44.2.1. Yüklenicinin Türkiye Temsilciliği aracılığıyla, yurt dışındaki yüklenici yetkilisine
imzalanmak üzere gönderilmeden önce,
Before the contract is sent to the representative of the tenderer abroad for signing of the contract
via Turkish Representative of the tenderer;
44.2.2. Türkiye’deki yüklenici yetkilisine (temsilci) sözleşme imzalama yetkisi verilmiş ise,
sözleşmeyi imzalamadan önce,
If the representative of the tenderer in Turkey is authorized to sign the contract; then before signing
of the contract;
44.2.3. Türkçe-İngilizce sözleşme tasarısı metinlerinin Tercüman/Yeminli Tercüme büroları
tarafından anlam bakımından uygunluğunun onaylanmasını müteakip (idarece talep edilmesi
halinde), Türkçe ve İngilizce sözleşme metinleri yüklenici yetkilisi tarafından imzalanır veya
sözleşme yurt dışında imzalanacaksa, yüklenicinin Türkiye’deki temsilcisi tarafından yurt dışına
gönderilir. Türkiye’deki yüklenici yetkilisine (temsilci) imzalama yetkisi verilmiş ise, yüklenici yetkilisi
tarafından imzalanır.
Following to approval of the Turkish-English draft contract by the translators/sworn translators
stating the correctness of the outline in terms of meaning (in case demanded by Contracting
Entity), the English and Turkish contract texts are signed by the representative of the tenderer, or if
the contract is to be signed abroad, it is sent abroad by representative of tenderer in Turkey. If
executive (representative) of the tenderer in Turkey has authorization for signature, it is signed by
the representative of the tenderer.
44.3. Yerli istekliler lehine sonuçlanan ihaleler sonucunda, Türkiye’deki yükleniciler tarafından
yürütülecek olan ve sadece Türkçe olarak hazırlanması gereken sözleşmelerde tercüman onayı
bulunmayacaktır. Bu durumda sözleşme taslağı doğrudan yüklenici yetkilisi tarafından imzalanır.
For tenders concluded on behalf of domestic tenderers, there shall be no translator’s approval in
contracts that shall be performed by contractors in Turkey and that shall be prepared only in
Turkish. In this case, the contract draft is signed directly by the contractor’s representative.
44.4. Yüklenici yetkilisince imzalanan sözleşme ile birlikte kesin teminat mektubu idareye
teslim edilir.
Final letter of guarantee is delivered to the Contracting Entity together with the contract signed by
the representative of the tenderer.
44.5. Sözleşme bir asıl nüsha olarak imza altına alınacak ve bu nüsha İdare’de alıkonulacaktır.
Ancak, Sözleşmenin düzenlenmesi anında Yüklenici talep ederse (Yerli Yüklenici tarafından
Sözleşmeye ait Damga Vergisi yürürlükteki oranı kadar ilgili Vergi Dairesi’ne/Saymanlığa
yatırılması kaydıyla) bir nüsha daha imza altına alınacak ve bu nüsha Yüklenici’ye verilecektir.
The Contract shall be signed in one original copy and this copy shall be reserved by the
Contracting Entity. However, during the preparation of the Contract, if required by the Contractor
(provided that the domestic contractor deposits the stamp duty of the Contract in an amount
equivalent to current ratio to the competent Tax Contracting Entity/Accountancy Office), one more
copy shall be signed and this copy shall be presented to the Contractor.
44.6. Sözleşme ile ilgili tüm masraflar yükleniciye aittir.
All expenses regarding the contract shall be borne by the tenderer.
V – SÖZLEŞMENİN UYGULANMASINA İLİŞKİN HUSUSLAR

45. AVANS VERİLMESİ ŞARTLARI VE MİKTARI :

Bu malzeme alımı için avans verilmeyecektir.
Any advance payment shall not be made for the purchase of goods for tender.
46. FİYAT FARKI /PRICE DIFFERENCES:
Bu malzeme alımı için fiyat farkı verilmeyecektir.
Any price difference shall not apply for the purchase of goods for tender.
