The Department <strong>of</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services<br />

<strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services<br />

The <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services serves the Crookst<strong>on</strong> campus <str<strong>on</strong>g>and</str<strong>on</strong>g> is resp<strong>on</strong>sible for all property<br />

owned by the <strong>University</strong>. The department seeks to maintain a staff <strong>of</strong> 1 director, <str<strong>on</strong>g>and</str<strong>on</strong>g> 3 full-time security <strong>of</strong>ficers<br />

who provide services in proactive patrol, crime preventi<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> investigati<strong>on</strong>, law enforcement, <str<strong>on</strong>g>and</str<strong>on</strong>g> emergency<br />

resp<strong>on</strong>se.<br />

The department patrols the <strong>University</strong> community by squad <str<strong>on</strong>g>and</str<strong>on</strong>g> foot. In additi<strong>on</strong> to patrol operati<strong>on</strong>s, the<br />

department investigates crimes <str<strong>on</strong>g>and</str<strong>on</strong>g> provides directed crime preventi<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> other support to the <strong>University</strong>.<br />

All 911 calls made from campus, including from cell ph<strong>on</strong>es, are received in the Crookst<strong>on</strong> police department’s<br />

dispatch center. The 24-hour 911 center is staffed with pr<strong>of</strong>essi<strong>on</strong>ally trained emergency dispatchers.<br />

Student <str<strong>on</strong>g>Security</str<strong>on</strong>g> Guards<br />

The department employs students as uniformed security guards. Student security guards provide escorts,<br />

routinely inspect exterior lighting <str<strong>on</strong>g>and</str<strong>on</strong>g> campus teleph<strong>on</strong>es, <str<strong>on</strong>g>and</str<strong>on</strong>g> provide building security. <str<strong>on</strong>g>Security</str<strong>on</strong>g> guards act<br />

as the “eyes <str<strong>on</strong>g>and</str<strong>on</strong>g> ears” <strong>of</strong> the department. They have no arrest powers, but are trained to determine when police<br />

should be called.<br />

<str<strong>on</strong>g>Security</str<strong>on</strong>g> guards are employees <strong>of</strong> the department <str<strong>on</strong>g>and</str<strong>on</strong>g> are subject to a criminal background check before hiring<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> undergo 30–40 hours <strong>of</strong> training.<br />

Crime Preventi<strong>on</strong><br />

Ensuring the safety <strong>of</strong> <strong>University</strong> community is a group effort. We all must do our part. When working,<br />

visiting, or attending classes <strong>on</strong> campus, keep in mind the following:<br />

n Report any suspicious pers<strong>on</strong>s or activities to the <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services Department, Centennial Hall 1110,<br />

218-281-8531.<br />

n Do not leave valuables unattended or unsecure.<br />

n Do not prop open entrances to buildings.<br />

n Lock your work <str<strong>on</strong>g>and</str<strong>on</strong>g> living areas every time you leave.<br />

n Report any maintenance problems to Facilities Management.<br />

n Use the escort service rather than walk al<strong>on</strong>e at night.<br />

n Be mindful <strong>of</strong> your surroundings.<br />

n Report lost keys immediately.<br />

Reporting a Crime<br />

Promptly <str<strong>on</strong>g>and</str<strong>on</strong>g> accurately report all crimes to the <strong>University</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services Department or appropriate police<br />

agencies. The <strong>University</strong> Department is located at Centennial Hall 1110. The main teleph<strong>on</strong>e number is 218-281-<br />

8531.<br />

To report an emergency, dial 9-1-1. Be prepared to give the following informati<strong>on</strong>:<br />

n Type <strong>of</strong> emergency<br />

n Your name<br />

n Your locati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> locati<strong>on</strong> <strong>of</strong> the emergency (if different)<br />

n Your ph<strong>on</strong>e number<br />

n If applicable (e.g., after a crime), a descripti<strong>on</strong> <strong>of</strong> individuals (gender, clothes descripti<strong>on</strong>, height,<br />

weight, hair color)<br />

n If applicable (e.g., after a car accident), a descripti<strong>on</strong> <strong>of</strong> vehicles (color, make, model, license plate<br />

number)<br />

It is important to wait <strong>on</strong> the line until the dispatcher tells you to hang up.<br />

Crime Alerts/Timely Warnings<br />

The <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services Department issues timely warnings (alerts) to the campus community<br />

for crimes that occur <strong>on</strong> <strong>University</strong> property <str<strong>on</strong>g>and</str<strong>on</strong>g> are determined to represent a serious or <strong>on</strong>going<br />

threat. The alerts will be timely <str<strong>on</strong>g>and</str<strong>on</strong>g> aid in the preventi<strong>on</strong> <strong>of</strong> similar occurrences.<br />

In certain cases, the alerts may be distributed to a localized area <strong>of</strong> the <strong>University</strong> if it is determined that the<br />

threat is specific to a particular area.<br />

The alerts may include the following details (if available):<br />

n Descripti<strong>on</strong> <strong>of</strong> the incident<br />

n Physical descripti<strong>on</strong> <strong>of</strong> the suspect, including gender <str<strong>on</strong>g>and</str<strong>on</strong>g> race<br />

n Composite drawing <strong>of</strong> the suspect<br />

n Apparent c<strong>on</strong>necti<strong>on</strong> to previous incidents, if applicable<br />

n Protected class status <strong>of</strong> the victim, if there was an apparent bias motive<br />

n Sex <strong>of</strong> the victim, if relevant<br />

n Injury sustained by the victim<br />

n Date <str<strong>on</strong>g>and</str<strong>on</strong>g> time the campus crime alert was released<br />

n Pertinent crime preventi<strong>on</strong> tips<br />

<strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> Crookst<strong>on</strong> <strong>Campus</strong><br />

Buildings <str<strong>on</strong>g>and</str<strong>on</strong>g> Grounds<br />

The <strong>University</strong> c<strong>on</strong>trols access to its space by using traditi<strong>on</strong>al key systems, electr<strong>on</strong>ic card reader systems, <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

alarms. Key systems are used predominantly for practical <str<strong>on</strong>g>and</str<strong>on</strong>g> financial reas<strong>on</strong>s. Individual resp<strong>on</strong>sibility <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

accountability is the primary method used to ensure that authorized people request, receive, <str<strong>on</strong>g>and</str<strong>on</strong>g> return c<strong>on</strong>trol<br />

keys or cards as their duties dictate.<br />

Any<strong>on</strong>e duplicating, possessing, or using access c<strong>on</strong>trol keys or cards for <strong>University</strong> premises without authorizati<strong>on</strong><br />

will be subject to disciplinary acti<strong>on</strong>s from the <strong>University</strong> or will be subject to criminal charges where<br />

appropriate.<br />

Most campus facilities are accessible during the normal business hours <strong>on</strong> weekdays <str<strong>on</strong>g>and</str<strong>on</strong>g> are accessible for<br />

limited hours <strong>on</strong> weekends. Outside doors <strong>of</strong> newer <strong>University</strong> buildings are equipped with electr<strong>on</strong>ic card<br />

access c<strong>on</strong>trol systems. Many older buildings are being retr<strong>of</strong>itted with such systems. Buildings are locked <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

unlocked by Facilities Management.<br />

<strong>Campus</strong> ph<strong>on</strong>es are available for emergency, medical, <str<strong>on</strong>g>and</str<strong>on</strong>g> service-related calls. The campus teleph<strong>on</strong>es are<br />

located outside <str<strong>on</strong>g>and</str<strong>on</strong>g> housed in yellow boxes. The campus also features several easily recognized blue-light 911<br />

ph<strong>on</strong>es.<br />

Residence Halls<br />

<str<strong>on</strong>g>Safety</str<strong>on</strong>g> in the residence halls is <strong>of</strong> great importance. The <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> has two traditi<strong>on</strong>al halls,<br />

two apartment-style living facilities, <str<strong>on</strong>g>and</str<strong>on</strong>g> a new apartment unit under c<strong>on</strong>structi<strong>on</strong>. All residence halls are fob<br />

access. Guests <str<strong>on</strong>g>and</str<strong>on</strong>g> visitors may access residence hall living areas <strong>on</strong>ly when escorted by a resident <strong>of</strong> that hall.<br />

The informati<strong>on</strong> desk in Centennial Hall is staffed 8 a.m. - Midnight, M<strong>on</strong>day through Friday by <strong>of</strong>fice assistants<br />

during the academic year. In additi<strong>on</strong>, there are security cameras in the lobbies <str<strong>on</strong>g>and</str<strong>on</strong>g> residential access<br />

points as well in other remote areas <strong>of</strong> the buildings.<br />

Each hall has a community advisor <strong>on</strong> duty each night. <str<strong>on</strong>g>Security</str<strong>on</strong>g> guards are <strong>on</strong> site <str<strong>on</strong>g>and</str<strong>on</strong>g> do rounds <strong>of</strong> the<br />

building between 8 p.m. <str<strong>on</strong>g>and</str<strong>on</strong>g> 7 a.m. <str<strong>on</strong>g>Security</str<strong>on</strong>g> guards, <str<strong>on</strong>g>and</str<strong>on</strong>g> <strong>on</strong>-duty community advisors work together to ensure<br />

that safety <str<strong>on</strong>g>and</str<strong>on</strong>g> security needs are met during the evening <str<strong>on</strong>g>and</str<strong>on</strong>g> night hours.<br />

Emergency Notificati<strong>on</strong><br />

In the event <strong>of</strong> a c<strong>on</strong>firmed significant emergency or dangerous situati<strong>on</strong> that poses an immediate threat to<br />

the health <str<strong>on</strong>g>and</str<strong>on</strong>g> safety <strong>of</strong> members <strong>of</strong> the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong>, Crookst<strong>on</strong>, community, the <strong>University</strong> has<br />

in place, several methods for communicating informati<strong>on</strong> quickly. The situati<strong>on</strong> will dictate which <strong>of</strong> the<br />

following notificati<strong>on</strong> methods are used. These include TXT-U, T<strong>on</strong>e Alert Radios, the U’s home page at<br />

www.umn.edu, <strong>on</strong>-the-ground public safety pers<strong>on</strong>nel, <str<strong>on</strong>g>and</str<strong>on</strong>g> informati<strong>on</strong> in the media.<br />

TXT-U Emergency Notificati<strong>on</strong><br />

TXT-U is the <strong>University</strong>’s emergency notificati<strong>on</strong> text messaging system. Students, faculty, <str<strong>on</strong>g>and</str<strong>on</strong>g> staff can stay<br />

informed about critical campus safety informati<strong>on</strong> by registering to receive TXT-U messages.<br />

Only <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> students, faculty, <str<strong>on</strong>g>and</str<strong>on</strong>g> staff can register for TXT-U. However, you can add more<br />

than <strong>on</strong>e mobile device to your account, registering your parents, family, friends, or others.<br />

TXT-U will be used infrequently <str<strong>on</strong>g>and</str<strong>on</strong>g> specifically for real emergency situati<strong>on</strong>s. To register for TXT-U, go to<br />

www.umn.edu/prepared/txtu.<br />

T<strong>on</strong>e Alert Radio<br />

A t<strong>on</strong>e alert radio is a radio that is programmed to receive emergency broadcasts directly from dispatch.<br />

Informati<strong>on</strong> sent to t<strong>on</strong>e alert radios includes severe weather warnings, chemical spills, bomb threats, civil<br />

disturbances, or any other immediate threat <strong>on</strong> campus. Many departments, <strong>of</strong>fices, recepti<strong>on</strong> desks, etc., have<br />

a t<strong>on</strong>e alert radio <str<strong>on</strong>g>and</str<strong>on</strong>g> pass informati<strong>on</strong> <strong>on</strong> to others in their area when they receive<br />

a message.<br />

Disseminati<strong>on</strong> <strong>of</strong> emergency informati<strong>on</strong> to the larger community (i.e., parents, surrounding neighborhoods)<br />

will take place at the incident comm<str<strong>on</strong>g>and</str<strong>on</strong>g>er’s discreti<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> as time allows. Depending <strong>on</strong> the nature <strong>of</strong> the<br />

incident, the <strong>University</strong> could utilize such avenues as the <strong>University</strong> home page (website) or the media. The<br />

first c<strong>on</strong>cern <strong>of</strong> the <strong>University</strong> will be to disseminate informati<strong>on</strong> to those people directly affected by the<br />

emergency.<br />

The <strong>University</strong> has adopted the Nati<strong>on</strong>al Incident Management System as its st<str<strong>on</strong>g>and</str<strong>on</strong>g>ard for resp<strong>on</strong>ding to incidents<br />

(http://policy.umn.edu/Policies/Operati<strong>on</strong>s/<str<strong>on</strong>g>Safety</str<strong>on</strong>g>/NIMS.html). UMC <str<strong>on</strong>g>Security</str<strong>on</strong>g> Officers <str<strong>on</strong>g>and</str<strong>on</strong>g> supervisors,<br />

al<strong>on</strong>g with <strong>University</strong> administrators who have resp<strong>on</strong>sibility during an incident, have been trained in NIMS.<br />

When an incident occurs that causes an immediate threat to the campus, the first resp<strong>on</strong>ders to the scene are<br />

usually from <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services. Depending <strong>on</strong> the incident, other <strong>University</strong> departments or other local or<br />

federal agencies could be involved in resp<strong>on</strong>ding.<br />

Escort Service<br />

The <strong>University</strong> provides a free walking escort service during evening hours (from <str<strong>on</strong>g>and</str<strong>on</strong>g> to <strong>University</strong> locati<strong>on</strong>s)<br />

to all student, staff, faculty, <str<strong>on</strong>g>and</str<strong>on</strong>g> visitors. Clients are met by a uniformed security <strong>of</strong>ficer. The escort service<br />

ph<strong>on</strong>e number is 218-281-8531 or 218-289-0565. Be prepared to give your first name, locati<strong>on</strong> at which to be<br />

met, <str<strong>on</strong>g>and</str<strong>on</strong>g> destinati<strong>on</strong>.<br />

Employee Assistance Program<br />

The Employee Assistance Program (EAP) provides free pr<strong>of</strong>essi<strong>on</strong>al c<strong>on</strong>sultati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> referral services for<br />

<strong>University</strong> employees <str<strong>on</strong>g>and</str<strong>on</strong>g> faculty who are experiencing work or pers<strong>on</strong>al-related difficulties. Spouses,<br />

partners, <str<strong>on</strong>g>and</str<strong>on</strong>g> immediate family members are also eligible for EAP services.<br />

The <strong>University</strong> <strong>of</strong>fers resources to assist students in their well-being. C<strong>on</strong>tact Counseling Department at<br />

Predatory/Sexual Offenders<br />

Certain fel<strong>on</strong>y level sex <str<strong>on</strong>g>and</str<strong>on</strong>g> other predatory <strong>of</strong>fenders are required by law to keep law enforcement agencies<br />

apprised <strong>of</strong> their current residence, employment <str<strong>on</strong>g>and</str<strong>on</strong>g> school addresses, as well as any changes. In additi<strong>on</strong>,<br />

some <strong>of</strong> these <strong>of</strong>fenders have dem<strong>on</strong>strated by their past behavior that they are part <strong>of</strong> a group who pose the<br />

greatest risk to the public when released. This does not mean that they will commit a new crime, just that they<br />

are part <strong>of</strong> a group <strong>of</strong> pers<strong>on</strong>s who might.<br />

State <str<strong>on</strong>g>and</str<strong>on</strong>g> federal law requires <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services to advise the <strong>University</strong> community <strong>of</strong> the release or residence<br />

<strong>of</strong> such predatory <strong>of</strong>fenders in our community. The use <strong>of</strong> this informati<strong>on</strong> to threaten, harass, or intimidate<br />

such individuals may be a crime <str<strong>on</strong>g>and</str<strong>on</strong>g> will not be tolerated.<br />

Victims Rights <str<strong>on</strong>g>and</str<strong>on</strong>g> Resources<br />

n You have the right to apply for financial help for losses resulting from a violent crime. This assistance does<br />

not cover property losses. For an applicati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> informati<strong>on</strong>, call Financial Help, 651-201-7300 or 1-888-622<br />

8799 (TTY 651-205-4827). If you feel your rights as a victim have been violated, call the <strong>Minnesota</strong> Crime<br />

n You have the right to request that the law enforcement agency withhold public access to data revealing your<br />

identity. The law enforcement agency will decide if this is possible.<br />

n You have the right, if an <strong>of</strong>fender is charged, to be informed <strong>of</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> participate in the prosecuti<strong>on</strong> process,<br />

As a university <str<strong>on</strong>g>and</str<strong>on</strong>g> as a community we strive to ensure the safety <str<strong>on</strong>g>and</str<strong>on</strong>g> respect the dignity <strong>of</strong> each student,<br />

staff, <str<strong>on</strong>g>and</str<strong>on</strong>g> faculty member. Sexual assault, relati<strong>on</strong>ship violence, <str<strong>on</strong>g>and</str<strong>on</strong>g> stalking are prohibited at the <strong>University</strong>.<br />

Sexual assault <str<strong>on</strong>g>and</str<strong>on</strong>g> relati<strong>on</strong>ship violence, including threats <strong>of</strong> sexual assault <str<strong>on</strong>g>and</str<strong>on</strong>g> related relati<strong>on</strong>ship violence,<br />

are attacks not <strong>on</strong>ly <strong>on</strong> a pers<strong>on</strong>’s body, but also <strong>on</strong> the pers<strong>on</strong>’s dignity, <str<strong>on</strong>g>and</str<strong>on</strong>g> are not tolerated. To foster a<br />

Board <strong>of</strong> Regents Policy <strong>on</strong> Sexual Harassment prohibits c<strong>on</strong>duct covered by this administrative policy <str<strong>on</strong>g>and</str<strong>on</strong>g> the<br />

Student Code <strong>of</strong> C<strong>on</strong>duct. Further, this policy implements the Regents’ policy in part <str<strong>on</strong>g>and</str<strong>on</strong>g> establishes procedures<br />

for resp<strong>on</strong>ding to incidents involving sexual assault <str<strong>on</strong>g>and</str<strong>on</strong>g> relati<strong>on</strong>ship violence. The commitment <strong>of</strong> the entire<br />

<strong>University</strong> community to this policy c<strong>on</strong>tributes to our goal <strong>of</strong> creating a campus free from sexual assault <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

from other violence that may occur within a pers<strong>on</strong>al, intimate relati<strong>on</strong>ship.<br />

Definiti<strong>on</strong>s<br />

C<strong>on</strong>sent: C<strong>on</strong>sent is informed, freely <str<strong>on</strong>g>and</str<strong>on</strong>g> actively given, <str<strong>on</strong>g>and</str<strong>on</strong>g> mutually understood. If physical force, coerci<strong>on</strong>,<br />

intimidati<strong>on</strong>, <str<strong>on</strong>g>and</str<strong>on</strong>g>/or threats are used, there is no c<strong>on</strong>sent. If the victim/survivor is mentally or physically incapacitated<br />

or impaired so that the victim/survivor cannot underst<str<strong>on</strong>g>and</str<strong>on</strong>g> the fact, nature, or extent <strong>of</strong> the sexual<br />

situati<strong>on</strong>, <str<strong>on</strong>g>and</str<strong>on</strong>g> the c<strong>on</strong>diti<strong>on</strong> was or would be known to a reas<strong>on</strong>able pers<strong>on</strong>, there is no c<strong>on</strong>sent. This includes<br />

c<strong>on</strong>diti<strong>on</strong>s due to alcohol or drug c<strong>on</strong>sumpti<strong>on</strong>, or being asleep or unc<strong>on</strong>scious.<br />

Sexual Assault: Sexual assault is actual, attempted, or threatened sexual c<strong>on</strong>tact with another pers<strong>on</strong> without<br />

that pers<strong>on</strong>’s c<strong>on</strong>sent. Sexual assault <strong>of</strong>ten is a criminal act that can be prosecuted under <strong>Minnesota</strong> state law,<br />

as well as under the Student C<strong>on</strong>duct Code <str<strong>on</strong>g>and</str<strong>on</strong>g> employee discipline procedures.<br />

Relati<strong>on</strong>ship Violence: Relati<strong>on</strong>ship violence means causing physical harm or abuse, <str<strong>on</strong>g>and</str<strong>on</strong>g> threats <strong>of</strong> physical<br />

harm or abuse, arising out <strong>of</strong> a pers<strong>on</strong>al, intimate relati<strong>on</strong>ship. Relati<strong>on</strong>ship violence <strong>of</strong>ten is a criminal act that<br />

can be prosecuted under <strong>Minnesota</strong> state law, as well as under the Student C<strong>on</strong>duct Code <str<strong>on</strong>g>and</str<strong>on</strong>g> employee discipline<br />

procedures.<br />

Administrative Procedures<br />

Victims/Survivors<br />

n Any <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> student or employee who has been sexually assaulted or physically harmed is<br />

str<strong>on</strong>gly encouraged to c<strong>on</strong>tact the Crookst<strong>on</strong> Police Department.<br />

n The <strong>University</strong> str<strong>on</strong>gly encourages individuals to report sexual assault <str<strong>on</strong>g>and</str<strong>on</strong>g> relati<strong>on</strong>ship violence to<br />

appropriate <strong>of</strong>ficials because it is the <strong>on</strong>ly way that acti<strong>on</strong> can be taken against an alleged violator <strong>of</strong> the<br />

policy. Timely reporting <str<strong>on</strong>g>and</str<strong>on</strong>g> a medical examinati<strong>on</strong> within 72 hours are critical in preserving evidence <strong>of</strong><br />

sexual assault, <str<strong>on</strong>g>and</str<strong>on</strong>g> the ability to resp<strong>on</strong>d effectively, but a victim/survivor can report an incident at any<br />

time.<br />

n Victims/survivors are also encouraged to c<strong>on</strong>tact the local victim/survivor service <strong>of</strong>fice <str<strong>on</strong>g>and</str<strong>on</strong>g>/or counseling<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> health care services. All c<strong>on</strong>tacts with victim/survivor service <strong>of</strong>fices such as Crookst<strong>on</strong>’s Community<br />

Violence Interventi<strong>on</strong> Center.<br />

n Victims/survivors are also encouraged to c<strong>on</strong>tact <strong>University</strong> <strong>of</strong>ficials for appropriate acti<strong>on</strong>. Specific c<strong>on</strong>tact<br />

informati<strong>on</strong> is c<strong>on</strong>tained in the C<strong>on</strong>tact secti<strong>on</strong> <strong>of</strong> the policy, but in general:<br />

— <strong>University</strong> housing residents should c<strong>on</strong>tact any Housing/Residential Life staff.<br />

— If a student is accused, report it to the student c<strong>on</strong>duct <strong>of</strong>fice <strong>on</strong> the appropriate campus.<br />

— If an employee is accused, report it to Equal Opportunity <str<strong>on</strong>g>and</str<strong>on</strong>g> Affirmative Acti<strong>on</strong>.<br />

<strong>University</strong> Offices Receiving a Report<br />

n Victim/survivor support services will:<br />

— Maintain the c<strong>on</strong>tacts as strictly c<strong>on</strong>fidential.<br />

— Provide crisis interventi<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> advocacy, in some cases including assisting victims/survivors in seeking<br />

restraining orders.<br />

— Assist <str<strong>on</strong>g>and</str<strong>on</strong>g> support the victim/survivor in c<strong>on</strong>tacting police <str<strong>on</strong>g>and</str<strong>on</strong>g>/or reporting to other <strong>University</strong> <strong>of</strong>fices, if<br />

the victim/survivor c<strong>on</strong>sents.<br />

— Assist the victim/survivor in obtaining medical assistance <str<strong>on</strong>g>and</str<strong>on</strong>g> counseling, changing academic programs<br />

or housing, etc.<br />

n Counseling <str<strong>on</strong>g>and</str<strong>on</strong>g> health care services will:<br />

— Maintain the c<strong>on</strong>tact as c<strong>on</strong>fidential.<br />

— Encourage, assist (as needed), <str<strong>on</strong>g>and</str<strong>on</strong>g> support the victim/survivor in reporting the incident to the police.<br />

— Provide appropriate counseling <str<strong>on</strong>g>and</str<strong>on</strong>g> medical services.<br />

n Housing/Residential Life Offices will:<br />

— C<strong>on</strong>tact, or encourage c<strong>on</strong>tact with, the local victim/survivor service <strong>of</strong>fice, <str<strong>on</strong>g>and</str<strong>on</strong>g> assist in obtaining medical<br />

care if needed.<br />

— Encourage the victim/survivor to report the incident to the police, <str<strong>on</strong>g>and</str<strong>on</strong>g> assist in making the report if<br />

requested by the victim/survivor. Housing/Residential Life may be obligated to report to the police the<br />

fact that an assault was reported, but the name <strong>of</strong> the victim/survivor will <strong>on</strong>ly be provided with the<br />

victim/survivor’s c<strong>on</strong>sent, except in extenuating circumstances.<br />

— If the pers<strong>on</strong> accused is a student, the incident will be reported to the campus <strong>of</strong>fice resp<strong>on</strong>sible for<br />

administering the Student C<strong>on</strong>duct Code.<br />

— Report for appropriate investigati<strong>on</strong> by campus authorities or police (where no police investigati<strong>on</strong> is<br />

warranted, Housing/Residential Life may c<strong>on</strong>duct the investigati<strong>on</strong>).<br />

n Equal Opportunity <str<strong>on</strong>g>and</str<strong>on</strong>g> Affirmative Acti<strong>on</strong> will:<br />

— C<strong>on</strong>tact victim/survivor service <strong>of</strong>fice <str<strong>on</strong>g>and</str<strong>on</strong>g> assist in obtaining medical care if needed.<br />

requested by the victim/survivor. EOAA may be obligated to report to the police the fact that an assault<br />

was reported, but the name <strong>of</strong> the victim will <strong>on</strong>ly be provided with the victim/survivor’s c<strong>on</strong>sent, except<br />

in extenuating circumstances.<br />

— Allow the victim/survivor <str<strong>on</strong>g>and</str<strong>on</strong>g> the pers<strong>on</strong> accused to have a n<strong>on</strong>-participating support pers<strong>on</strong> present for<br />

interviews.<br />

— If the pers<strong>on</strong> accused is a student, the incident will be reported to the campus <strong>of</strong>fice resp<strong>on</strong>sible for<br />

administering the Student C<strong>on</strong>duct Code.<br />

— If the pers<strong>on</strong> accused is an employee, investigate, <str<strong>on</strong>g>and</str<strong>on</strong>g> make recommendati<strong>on</strong>s for acti<strong>on</strong>, as appropriate<br />

(in many cases the police may c<strong>on</strong>duct the investigati<strong>on</strong>).<br />

n <strong>Campus</strong> student c<strong>on</strong>duct <strong>of</strong>fices will:<br />

— Resp<strong>on</strong>d to the allegati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> discipline if needed, c<strong>on</strong>sistent with the Student C<strong>on</strong>duct Code <str<strong>on</strong>g>and</str<strong>on</strong>g>, for<br />

the campus, the Procedures for Disciplinary Proceedings.<br />

— Assist the victim/survivor in c<strong>on</strong>tacting victim/survivor service <strong>of</strong>fice if desired.<br />

— Encourage the victim/survivor to report the incident to the police, <str<strong>on</strong>g>and</str<strong>on</strong>g> assist in making the report if<br />

requested by the victim/survivor. <strong>Campus</strong> c<strong>on</strong>duct <strong>of</strong>fices may be obligated to report to the police the fact<br />

that an assault was reported, but the name <strong>of</strong> the victim/survivor will <strong>on</strong>ly be provided with the victim<br />

survivor’s c<strong>on</strong>sent, except in extenuating circumstances.<br />

— Permit the victim/survivor <str<strong>on</strong>g>and</str<strong>on</strong>g> the pers<strong>on</strong> to have a support pers<strong>on</strong> or advisor present at any interview<br />

or hearing, in a manner c<strong>on</strong>sistent with the governing student c<strong>on</strong>duct procedures.<br />

n <strong>University</strong> investigatory <str<strong>on</strong>g>and</str<strong>on</strong>g> disciplinary procedures will:<br />

— Proceed independently <strong>of</strong> any acti<strong>on</strong> taken in the criminal or civil courts, as determined <strong>on</strong> a case-by-case<br />

basis. <strong>University</strong> procedures are not a substitute for criminal court proceedings.<br />

— Not require a victim/survivor to mediate directly with the pers<strong>on</strong> accused.<br />

— Act promptly <str<strong>on</strong>g>and</str<strong>on</strong>g> appropriately in cases where the <strong>University</strong> judicial process has found the accused<br />

party or parties in violati<strong>on</strong> <strong>of</strong> <strong>University</strong> policy. Possible sancti<strong>on</strong>s include, but are not limited to,<br />

dismissal, suspensi<strong>on</strong>, <str<strong>on</strong>g>and</str<strong>on</strong>g> warning.<br />

— Inform both victim/survivor <str<strong>on</strong>g>and</str<strong>on</strong>g> accused pers<strong>on</strong> <strong>of</strong> the outcome.<br />

The Discipline Process<br />

Alleged violati<strong>on</strong>s <strong>of</strong> the student c<strong>on</strong>duct code are matters <strong>of</strong> c<strong>on</strong>cern to the <strong>University</strong>. Allegati<strong>on</strong>s <strong>of</strong> individual<br />

or group misc<strong>on</strong>duct may be reported by <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services, <strong>University</strong> departments, individual students,<br />

faculty/staff, or campus guests. Allegati<strong>on</strong>s <strong>of</strong> c<strong>on</strong>duct code violati<strong>on</strong>s are forwarded to the Associate Vice<br />

Chancellor for Student Affairs to determine (1) whether the alleged misc<strong>on</strong>duct appears, as judged by available<br />

evidence, to violate the c<strong>on</strong>duct code, <str<strong>on</strong>g>and</str<strong>on</strong>g> (2) which item(s) in the code may have been violated.<br />

The Associate Vice Chancellor has been entrusted with the resp<strong>on</strong>sibility <strong>of</strong> upholding the <strong>University</strong> <strong>of</strong><br />

<strong>Minnesota</strong> Board <strong>of</strong> Regents Student C<strong>on</strong>duct Code (umn.edu/regents/policies/academic/Student_C<strong>on</strong>duct_<br />

Code.html) <str<strong>on</strong>g>and</str<strong>on</strong>g> administering the student discipline procedures.<br />

Student Hearings<br />

In cases <strong>of</strong> sexual assault, if a disciplinary hearing is c<strong>on</strong>ducted, both the reporting party <str<strong>on</strong>g>and</str<strong>on</strong>g> the accused will<br />

be given the opportunity to have a support pers<strong>on</strong> during proceedings. If either party does not have a support<br />

pers<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> wishes to have <strong>on</strong>e, the Associate Vice Chancellor will provide the party with opti<strong>on</strong>s to<br />

accommodate their needs.<br />

Once the hearing is c<strong>on</strong>cluded <str<strong>on</strong>g>and</str<strong>on</strong>g> a determinati<strong>on</strong> made, the reporting party <str<strong>on</strong>g>and</str<strong>on</strong>g> the accused student will be<br />

informed <strong>of</strong> the outcome in writing. The accused student will be given informati<strong>on</strong> regarding access to an<br />

appeal if resp<strong>on</strong>sibility for a violati<strong>on</strong> has been established. The hearings are closed. Therefore the committee’s<br />

acti<strong>on</strong>s will not be made public.<br />

Sancti<strong>on</strong>s that may occur as a result <strong>of</strong> a determinati<strong>on</strong> <strong>of</strong> a violati<strong>on</strong> range from a warning to the revocati<strong>on</strong> <strong>of</strong><br />

Drug <str<strong>on</strong>g>and</str<strong>on</strong>g> Alcohol Policy<br />

Federal laws require the <strong>University</strong> to carry out a program to prevent the unlawful possessi<strong>on</strong>, use, or distributi<strong>on</strong><br />

<strong>of</strong> illegal drugs <str<strong>on</strong>g>and</str<strong>on</strong>g> abuse <strong>of</strong> alcohol by its students <str<strong>on</strong>g>and</str<strong>on</strong>g> employees. The <strong>University</strong> prohibits the unlawful<br />

possessi<strong>on</strong>, use, or distributi<strong>on</strong> <strong>of</strong> alcohol <str<strong>on</strong>g>and</str<strong>on</strong>g> illicit drugs by students <str<strong>on</strong>g>and</str<strong>on</strong>g> employees <strong>on</strong> all <strong>of</strong> its campuses<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> facilities, or as part <strong>of</strong> <strong>University</strong>-sp<strong>on</strong>sored activities. It also prohibits the unlawful manufacture, distributi<strong>on</strong>,<br />

Residential Life Missing Pers<strong>on</strong> Policy<br />

The purpose <strong>of</strong> this policy is to establish procedures for the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong>, Crookst<strong>on</strong> resp<strong>on</strong>se to<br />

reports <strong>of</strong> missing students. This policy applies to students who reside in <strong>University</strong> owned housing facilities.<br />

For purposes <strong>of</strong> this policy, a student may be c<strong>on</strong>sidered a “missing pers<strong>on</strong>” if the pers<strong>on</strong>’s absence is suspiciously<br />

different from his/her usual pattern <strong>of</strong> behavior <str<strong>on</strong>g>and</str<strong>on</strong>g>/or unusual circumstances may have caused the<br />

absence. Such circumstances may include, but is not limited to:<br />

n A report or suspici<strong>on</strong> that the missing pers<strong>on</strong> may be the victim <strong>of</strong> foul play,<br />

n The missing pers<strong>on</strong> has expressed suicidal thoughts,<br />

n The missing pers<strong>on</strong> is drug dependent,<br />

n The missing pers<strong>on</strong> is in a life-threatening situati<strong>on</strong>,<br />

n The missing pers<strong>on</strong> has been with pers<strong>on</strong>s who may endanger the student’s welfare.<br />

n The witnessed abducti<strong>on</strong> <strong>of</strong> an individual<br />

Official notificati<strong>on</strong> procedures for missing pers<strong>on</strong>s<br />

n Any individual <strong>on</strong> campus who has informati<strong>on</strong> that a <strong>University</strong> housing student may be a missing pers<strong>on</strong><br />

must notify the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services Department which is a branch <strong>of</strong> the Department<br />

<strong>of</strong> Public <str<strong>on</strong>g>Safety</str<strong>on</strong>g> as so<strong>on</strong> as possible.<br />

n If a report <strong>of</strong> a possible missing pers<strong>on</strong> is made to a Housing & Residential Life staff member, the staff<br />

member will:<br />

— C<strong>on</strong>duct a life safety/wellness check <strong>on</strong> the resident,<br />

— Attempt to make c<strong>on</strong>tact via cellular ph<strong>on</strong>e, email, or other means,<br />

— C<strong>on</strong>tact other students who may be aware <strong>of</strong> the missing pers<strong>on</strong>’s whereabouts (e.g., roommate, friends,<br />

classmates).<br />

If the missing pers<strong>on</strong> cannot be found within 24 hours, RL staff will c<strong>on</strong>tact the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong><br />

<str<strong>on</strong>g>Security</str<strong>on</strong>g> Services Department to report a possible missing pers<strong>on</strong>.<br />

n The <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services Department will gather all essential informati<strong>on</strong> about the<br />

<strong>University</strong> housing student from the reporting pers<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> from the student’s acquaintances (descripti<strong>on</strong>,<br />

clothes last worn, where student might be, who student might be with, vehicle descripti<strong>on</strong>, informati<strong>on</strong><br />

about the physical <str<strong>on</strong>g>and</str<strong>on</strong>g> mental well being <strong>of</strong> the student, an up-to-date photograph, class schedule, card<br />

access logs, dining records, video surveillance, etc.). Appropriate campus staff, such as RL staff, may be<br />

notified to aid in the search for the student.<br />

n No later than 24 hours after determining that a <strong>University</strong> housing student is missing, the Director <strong>of</strong><br />

Residential Life or designee will notify the emergency c<strong>on</strong>tact (for students 18 <str<strong>on</strong>g>and</str<strong>on</strong>g> over) or the parent<br />

guardian (for students under the age <strong>of</strong> 18) that the student is believed to be missing.<br />

<strong>Campus</strong> communicati<strong>on</strong>s about missing students<br />

In cases involving missing pers<strong>on</strong>s, law enforcement pers<strong>on</strong>nel are best situated to provide informati<strong>on</strong> to the<br />

media that is designed to elicit public assistance in the search for a missing pers<strong>on</strong>. Therefore, all communicati<strong>on</strong>s<br />

regarding missing students will be h<str<strong>on</strong>g>and</str<strong>on</strong>g>led by the appropriate law enforcement authorities, who may<br />

c<strong>on</strong>sult with <strong>University</strong> Relati<strong>on</strong>s. All inquiries to the <strong>University</strong> regarding missing students, or informati<strong>on</strong><br />

provided to any individual at the <strong>University</strong> about a missing student, shall be referred to <strong>University</strong> Relati<strong>on</strong>s.<br />

Prior to providing the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> community with any informati<strong>on</strong> about a missing student,<br />

<strong>University</strong> Relati<strong>on</strong>s shall c<strong>on</strong>sult with the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> Police Department to ensure that communicati<strong>on</strong>s<br />

does not hinder the investigati<strong>on</strong>.<br />

Definiti<strong>on</strong>s<br />

Criminal Offenses<br />

The majority <strong>of</strong> the definiti<strong>on</strong>s are from the FBI’s Uniform Crime Reporting H<str<strong>on</strong>g>and</str<strong>on</strong>g>book. Sex <strong>of</strong>fense definiti<strong>on</strong>s<br />

Aggravated Assault: The unlawful attack by <strong>on</strong>e pers<strong>on</strong> up<strong>on</strong> another for the purpose <strong>of</strong> inflicting severe or<br />

aggravated bodily injury. This type <strong>of</strong> assault usually is accompanied by the use <strong>of</strong> a weap<strong>on</strong> or by means<br />

likely to produce death or great bodily harm. (It is not necessary that injury result from aggravated assault<br />

when a gun, knife, or other weap<strong>on</strong> is used that could <str<strong>on</strong>g>and</str<strong>on</strong>g> probably would result in serious pers<strong>on</strong>al injury if<br />

the crime were successfully completed.)<br />

Ars<strong>on</strong>: Any willful or malicious burning or attempt to burn, with or without intent to defraud, a dwelling,<br />

house, public building, motor vehicle or aircraft, pers<strong>on</strong>al property <strong>of</strong> another, etc.<br />

Burglary: The unlawful entry <strong>of</strong> a structure to commit a fel<strong>on</strong>y or a theft. For reporting purposes, this definiti<strong>on</strong><br />

includes unlawful entry with intent to commit a larceny or fel<strong>on</strong>y; breaking <str<strong>on</strong>g>and</str<strong>on</strong>g> entering with intent to<br />

commit a larceny; housebreaking; safecracking; <str<strong>on</strong>g>and</str<strong>on</strong>g> all attempts to commit any <strong>of</strong> the aforementi<strong>on</strong>ed.<br />

Note: In July 2010, the Department <strong>of</strong> Educati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> FBI released new guidance for the classificati<strong>on</strong>s <strong>of</strong><br />

Burglary. This guidance is to be used in the classificati<strong>on</strong> <strong>of</strong> Burglary, starting with statistics from the 2009<br />

calendar year.<br />

An incident must meet three c<strong>on</strong>diti<strong>on</strong>s to be classified as Burglary:<br />

— There must be evidence <strong>of</strong> unlawful entry (trespass). Both forcible entry <str<strong>on</strong>g>and</str<strong>on</strong>g> unlawful entry–no force are<br />

counted.<br />

— The unlawful entry must occur within a structure, which is defined as having four walls, a ro<strong>of</strong>, <str<strong>on</strong>g>and</str<strong>on</strong>g> a<br />

door.<br />

— The unlawful entry into a structure must show evidence that the entry was made in order to commit<br />

a fel<strong>on</strong>y or theft. If the intent was not to commit a fel<strong>on</strong>y or theft, or if the intent cannot be determined,<br />

the proper classificati<strong>on</strong> is Larceny.<br />

Motor Vehicle Theft: The theft or attempted theft <strong>of</strong> a motor vehicle. (Classify as motor vehicle theft all cases<br />

where automobiles are taken by pers<strong>on</strong>s not having lawful access even though the vehicles are later ab<str<strong>on</strong>g>and</str<strong>on</strong>g><strong>on</strong>ed—including<br />

joyriding.)<br />

Murder <str<strong>on</strong>g>and</str<strong>on</strong>g> N<strong>on</strong>-negligent Manslaughter: The willful (n<strong>on</strong>-negligent) killing <strong>of</strong> <strong>on</strong>e human being by another.<br />

Negligent Manslaughter: The killing <strong>of</strong> another pers<strong>on</strong> through gross negligence.<br />

Robbery: The taking or attempting to take anything <strong>of</strong> value from the care, custody, or c<strong>on</strong>trol <strong>of</strong> a pers<strong>on</strong> or<br />

pers<strong>on</strong>s by force or threat <strong>of</strong> force or violence <str<strong>on</strong>g>and</str<strong>on</strong>g>/or putting the victim in fear.<br />

Sex Offenses<br />

Forcible Sex Offenses: Any sexual act directed against another pers<strong>on</strong>, forcible <str<strong>on</strong>g>and</str<strong>on</strong>g>/or against the pers<strong>on</strong>’s<br />

will; or not forcible or against the pers<strong>on</strong>’s will where the victim is incapable <strong>of</strong> giving c<strong>on</strong>sent.<br />

Forcible Rape: The carnal knowledge <strong>of</strong> a pers<strong>on</strong>, forcibly <str<strong>on</strong>g>and</str<strong>on</strong>g>/or against that pers<strong>on</strong>’s will; or not forcibly or<br />

against the pers<strong>on</strong>’s will where the victim is incapable <strong>of</strong> giving c<strong>on</strong>sent because <strong>of</strong> his/her temporary or permanent<br />

mental or physical incapacity (or because <strong>of</strong> his/her youth).<br />

Forcible Sodomy: Oral or anal sexual intercourse with another pers<strong>on</strong>, forcibly <str<strong>on</strong>g>and</str<strong>on</strong>g>/or against that pers<strong>on</strong>’s<br />

will; or not forcibly or against the pers<strong>on</strong>’s will where the victim is incapable <strong>of</strong> giving c<strong>on</strong>sent because <strong>of</strong> his/<br />

her youth or because <strong>of</strong> temporary or permanent mental or physical incapacity.<br />

Sexual Assault With an Object: The use <strong>of</strong> an object or instrument to unlawfully penetrate, however slightly,<br />

the genital or anal opening <strong>of</strong> the body <strong>of</strong> another pers<strong>on</strong>, forcibly <str<strong>on</strong>g>and</str<strong>on</strong>g>/or against that pers<strong>on</strong>’s will; or not<br />

forcibly or against the pers<strong>on</strong>’s will where the victim is incapable <strong>of</strong> giving c<strong>on</strong>sent because <strong>of</strong> his/her youth or<br />

because <strong>of</strong> temporary or permanent mental or physical incapacity.<br />

Forcible F<strong>on</strong>dling: The touching <strong>of</strong> the private body parts <strong>of</strong> another pers<strong>on</strong> for the purpose <strong>of</strong> sexual gratificati<strong>on</strong>,<br />

forcibly <str<strong>on</strong>g>and</str<strong>on</strong>g>/or against that pers<strong>on</strong>’s will; or not forcibly or against the pers<strong>on</strong>’s will where the victim is<br />

incapable <strong>of</strong> giving c<strong>on</strong>sent because <strong>of</strong> his/her youth or because <strong>of</strong> temporary or permanent mental or physical<br />

incapacity.<br />

N<strong>on</strong>-Forcible Sex Offenses: Unlawful, n<strong>on</strong>-forcible sexual intercourse.<br />

Incest: N<strong>on</strong>-forcible sexual intercourse between pers<strong>on</strong>s who are related to each other within the degrees<br />

wherein marriage is prohibited by law.<br />

Statutory Rape: N<strong>on</strong>-forcible sexual intercourse with a pers<strong>on</strong> who is under the statutory age <strong>of</strong> c<strong>on</strong>sent.<br />

Hate Crime: Any crime reported in the annual statistics, other crime involving bodily injury, <str<strong>on</strong>g>and</str<strong>on</strong>g> any <strong>of</strong> the<br />

following crimes that manifest evidence that the victim was intenti<strong>on</strong>ally selected because <strong>of</strong> the victim’s actual<br />

or perceived race, gender, religi<strong>on</strong>, sexual orientati<strong>on</strong>, or disability.<br />

Additi<strong>on</strong>al Hate Crime categories (Note: these crimes are <strong>on</strong>ly reported in the annual statistics if the crime is<br />

c<strong>on</strong>sidered a hate crime.)<br />

Larceny-Theft: The unlawful taking, carrying, leading, or riding away <strong>of</strong> property from the possessi<strong>on</strong> or c<strong>on</strong>structive<br />

possessi<strong>on</strong> <strong>of</strong> another. (Note: c<strong>on</strong>structive possessi<strong>on</strong> is defined by Black’s Law Dicti<strong>on</strong>ary, sixth ed.<br />

as “where <strong>on</strong>e does not have physical custody or possessi<strong>on</strong>, but is in a positi<strong>on</strong> to exercise domini<strong>on</strong> or c<strong>on</strong>trol<br />

over a thing.”)<br />

Simple Assault: An unlawful physical attack by <strong>on</strong>e pers<strong>on</strong> up<strong>on</strong> another where neither the <strong>of</strong>fender displays<br />

a weap<strong>on</strong>, nor the victim suffers obvious severe or aggravated bodily injury involving apparent broken b<strong>on</strong>es,<br />

loss <strong>of</strong> teeth, possible internal injury, severe lacerati<strong>on</strong>, or loss <strong>of</strong> c<strong>on</strong>sciousness.<br />

Intimidati<strong>on</strong>: To unlawfully place another pers<strong>on</strong> in reas<strong>on</strong>able fear <strong>of</strong> bodily harm through the use <strong>of</strong> threatening<br />

words <str<strong>on</strong>g>and</str<strong>on</strong>g>/or other c<strong>on</strong>duct, but without displaying a weap<strong>on</strong> or subjecting the victim to actual physical<br />

attack.<br />

Destructi<strong>on</strong>/Damage/V<str<strong>on</strong>g>and</str<strong>on</strong>g>alism <strong>of</strong> Property (Except “Ars<strong>on</strong>”): To willfully or maliciously destroy, damage,<br />

deface, or otherwise injure real or pers<strong>on</strong>al property without the c<strong>on</strong>sent <strong>of</strong> the owner or the pers<strong>on</strong> having<br />

custody or c<strong>on</strong>trol <strong>of</strong> it.<br />

Illegal Weap<strong>on</strong>s Possessi<strong>on</strong><br />

The violati<strong>on</strong> <strong>of</strong> laws or ordinances dealing with weap<strong>on</strong> <strong>of</strong>fenses, regulatory in nature, such as manufacture,<br />

sale, or possessi<strong>on</strong> <strong>of</strong> deadly weap<strong>on</strong>s; carrying deadly weap<strong>on</strong>s, c<strong>on</strong>cealed or openly; furnishing deadly<br />

weap<strong>on</strong>s to minors; aliens possessing deadly weap<strong>on</strong>s; <str<strong>on</strong>g>and</str<strong>on</strong>g> all attempts to commit any <strong>of</strong> the aforementi<strong>on</strong>ed.<br />

Drug Law Violati<strong>on</strong>s<br />

Violati<strong>on</strong>s <strong>of</strong> state <str<strong>on</strong>g>and</str<strong>on</strong>g> local laws relating to the unlawful possessi<strong>on</strong>, sale, use, growing, <str<strong>on</strong>g>and</str<strong>on</strong>g> making <strong>of</strong><br />

narcotic drugs. The relevant substances include opium or cocaine <str<strong>on</strong>g>and</str<strong>on</strong>g> their derivatives (morphine, heroine,<br />

codeine); marijuana; synthetic narcotics (Demerol, methad<strong>on</strong>e); <str<strong>on</strong>g>and</str<strong>on</strong>g> dangerous n<strong>on</strong>-narcotic drugs (barbiturates,<br />

Benzedrine).<br />

Liquor Law Violati<strong>on</strong>s<br />

The violati<strong>on</strong> <strong>of</strong> laws or ordinances prohibiting the manufacture, sale, transporting, furnishing, <str<strong>on</strong>g>and</str<strong>on</strong>g>/<br />

or possessing <strong>of</strong> intoxicating liquor; maintaining unlawful drinking places; bootlegging; operating a still;<br />

furnishing liquor to a minor or intemperate pers<strong>on</strong>; using a vehicle for illegal transportati<strong>on</strong> <strong>of</strong> liquor; drinking<br />

<strong>on</strong> a train or public c<strong>on</strong>veyance; <str<strong>on</strong>g>and</str<strong>on</strong>g> all attempts to commit any <strong>of</strong> the aforementi<strong>on</strong>ed. (Drunkenness <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

driving under the influence are not included in this definiti<strong>on</strong>.)<br />

Locati<strong>on</strong>s<br />

educati<strong>on</strong>al purposes, is frequently used by students, <str<strong>on</strong>g>and</str<strong>on</strong>g> is not within the same reas<strong>on</strong>ably c<strong>on</strong>tiguous<br />

Public Property: All public property, including thoroughfares, streets, sidewalks, <str<strong>on</strong>g>and</str<strong>on</strong>g> parking facilities, that is<br />

within the campus, or immediately adjacent to <str<strong>on</strong>g>and</str<strong>on</strong>g> accessible from campus.<br />

This brochure is published annually by the <strong>University</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> made available to all current <str<strong>on</strong>g>and</str<strong>on</strong>g> prospective<br />

students, staff, <str<strong>on</strong>g>and</str<strong>on</strong>g> faculty. Statistics are compiled by the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> Police Department in c<strong>on</strong>sultati<strong>on</strong><br />

with the St. Paul <str<strong>on</strong>g>and</str<strong>on</strong>g> Minneapolis police departments <str<strong>on</strong>g>and</str<strong>on</strong>g> a wide range <strong>of</strong> <strong>University</strong> pers<strong>on</strong>nel called<br />

<strong>Campus</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Authorities.<br />

<strong>Campus</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Authorities (CSA)<br />

<strong>Campus</strong> security authorities, as defined by the Clery Act, have an obligati<strong>on</strong> to report allegati<strong>on</strong>s <strong>of</strong> Clery<br />

Act-defined crimes if they c<strong>on</strong>clude the allegati<strong>on</strong>s are made in good faith. These crime allegati<strong>on</strong>s should<br />

be reported to the <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services Department or to the local police. The Clery Act<br />

definiti<strong>on</strong> <strong>of</strong> a campus security authority includes faculty <str<strong>on</strong>g>and</str<strong>on</strong>g> staff bey<strong>on</strong>d just police <strong>of</strong>ficers. A faculty or<br />

staff member who has significant resp<strong>on</strong>sibility for student <str<strong>on</strong>g>and</str<strong>on</strong>g> campus activities, including but not limited<br />

to student housing, student discipline, <str<strong>on</strong>g>and</str<strong>on</strong>g> campus judicial proceedings, is a campus security authority. The<br />

intent <strong>of</strong> including n<strong>on</strong>-law enforcement pers<strong>on</strong>nel as campus security authorities is to acknowledge that<br />

Counselors’ C<strong>on</strong>fidential Reporting<br />

<strong>Campus</strong> pastoral counselors <str<strong>on</strong>g>and</str<strong>on</strong>g> campus pr<strong>of</strong>essi<strong>on</strong>al counselors, when acting as such, are not c<strong>on</strong>sidered to<br />

be campus security authorities <str<strong>on</strong>g>and</str<strong>on</strong>g> are not required to report crimes for inclusi<strong>on</strong> into the annual disclosure <strong>of</strong><br />

crime statistics.<br />

The Clery Act defines Counselors as:<br />

Pastoral Counselor: An employee <strong>of</strong> an instituti<strong>on</strong>, who is associated with a religious order or denominati<strong>on</strong><br />

Annual Fire <str<strong>on</strong>g>Safety</str<strong>on</strong>g> Report<br />

The <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong>, Crookst<strong>on</strong> campus, has 4 facilities for student housing. Two are traditi<strong>on</strong>al style<br />

residence halls, two are apartment style living. The chart below summarizes each facility’s fire safety system<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> the number <strong>of</strong> fire drills held during the 2011 calendar year.<br />

Regulati<strong>on</strong>s regarding portable electrical appliances, smoking <str<strong>on</strong>g>and</str<strong>on</strong>g> open flames for all residence halls:<br />

Electrical/Appliances<br />

n Residents in traditi<strong>on</strong>al style residence halls are not allowed to have or use hazardous electrical appliances<br />

or cooking appliances, including: any appliances with open heating elements, including but not limited to<br />

oil popcorn makers, countertop grills, pizza bakers/carousels, quesadilla makers, countertop s<str<strong>on</strong>g>and</str<strong>on</strong>g>wich<br />

makers, toasters, hot plates, toaster ovens, etc.<br />

n Only refrigerators that are 4.3 cubic feet or smaller, <str<strong>on</strong>g>and</str<strong>on</strong>g> microwave ovens using no more than 700 watts, are<br />

allowed except for use in <strong>University</strong>-designated kitchen areas (e.g., apartment kitchens, residence hall<br />

kitchenettes). No other major appliances, including air c<strong>on</strong>diti<strong>on</strong>ers or dishwasher units, are permitted.<br />

Cooking<br />

n Cooking is permitted <strong>on</strong>ly in <strong>University</strong>-designated kitchen areas. Cooking is not permitted in traditi<strong>on</strong>al<br />

style residence hall rooms.<br />

Smoking<br />

n Smoking any substance or creating smoke is not permitted in the residence halls/apartment complexes. This<br />

includes all public areas <str<strong>on</strong>g>and</str<strong>on</strong>g> all resident rooms <str<strong>on</strong>g>and</str<strong>on</strong>g> apartments. Chewing tobacco is not permitted inside the<br />

public areas within the residence hall/apartment complexes.<br />

Fire Hazard<br />

n It is prohibited to have open flames or other materials that c<strong>on</strong>stitute fire hazards <strong>on</strong> <strong>University</strong> housing<br />

property, including c<str<strong>on</strong>g>and</str<strong>on</strong>g>les, c<str<strong>on</strong>g>and</str<strong>on</strong>g>le warmers, incense, or other materials.<br />

n Hookahs or any smoking paraphernalia that has the potential for an open flame are not allowed.<br />

n Due to the hazardous materials in the following listed lighting devices, <str<strong>on</strong>g>and</str<strong>on</strong>g> the potential for fire <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

chemical safety hazards, halogen lamps, torchiere lamps, ne<strong>on</strong> lighting, black lights, strobe lights, lava<br />

lamps, <str<strong>on</strong>g>and</str<strong>on</strong>g> decorative lighting (including any string or tube lighting with multiple outlets <str<strong>on</strong>g>and</str<strong>on</strong>g> plug<br />

adapters) are prohibited.<br />

n Due to potential for fire, c<strong>on</strong>cealed extensi<strong>on</strong> cords, multiple outlet, <str<strong>on</strong>g>and</str<strong>on</strong>g> octopus adapters are prohibited.<br />

Residents may possess multiple strip outlets that are fused with at least 14 gauge wire <str<strong>on</strong>g>and</str<strong>on</strong>g> grounded cords<br />

to power electr<strong>on</strong>ic devices in their rooms <str<strong>on</strong>g>and</str<strong>on</strong>g> apartments.<br />

n In compliance with <strong>Minnesota</strong> State Fire Code, failure to exit the hall/apartment during a fire alarm is a law<br />

violati<strong>on</strong>.<br />

Student Housing Evacuati<strong>on</strong><br />

Procedures are covered yearly with residents. Each hall performs three fire evacuati<strong>on</strong> drills each academic<br />

year.<br />

Evacuati<strong>on</strong> Procedure<br />

Residents are to immediately leave the building by the nearest, safest exit. Housing staff is resp<strong>on</strong>sible for<br />

moving all exiting residents to a safe locati<strong>on</strong>, normally a nearby residence hall. Each hall c<strong>on</strong>ducts three fire<br />

drills per academic year.<br />

Fire Reporting<br />

For the purposes <strong>of</strong> including a fire in the annual fire safety report, fires should be reported to <strong>on</strong>e <strong>of</strong> the<br />

following departments/people: <str<strong>on</strong>g>Security</str<strong>on</strong>g> Services, residence director, central housing, director <strong>of</strong> housing,<br />

or housing facilities.<br />

Fire Log<br />

The Department <strong>of</strong> Envir<strong>on</strong>mental Health & <str<strong>on</strong>g>Safety</str<strong>on</strong>g>, 218-281-8300, maintains a fire log <strong>of</strong> fires that occur in<br />

<strong>on</strong>-campus student housing facilities.<br />

Steps to Be Taken in Case <strong>of</strong> Fire<br />

If you discover a fire:<br />

n Manually activate the fire alarm.<br />

n Immediately exit the building <str<strong>on</strong>g>and</str<strong>on</strong>g> close the door(s) behind you.<br />

n Tell others in the area there is a fire.<br />

n Call 911 when you have reached safety.<br />

If you are trapped during a fire:<br />

n Wet <str<strong>on</strong>g>and</str<strong>on</strong>g> place cloth material around <str<strong>on</strong>g>and</str<strong>on</strong>g> under the door to prevent smoke from entering.<br />

n Close as many doors as possible between you <str<strong>on</strong>g>and</str<strong>on</strong>g> the fire.<br />

n Be prepared to signal some<strong>on</strong>e outside, but do not break glass until absolutely necessary, as smoke may be<br />

drawn into the room.<br />

If caught in smoke:<br />

n Drop to the floor <str<strong>on</strong>g>and</str<strong>on</strong>g> crawl toward an exit.<br />

n Stay as low as possible.<br />

n Take shallow breaths through your nose <str<strong>on</strong>g>and</str<strong>on</strong>g> use a shirt or towel as a filter.<br />

The <strong>University</strong> <strong>of</strong> <strong>Minnesota</strong> does not have a system wide policy regarding the fire safety educati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> training<br />

for all students, faculty, <str<strong>on</strong>g>and</str<strong>on</strong>g> staff. Accredited clinical areas are required to have quarterly drills <str<strong>on</strong>g>and</str<strong>on</strong>g> policies<br />

in place. Housing <str<strong>on</strong>g>and</str<strong>on</strong>g> Residential Life adheres to state <str<strong>on</strong>g>and</str<strong>on</strong>g> federal laws regarding policy, training, <str<strong>on</strong>g>and</str<strong>on</strong>g> drills.<br />

The Department <strong>of</strong> Envir<strong>on</strong>mental <str<strong>on</strong>g>Safety</str<strong>on</strong>g> <strong>of</strong>fers fire safety training to students, staff, <str<strong>on</strong>g>and</str<strong>on</strong>g> faculty up<strong>on</strong> request.<br />
