The delivery of items are specified in APPENDIX-13. The bids not comforming to this program will
not be accepted.
48.5.1. İhalenin Yabancı İstekliler ve Serbest Bölgeden Teklif Veren İstekliler Lehine
Sonuçlanması Halinde Uygulanacak Teslim Süresi :
Delivery Time for Foreign Bidders and the bidders located in Free Zone Being Awarded a
Contract:
Malzeme sözleşmenin karşılıklı olarak imzalandığının idare tarafından yükleniciye bildirimini
müteakip proforma faturasında belirtilen tarihe kadar tek partide/partiler halinde TESLİM YERİNE
teslim edilecektir. İstekliler teslim sürelerini LAHİKA-13’e uygun verecektir. Akreditifin süresi bu
sürelere göre belirlenecektir. Sözleşmenin imzalanmasını müteakip yüklenici tarafından yapılacak
erken teslim idare tarafından kabul edilecek; ancak ödeme 47.3. maddesinde belirtildiği gibi
olacaktır.
The material shall be delivered to the DELIVERY PLACE in lot/s until the date stated in the
proforma invoice following the notification by the Contracting Entity that the contract has been
signed mutually. The tenderers will give the delivery time in accordance with APPENDIX-13. The
validity time of the letter of credit shall be determined in accordance with the shipment time. After
the signature of the contract, early delivery to be made by the Contractor shall be accepted by the
Contracting Entity; but payment will be done as stated in article 47.3.

Delivery Time for Domestics Tenderers Being Awarded a Contract:
Malzeme sözleşmenin karşılıklı olarak imzalandığının idare tarafından yükleniciye bildirimini
müteakip proforma faturasında belirtilen tarihe kadar tek partide/partiler halinde TESLİM YERİNE
teslim edilecektir. İstekliler teslim sürelerini LAHİKA-13’e uygun verecektir. Sözleşmenin
imzalanmasını müteakip yüklenici tarafından yapılacak erken teslim idare tarafından kabul
edilecek; ancak ödeme 47.3. maddesinde belirtildiği gibi olacaktır.

49.1. Mücbir Sebep Halleri: / Conditions as Force Majeure:
İDARE, Yükleniciden kaynaklanan bir kusurdan ileri gelmemiş olması, taahhüdün kısmen veya
tamamen yerine getirilmesine engel nitelikte olması, yüklenicinin bu engeli ortadan kaldırmaya
gücünün yetmemiş bulunması halinde bu durumun 49.2. maddesinde belirtilen yetkili merciler
tarafından belgelendirilmesi kaydıyla aşağıda belirtilen halleri mücbir sebep olarak kabul eder.
The Contracting Entity shall accept the below mentioned conditions as force majeure provided that
they have not arisen due to the Contractor’ s failure, prevent the fulfillment of the commitment and
the Contractor has no capability to stop and are documented by the competent authorities
specified in Article 49.2.
49.1.1. Olağanüstü tabiat olayları, zelzele, yangın, su baskını gibi doğal afetlerin meydana gelmesi,
Occurrence of abnormal natural disasters such as earthquake, fire and flood.
49.1.2. İmalatın yapıldığı işyeri, fabrika ve mıntıkada taahhüdü önemli ölçüde etkileyen kanuni
grev, ayaklanma ve taşımada ulaşımın engellenmesi,
Legal strike, rebellion preventing the fulfillment of the commitment in the work place, factory and
region and blockages in the transportation.
49.1.3. Genel salgın hastalık ve kıtlık olması veya bu nedenler ile giriş ve çıkışın işçi veya
malzeme ulaşımının engellenmesi,
Epidemics and starvation or the prevention of entry, exit and the transportation of workers or goods
thereto.
