Effective January 2012 COMMISSIONS & TERMS OF PAYMENT • Retail rates are non-commissionable. • Payment is due upon receipt of invoice. • Payment must accompany all new accounts until credit is established. • Advertiser and agency shall be jointly and severally liable for such monies as are due and payable to the Telegram & Gazette for advertising ordered by the agency. • MasterCard, Discover, American Express and Visa accepted. POLICY – ALL CLASSIFICATIONS • All copy, illustrations and artwork, is subject to approval by the publisher. • Publisher reserves the right to reject or revise objectionable copy. • Publisher retains the right to decide under which classification advertising will be charged. • The word “Advertisement” must be printed above each column on any advertisement resembling news matter. • Position requests are honored as make-up permits but no specific page or section is guaranteed. No allowance will be given if position “requests” cannot be honored. • All composition by the Telegram & Gazette remains its property and shall not be reproduced in any way for use in other publications without the prior written consent of the Telegram & Gazette. • An extra charge will be made when an advertiser changes the copy after the advertisement has been set, or when unusual layout or copy produces additional expense in preparing the advertisements. • Advertisements on order, cancelled after processing prior to publication date and not rescheduled within 30 days, will be billed at the current composition rate. • Ads exceeding 19 inches in depth, broadsheet and 10 inches in depth, tabloid, will be floated in the full depth and charged 21 and 12 inches respectively. • Purchased space is for the exclusive use of the individual customer. Space can not be used for brokering or include any other business without pre-approval by the Telegram & Gazette at applicable rates. CLAIMS FOR ERRORS OR OMISSIONS • The Telegram & Gazette shall not be liable for failure to publish an ad, or for typographical errors in publication, except to the extent of the cost of the ad for the first day’s insertion. Adjustment for errors may be limited to the cost of the portion of the ad printed in error. • Any claims in regard to the size of an advertisement, the rate charged or the content should be presented in writing within sixty days (60) after receipt of invoicing. Box 15012 Worcester, MA 01615-0012 • Any claims presented after the sixty-day period will not be honored or considered. CONTRACT REGULATIONS • The Telegram & Gazette may revise its contract advertising rates, rebates, discounts or specifications at any time without notice. The advertiser may cancel a contract, without adjustment charges, at any date on which new and higher rates become effective. • Contract rates cover only advertising relating to the advertiser’s regular business. The advertiser cannot transfer the contract, or any of its privileges, in whole or in part, to any other person or concern. • In the event that the advertiser is unable to fulfill their annual contract, they will be short- rated back to the level that is consistent with space used. If space/volume exceeds the contract level, the publisher will rebate up one level at the end of the contract year. • If the advertiser discontinues a contract before its expiration and a rate adjustment is necessary, the rate will revert to the rate for the proper space and/or frequency bracket used. • The open rate will be charged in the absence of a contract. • A contract may be cancelled by the publisher for any breach of its terms or conditions by the advertiser. • Failure to publish and distribute any issue or issues of the Telegram & Gazette shall not constitute a breach of contract. • Space used in the Sunday or Daily paper at the repeat rate applies toward fulfillment of bulk space contracts. • Divisional contracts working off master contract rates must have corresponding effective dates. • Failure by the publisher to enforce any of the specifications of a contract shall not constitute a waiver of such specifications. • Contracts which have expired 45 days or more past expiration date will be invoiced at the earned rate. 1/1/2012 V1
