49.3.6.2. Yabancı yüklenici için; Sözleşme şartlarının yüklenici tarafından yerine<br />
getirilemeyeceğinin anlaşılması veya bu maddenin 49.3.5. nolu alt bendindeki durumda<br />
sözleşmenin tasfiyesine karar verilmiş ise teslim alınamayan malzeme ile ilgili akreditif iptal edilir.<br />
Ayrıca teslim alınarak kabulü yapılmış malzemeye ilişkin sözleşme şartlarının yerine getirilmesini<br />
müteakip teslim alınamayan malzemeye ait kesin teminat ve varsa ek kesin teminat, yükleniciye en<br />
kısa sürede iade edilir. Yerli yüklenici için; teslim alınarak kabulü yapılmış malzemeye ilişkin<br />
sözleşme şartlarının yerine getirilmesini müteakip teslim alınamayan malzemeye ait kesin teminat<br />
ve varsa ek kesin teminat, yükleniciye en kısa sürede iade edilir.<br />
For foreign tenderers in case the terms and conditions of the contract shall not be executed and<br />
the contract is to be terminated in accordance with sub paragraph 49.3.5, the letter of credit<br />
concerning the undelivered goods shall be cancelled. Furthermore the Contracting Entity could<br />
return the performance bond and if any, the supplementary performance bond of the undelivered<br />
goods upon the execution of the terms and conditions stipulated in the contract on the delivered<br />
and accepted goods. For domestic tenderers, the Contracting Entity could return the performance<br />
bond and if any, the supplementary performance bond of the undelivered goods upon the<br />
execution of the terms and conditions stipulated in the contract on the delivered and accepted<br />
goods.<br />
49.3.7. Mücbir sebep/sebeplerin oluşması ve bu zamana kadar teslim edilmemiş veya kabul<br />
edilmemiş malzemeden dolayı malzemenin bütünlüğünün ve performansının etkileniyor olması<br />
durumunda;<br />
The Contractor shall be granted additional time in case any force majeure condition happens or the<br />
integrity and performance of the goods are being influenced due to the undelivered goods till this<br />
time.<br />
49.3.7.1. İdare tarafından, yüklenicinin sözleşme şartlarını yerine getirebileceğinin anlaşılması<br />
durumunda Yükleniciye ilâve süre verilir.<br />
The Contractor shall be granted additional time in case it is observed that the Contractor could<br />
implement the terms and conditions of the contract.<br />
49.3.7.2. Sözleşme şartlarının yüklenici tarafından yerine getirilemeyeceğinin anlaşılması veya<br />
bu maddenin 49.3.5. nolu alt bendindeki durumda sözleşmenin tasfiyesine karar verilmiş ise;<br />
In case it is observed that the terms and conditions of the contract could not be implemented by<br />
the Contractor and the Contract is to be abrogated in accordance with the conditions specified in<br />
Article 49.3.5,<br />
49.3.7.2.1. Yabancı yüklenici için; Türkiye’de teslim birliğinde olan malzeme de dahil teslim alınan<br />
malzeme kullanılmamışsa yükleniciye teslim edilir ve malzeme her türlü masrafı yükleniciye ait<br />
olmak üzere yüklenici tarafından yurt dışına çıkarılır. (Yurt dışına çıkarılacak malzemenin Son<br />
Kullanıcı Belgesi, yüklenici tarafından idareye geri verilecektir. Yüklenicinin bu belgeyi geri<br />
vermemesi durumunda, malzemenin sevkine izin verilmeyecektir.) Yerli yüklenici için; Teslim<br />
birliğinde olan malzeme de dâhil teslim alınan malzeme kullanılmamışsa Yükleniciye teslim edilir<br />
ve malzeme her türlü masrafı Yükleniciye ait olmak üzere Yüklenici tarafından teslim birliği dışına<br />
çıkarılır.<br />
For foreign tenderers if the goods delivered as well as those in the military unit in Turkey have not<br />
been used, they shall be redelivered to the Contractor and they are taken abroad by the Contractor<br />
provided that all expenses shall be borne by the Contractor. (End User Certificate of the goods to<br />
be taken abroad shall be returned to the Contracting Entity. In case the Tenderer has not<br />
submitted this, the goods shall not be authorized for shipping). For domestic tenderers the goods<br />
delivered as well as those in the military unit in Turkey have not been used, they shall be<br />
redelivered to the Contractor and they are taken out of the delivery base by the Contractor<br />
provided that all expenses shall be borne by the Contractor.<br />
49.3.7.2.2. Yabancı yüklenici için; Bu durumda varsa yükleniciye ödenen akreditif ve versa avans<br />
ödendiği tarihten geri ödendiği tarihe kadar geçen günlere ait kanunî faizi ile birlikte geri alınarak<br />
hazineye irad kaydedilir. Açılan akreditifin bakiye kısmının tamamı iptal edilir. İdare de avansın geri<br />
iadesi kaydıyla avans teminat mektubunu, ödenen akreditif bedeli geri alınmak kaydıyla da kesin<br />
teminatı ve varsa ek kesin teminatı iade edilir ve yükleniciye ihalelere katılmaktan yasaklama<br />
cezası verilmez. Yerli yüklenici için; Bu durumda Yükleniciye varsa ödenen avans ödendiği tarihten<br />
geri ödendiği tarihe kadar geçen günlere ait kanunî faizi ile birlikte geri alınarak hazineye irad<br />
