49.1.4. Yapılan Sözleşmelerden sonra Harp ve abluka hali olması, kısmî veya genel seferberlik
ilânı,

gösterememesi, malzemenin nakliyat sigortasının yaptırılamaması veya sigorta sözleşmesi
olmaması,
Due to the reasons arising from Contracting Entity’s failure, the failure of the Contracting Entity’s
shipping firm in transportation of the goods or the Contracting Entity’s failure to appoint a shipping
firm for FOB/FCA deliveries, to ensure a transportation insurance for the goods or to have an
insurance agreement.
49.1.6. Taşıma esnasında taşımayı engelleyen kazalarının vuku bulması,

49.1.7. İdare ve/veya ülkesindeki yetkili kurum ve kuruluşların işlemlerinden kaynaklanan ve
sorumluluğu yükleniciye ait olmayan yer tesliminin yapılamaması, projelerin onaylanmaması,
ödenek yetersizliği, teslim limanı ve taşıma aracında değişiklik olması gibi durumlar,
Failure to make delivery to the point which is not under the Contractor’s responsibility, to ratify the
contracts, inadequate appropriations, changes in the delivery port and delivery vehicle due to the
procedures of the authorized agencies and institutions,
49.1.8. Yabancı yüklenici için; Türk resmi makam ve mercileri veya yüklenicinin memleketindeki
resmi makamların karar ve işlemleri, malzeme ihraç lisansına tabi ise ihraç lisansının alınamaması
veya alınmış ise iptal edilmesi sonucu ithalatın imkansız hale gelmesi veya gecikmesi, Yerli
yüklenici için; Türk resmi makam ve mercilerinin karar ve işlemleri, malzeme ihraç lisansına tabi ise
ihraç lisansının alınamaması veya alınmış ise iptal edilmesi sonucu ithalatın imkânsız hale gelmesi
veya gecikmesi.
For foreign tenderers, the blocking or delaying of the import due to the decisions and procedures of
the Turkish official authorities or those of the Contractor’s country or if the material is subject to
export license, the failure to get export license or cancellation of it, for domestic tenderers, the
blocking or delaying of the import due to the decisions and procedures of the Turkish official

49.1.9. Proforma faturada malzemenin temin edileceği belirtilen üreticinin (Üretici (MFRC) kodu
belirtilen) üretimini engelleyen veya aksatan idari hata dışındaki etkenlerin idareye yazılı olarak
bildirilmesi ve bu durumun idare tarafından kabul edilmesi durumunda.
In the event that circumstances which hinder the production process of the manufacturer (the
MFRC code defined on the Proforma Invoice) from which the item/s will be supplied or
circumstances other than Administrative deficiencies are submitted to the Contracting Entity in
writing and that they are accepted by the Contracting Entity.
49.1.10. Ayrıca, İdarenin sebebiyet verdiği ve/veya uygun gördüğü hallerdir.

Yukarıda belirtilen mücbir sebep halleri, hammadde temin edilen ülkeler için de geçerli olacaktır.

49.2. Yukarıda sayılan mücbir sebep hallerinin tevsik şekilleri;
The ratification of the above-mentioned force majeure shall be as follows.
49.2.1. Yabancı yüklenici için 49.1.1., 49.1.2., 49.1.3., 49.1.4., 49.1.6. ve 49.1.9. maddelerindeki
olaylar yüklenicinin bulunduğu ülkenin resmi makamlarından veya mahalli odaca tasdik edilmiş ve
o ülkedeki Türk Konsolosluğunca onaylanmış belgeler ile tevsik edilecektir. Yerli yüklenici için;
49.1.1., 49.1.2., 49.1.3., 49.1.4., 49.1.6. ve 49.1.9. maddelerindeki olaylar resmi makamlardan
veya mahalli odaca tasdik edilmiş belgeler ile tevsik edilecektir.
