commission designs a final acceptance report. The Contracting Entity shall endeavor to complete
the inspection within 60 calendar days following the delivery of the subject material to FOB/FCA
Delivery Place. For this reason, the commencement date of the warranty shall be written in Turkey
after the inspection acceptance date. The contractor is liable to design the guarantee documents
on behalf of the Contracting Entity and present their original copies to him
53.1.2. Garanti kapsamındaki malzemede garanti süresi içerisinde kullanıcı hatası olmaksızın
meydana gelebilecek her türlü arıza ve eksiklikler yükleniciye tebliğ tarihinden itibaren ilgili
malzeme için sözleşmede belirtilen teslim süresinin en fazla yarısı içerisinde giderilmiş ya da yenisi
ile değiştirilmiş olarak bütün masraflar (nakliye, sigorta, gümrük masrafları vb) yüklenici tarafından
karşılanmak üzere birliğine teslim edilecektir. Bu işlemlerin garantiyi sağlayan kişi veya kuruluş
tarafından giderilmesini YÜKLENİCİ üstlenecektir. İş bu yükümlülüğün YÜKLENİCİ tarafından
yerine getirilmemesi halinde İDARE, garantinin sağlanması için sarfına maruz kalacağı tüm
giderleri YÜKLENİCİ’nin alacaklarından kesmek veya teminatını paraya çevirmek suretiyle tahsil
etmek hakkına sahiptir. Garanti süresi içerisinde geçen arızalı süre garanti süresine ilave
edilecektir.
All defects and shortages of the material under warranty occurred within the warranty period
without the failure of the user shall be delivered to its unit, provided that all costs (delivery,
insurance, customs costs, etc.) are reimbused by the contractor, after being corrected or replaced
by a new one at the latest within half of the delivery time stated in the contract as of the notification
date for the Contractor. The Contractor shall undertake the responsibility that these failures are
corrected by the person or organization providing the warranty. In the event that this commitment is
not performed by the CONTRACTOR, the CONTRACTING ENTITY shall be entitled to deduct all
expenses to be spared for providing warranty from the receivables of the Contractor or collect
through converting his performance bond to cash. The period passed for the correction of failures
shall be included in the warranty period.
54. ANLAŞMAZLIKLARIN ÇÖZÜMÜ / SETTLEMENT OF DISPUTES:
Sözleşmenin yorum ve icrasından doğacak anlaşmazlıklar, karşılıklı müzakereler ile halledilmeye
çalışılacak ve sözleşmede yer alan konuya ilişkin hükümler uygulanacaktır. Bu suretle
giderilemeyen bütün uyuşmazlıkların hallinde T.C. Ankara Mahkemeleri ve İcra Daireleri yetkili
olacak, Türkiye Cumhuriyeti Kanun ve Mevzuatını uygulayacaktır.
Any disputes arising between parties in the interpretation and execution of the Contract shall be
settled through mutual negotiations and provisions of the contract shall be applied. Turkish
Republic Commerce Courts and Sequestration Offices in Ankara shall have jurisdiction authority in
the settlement of any unresolved disputes, for which Laws and Regulations of Turkish Republic
shall be applicable.
VI. DİĞER HUSUSLAR/OTHER TERMS AND CONDITIONS
55. AMBALAJLAMA /PACKAGING:
55.1. Malzemenin teknik dokümanında/ihale dokümanında ya da uluslar arası standartlara uygun
belirtilen şekilde ambalajlanmaması nedeniyle meydana gelebilecek ve sigorta tarafından
karşılanmayan hasar, zarar ve eksiklikler YÜKLENİCİ’ye ait olacaktır. YÜKLENİCİ konu hakkında
herhangi bir hak iddiasında bulunmayacaktır.
Any harms, losses and shortages to arise due to packing of the items in a way contrary to the one
defined in the Technical Document/ Tender Document or contrary to the international standarts
and not paid by the insurance shall be paid by the Contractor. The Contractor shall not claim any
right thereabout.
55.2. Malzeme orijinal ambalajları içerisinde teslim edilecektir. Şekil ve ebat bakımından
ambalajlanamayan malzemenin tahliye limanına kadar sağlam bir şekilde sevkıyatı temin edilecek
ve her türlü hava şartlarına, indirme ve bindirmeye, ara depolamaya, hasara, korozyona ve
deformasyona vs. karşı gerekli şekilde koruma tedbirleri alınmış olarak sevk edilecektir. Sağlam bir
sevkıyat için alınacak bütün tedbirler sevk edilen malzemenin imalatçısı veya yetkili satıcısı
tarafından FOB/FCA/TESLİM YERİNE teslim limanına göre hava/deniz aşırı sevkıyatlarda
kullanılan sevk tedbirlerinin aynısı olacaktır.
The goods shall be delivered in their original packages. Any good which could not be packed due
to its shape and dimension shall be shipped to the discharge port in a secure way and measures
