Effective January 2012<br />

COMMISSIONS & TERMS OF PAYMENT<br />

• Retail rates are non-commissionable.<br />

• Payment is due upon receipt of invoice.<br />

• Payment must accompany all new accounts<br />

until credit is established.<br />

• Advertiser and agency shall be jointly and<br />

severally liable for such monies as are due<br />

and payable to the <strong>Telegram</strong> & <strong>Gazette</strong> for<br />

advertising ordered by the agency.<br />

• MasterCard, Discover, American Express<br />

and Visa accepted.<br />

POLICY – ALL CLASSIFICATIONS<br />

• All copy, illustrations and artwork, is subject<br />

to approval by the publisher.<br />

• Publisher reserves the right to reject or<br />

revise objectionable copy.<br />

• Publisher retains the right to decide under<br />

which classification advertising will be<br />

charged.<br />

• The word “Advertisement” must be printed<br />

above each column on any advertisement<br />

resembling news matter.<br />

• Position requests are honored as make-up<br />

permits but no specific page or section is<br />

guaranteed. No allowance will be given if<br />

position “requests” cannot be honored.<br />

• All composition by the <strong>Telegram</strong> & <strong>Gazette</strong><br />

remains its property and shall not be<br />

reproduced in any way for use in other<br />

publications without the prior written<br />

consent of the <strong>Telegram</strong> & <strong>Gazette</strong>.<br />

• An extra charge will be made when an<br />

advertiser changes the copy after the<br />

advertisement has been set, or when<br />

unusual layout or copy produces additional<br />

expense in preparing the advertisements.<br />

• Advertisements on order, cancelled after<br />

processing prior to publication date and not<br />

rescheduled within 30 days, will be billed at<br />

the current composition rate.<br />

• Ads exceeding 19 inches in depth,<br />

broadsheet and 10 inches in depth, tabloid,<br />

will be floated in the full depth and charged<br />

21 and 12 inches respectively.<br />

• Purchased space is for the exclusive use of<br />

the individual customer. Space can not be<br />

used for brokering or include any other<br />

business without pre-approval by the<br />

<strong>Telegram</strong> & <strong>Gazette</strong> at applicable rates.<br />

CLAIMS FOR ERRORS OR OMISSIONS<br />

• The <strong>Telegram</strong> & <strong>Gazette</strong> shall not be liable<br />

for failure to publish an ad, or for<br />

typographical errors in publication, except to<br />

the extent of the cost of the ad for the first<br />

day’s insertion. Adjustment for errors may be<br />

limited to the cost of the portion of the ad<br />

printed in error.<br />

• Any claims in regard to the size of an<br />

advertisement, the rate charged or the<br />

content should be presented in writing within<br />

sixty days (60) after receipt of invoicing.<br />

• Any claims presented after the sixty-day<br />

period will not be honored or considered.<br />

CONTRACT REGULATIONS<br />

• The <strong>Telegram</strong> & <strong>Gazette</strong> may revise its<br />

contract advertising rates, rebates, discounts<br />

or specifications at any time without notice.<br />

The advertiser may cancel a contract, without<br />

adjustment charges, at any date on which new<br />

and higher rates become effective.<br />

• Contract rates cover only advertising relating to<br />

the advertiser’s regular business. The<br />

advertiser cannot transfer the contract, or any<br />

of its privileges, in whole or in part, to any other<br />

person or concern.<br />

• In the event that the advertiser is unable to<br />

fulfill their annual contract, they will be short-<br />

rated back to the level that is consistent with<br />

space used. If space/volume exceeds the<br />

contract level, the publisher will rebate up one<br />

level at the end of the contract year.<br />

• If the advertiser discontinues a contract before<br />

its expiration and a rate adjustment is<br />

necessary, the rate will revert to the rate for the<br />

proper space and/or frequency bracket used.<br />

• The open rate will be charged in the absence<br />

of a contract.<br />

• A contract may be cancelled by the publisher<br />

for any breach of its terms or conditions by the<br />

advertiser.<br />

• Failure to publish and distribute any issue or<br />

issues of the <strong>Telegram</strong> & <strong>Gazette</strong> shall not<br />

constitute a breach of contract.<br />

• Space used in the Sunday or Daily paper at<br />

the repeat rate applies toward fulfillment of<br />

bulk space contracts.<br />

• Divisional contracts working off master contract<br />

rates must have corresponding effective dates.<br />

• Failure by the publisher to enforce any of the<br />

specifications of a contract shall not constitute<br />

a waiver of such specifications.<br />

• Contracts which have expired 45 days or more<br />

past expiration date will be invoiced at the<br />

earned rate.<br />
