49.3.8.2. Yüklenici tarafından ihraç lisansının alınmasını takiben, ihraç lisansının ihraç lisansını

49.3.8.3. Sözleşmenin tasfiyesi hâlinde, mücbir sebep şartlarına maruz kalan yüklenicinin, bu
durumu mücbir sebep hallerinde istenen belgelerle tevsik etmesi zorunludur. Bu durumda varsa
ödenen avans ödendiği tarihten geri ödendiği tarihe kadar geçen günlere ait kanunî faizi ile birlikte
30 (otuz) takvim günü içinde yüklenici tarafından idarenin belirttiği hesaba geri ödenir.
In the event that the Contract is terminated, the Contractor exposed to the force majeure shall

The letter of credit opened shall be cancelled. The Contracting Entity shall release the Advance
Letter of Guarantee (if the advance payment was made) and Performance Bond and if any,
additional performance bond. In case the advance payment is not returned, advance letter of
guarantee shall be registered as revenue. Following this procedure, performance bond and if any
additional performance bond shall be returned.
49.4. Mücbir sebeplerden dolayı sözleşmenin feshedilmesi halinde, hesabı genel hükümlere göre
tasfiye edilerek, yukarıdaki esaslar doğrultusunda kesin teminat ve varsa ek kesin teminatlar iade
edilir.
In case the contract is abrogated due to forces majeure, the account of the Contractor shall be
liquidated in accordance with the terms and conditions of the contract and the performance bond
as well as if any, an additional performance bond shall be returned to the above mentioned terms
and conditions.
50. SÖZLEŞME KAPSAMINDA YAPILACAK İŞİN ARTIŞI VE EKSİLİŞİ VE İŞİN TASFİYESİ;
THE INCREASE OR DECREASE IN THE AMOUNT OF THE WORK FOR THE CONTRACT AND
FINALIZATION:
50.1. İmzalanacak mal/hizmet sözleşme bedelinin % 20 (yüzdeyirmi)’si oranına kadar az veya
fazla alım yapılabilir. Fazla alım yapılması durumunda;
The Contracting Entity may increase or decrease the quantity of purchase for goods/services
amounting to 20% (twenty percent) of the contract price. In case of any increase in the quantity of
purchase;
50.1.1. İmzalanacak sözleşme konusu alım içinde kalınması,

50.1.2. İdare’yi külfete sokmaksızın teknik veya ekonomik olarak asıl işten ayrılmasının mümkün
olmaması şartlarıyla, süre hariç, sözleşme ve ihale dokümanındaki hükümler çerçevesinde Ek
Sözleşme yapılmadan İdare adına İhale Yetkilisinden alınacak onay ile fazla alım yapılabilir.
Any extra purchase could be made by the approval of the tender official within the terms and
conditions of the contract and the tender document excluding those applicable for time and
needless of an additional contract But, this should not pose a economic problem for the
Contracting Entity and the separation of the work and such purchase in technical and economic
ways should be inconvenient.
50.2. Fazla alım yapılması halinde fazla alım bedelinin % 6 (yüzdealtı)’sı oranında Ek Kesin
Teminat alınır. Ayrıca, ihalenin yerli istekli lehine sonuçlanması halinde, fazla alım alıma ait damga
vergisi fazla alım bedelinin yürürlükteki oranı kadar yüklenici tarafından ilgili saymanlık/vergi
