbiased predictions, following this<br />
article is a team by team breakdown of the Las Vegas odds each<br />
team is ranked with to win the Super Bowl as well as the Las<br />
Vegas projected number of wins for the regular season. The<br />
prediction segments are my opinions for the coming season. I<br />
have listed my opinion on whether the team will finish at, above,<br />
or below the projected Vegas win total. I hope you find the<br />
information informative as well as entertaining.<br />
As a reminder to all football fans, no matter what Las Vegas<br />
or this writer is predicting, it is early September, every team is<br />
tied for first, and your favorite team can win the Super Bowl!<br />
Capsules are broken down by division. Next to team name is Las Vegas Odds for that<br />
team to win the Super Bowl listed then the Las Vegas projected season win total. My<br />
predictions follow.<br />
AFC EAST<br />
NEW ENGLAND PATRIOTS 6-1 & 11<br />
Prediction: Right at the 11 win total and division winner.<br />
NEW YORK JETS 25-1 & 9.5<br />
Prediction: Will just eclipse the 9.5 and win 10 games and be a Wild Card winner.<br />
BUFFALO BILLS 40-1 & 8.5<br />
Prediction: Too young on offense to compete and fall below with 5-6 wins.<br />
MIAMI DOLPHINS 100-1 & 5.5<br />
Prediction: Will surpass the projected total and win 8.<br />
AFC NORTH<br />
PITTSBURGH STEELERS 16-1 & 9.5<br />
Prediction: Will come up just short on the 9.5 and win 9.<br />
BALTIMORE RAVENS 17-1 & 9.5<br />
Prediction: Narrowly go over the win total with 10 and take the division title.<br />

Build the Partnership at School<br />

With your home all prepped and<br />
ready-to-go, get as familiar as you can<br />
with the school and classroom where<br />
your child will be spending so many<br />
hours away from home. If there is a<br />
school visiting day, be sure to attend. If<br />
not, make your own as soon as possible.<br />
Get to know your child’s school,<br />
classroom, and teacher as well as<br />
possible.<br />

Having a positive relationship with<br />
your child’s teacher will be worth its<br />
weight in gold. This is your partnership.<br />
From your child’s point of view, it will<br />
help greatly for him or her to know that<br />
you have a direct connection with this<br />

paper for the teacher’s response.<br />
Your child will be the special<br />
messenger who carries the<br />
messages back and forth between<br />
the two important partners. This will<br />
ensure an open line of<br />
communication between you and<br />
your child’s teacher.<br />
Having your home set up for<br />
school, will show great respect and<br />
appreciation for your child’s efforts.<br />
Familiarizing yourself with the school,<br />
classroom, and teacher, demonstrates<br />
strong support for what is being asked of<br />
your child. When you keep a<br />
communication system going, you are<br />
actively creating and building a<br />
partnership. A strong connection<br />
between home and school is one of the<br />
major building blocks for guiding your<br />
child through a year of school success.<br />

In the wake of various well known<br />
cases involving people who are unable<br />
to make their own choices, such as Terry<br />
Schiavo, it is very important that you<br />
give serious thought to basic family<br />
estate planning tools such as the living<br />
will and the health care surrogate<br />
designation. You should also, think about<br />
a testamentary will or revocable living<br />
trust and a durable power of attorney.<br />
Many people feel that the<br />
catastrophes these “dooms-day<br />
documents” are meant to address are<br />
just so remote and so difficult to think<br />
about. With our busy schedules, it’s hard<br />
to take the time to go to a lawyer’s<br />
office, tell your life story, think about<br />
your mortality and get it done. People<br />
are under the misconception that it’s too<br />
expensive and these things cannot<br />
happen to them.<br />
But the facts are: (1) things can<br />
happen at any time, (2) it doesn’t take a<br />
lot of time, (3) it’s not expensive and (4)<br />
you don’t even have to leave your house<br />
except to have two witnesses present<br />
when you sign (plus a notary if it’s a<br />
will). In fact, if you don’t care that you<br />
don’t actually meet the attorney who<br />
prepares your documents, the whole ball<br />
of wax can be done without ever going<br />
to a lawyer’s office. The information can<br />
be taken over the phone, payment can<br />
be mailed, documents can be mailed to<br />
you for review, and then they can be<br />
executed anywhere there are the proper<br />
witnesses and a notary if needed. Some<br />
banks and brokerage houses will do this<br />
for you. Or, if you can’t find a spot, the<br />
lawyer who prepared the documents will<br />
be happy to supervise their execution in<br />
his/her office. Execution can be<br />
accomplished in under twenty minutes.<br />
As to the living will, you all know<br />
that the Terry Schiavo matter was heartrending<br />
no matter what side of politics<br />
you were on. The execution of a living<br />
will and a healthcare surrogate<br />
designation keeps you in control of your<br />
own destiny even if you are incapable of<br />
expressing your wishes any longer. It<br />
allows you to choose, while you still can,<br />
how you are to be dealt with in the<br />
event that the only thing keeping you<br />
alive is a machine. Your designated<br />
healthcare surrogate is selected by you<br />
to make decisions on your behalf if you<br />
can’t. That person should be someone<br />
very close to you and who can be<br />
trusted to carry out your wishes in<br />
accordance with your instructions<br />
thoughtfully set forth in advance in your<br />
living will. Thus, the title “advance<br />
directives.” If the document is properly<br />
prepared, there is a formal procedure<br />
set forth therein for the proper<br />
determination of your condition. Even<br />
then, your trusted health care surrogate<br />
can still refuse if he/she thinks that it’s<br />

just not the right time. So, those TV<br />
dramas where the surgeons stand over a<br />
still warm body waiting to harvest<br />
organs, are just that, TV. There are<br />
procedures in place to prevent that from<br />
happening.<br />
Both the living will and healthcare<br />
surrogate designation, if properly<br />
drafted, also address privacy issues that<br />
have now come into all of our lives via<br />
“HIPAA” (the Health and Income<br />
Portability and Accountability Act of<br />
1996). Because of this legislation, even<br />
immediate family members can be<br />
prevented from seeing a loved one’s<br />
medical records, which may be needed<br />
for decision making purposes, unless<br />
your doctor and the hospital have your<br />
living will on file with the proper HIPAA<br />
authorizations contained therein. This<br />
has been a nightmare for at least two of<br />
my clients who came to me for help to<br />
remedy this very situation.<br />
Surely, this article is not meant to<br />
preach nor should it be construed as<br />
advice as to what your living will should<br />
say about unthinkable things. The intent<br />
here is simply to sensitize anyone<br />
