37.3. İhale sonucunun ilânı; Sözleşmenin istekli ve idare yetkililerince imzalanmasını müteakip,
15 (onbeş) gün içinde www.hvlojk.tsk.tr. internet adresinde yayımlanmak suretiyle ilân edilecektir.
Declaration of the tender decision: Following the signing of the Contract by the Tenderer and
authorities of the Contracting Entity, it shall be announced within 15 (fifteen) days at
www.hvlojk.tsk.tr web site.
38. KESİNLEŞEN İHALE KARARININ BİLDİRİLMESİ :
NOTIFICATION OF THE FINAL TENDER DECISION:
İhale sonucu; ihale kararlarının ihale yetkilisi tarafından onaylandığı günü izleyen 5 (beş) gün
içinde, ihale üzerinde bırakılan istekli de dâhil ihaleye teklif veren bütün isteklilere imza karşılığı
elden tebliğ edilir veya iadeli taahhütlü mektup ile tebligat adreslerine bildirilir. Yerli isteklilere,
mektubun postaya verilmesini takip eden 7 (yedi)’nci gün, Yabancı isteklilerde ise
19 (ondokuz)’uncu gün kararın isteklilere tebliğ tarihi kabul edilir. Ayrıca Elektronik ortamda veya
belgegeçer ile de tebliğ edilebilir. Bu şekilde yapılan tebliğlerde bildirim tarihi tebliğ tarihi sayılır.
İhale kararlarının ihale yetkilisi tarafından iptal edilmesi durumunda da isteklilere aynı şekilde
bildirim yapılır.
Within 5 (five) days following the approval of the tender decision by the tender authority, final
tender decision shall be notified to all tenderers including the tenderers awarded a contract by
hand in return for signature or sent to their correspondence address by registered and reply-paid
mail. For domestic tenderers, the 7th (seventh) day following the date of mailing the notification
letter and for foreign tenderers, the 19th (nineteenth) day shall be deemed to be the date of
notification of tender decision to the tenderers. In addition it may be notified by e-mail or by fax. In
this case, the announcement date shall be deemed to be the notification date. In the event that the
tender decisions are cancelled by the tender authority, the tenderers are notified in the same way.
39. SÖZLEŞMEYE DAVET/INVITATION TO A CONTRACT:
39.1. İş bu şartnamenin 38’inci maddesinde belirtilen bildirim sürelerinin bitimini veya Maliye
Dairesi Başkanlığınca ön mali kontrolü gereken hallerde bu kontrolün yapıldığının bildirilmesini
izleyen günden itibaren, 7 (yedi) gün içinde ihale üzerinde kalan istekli veya yurtiçinde
yetkilendirdiği şahıs, kurum/kuruluş vs.ye kesin teminatı vermek suretiyle sözleşmeyi imzalaması
için idareye davet edilir. İdarece hazırlanan Türkçe İngilizce sözleşme (ihalenin yerli istekli lehine
sonuçlanması halinde sadece Türkçe hazırlanan sözleşme), ve davet yazısı ihale üzerinde kalan
istekliye imza karşılığı elden teslim edilir. Elden teslim edildiği tarih, sözleşmenin imzalanması
hususunun ihale üzerinde kalan istekliye tebliğ tarihidir.
Within 7 days, following the end of the period specified in Article 38 or the day a notification letter
about making an initial control is given, when this control of Presidency of Financial Department is
required, the Tenderer being awarded a contract or his domestic representative,
institution/organization etc. shall be invited for signing of a contract provided that he presents a
performance bond. The Turkish/English contract drawn up by the Contracting Entity (In case a
domestic Tenderer is awarded a contract, only the Turkish version) and the invitation letter shall be
handed to the Tenderer being awarded for a contract against signature. The date when the
contract is handed shall be accepted as the notification to the tenderer being awarded a contract
for signing of the Contract.
39.2. Yüklenicinin sözleşmeyi ve davet yazısını elden teslim alacak yurtiçinde temsilcisinin
bulunmaması durumunda ise hazırlanan sözleşme imzalanmak üzere isteklinin veya temsilcisinin
tebligat adresine iadeli taahhütlü mektup ile postalanmak suretiyle gönderilebilir. Bu durumda
postaya verilmesini takip eden 7 (yedi)’nci gün yerli isteklilere, 19 (ondokuz)’uncu gün yabancı
isteklilere sözleşmenin imzalanması hususunun ihale üzerinde kalan istekliye tebliğ tarihidir.
In the event that the Contractor does not have a domestic representative to get the contract and
invitation letter by hand, the prepared contract may be sent by a registered and reply-paid mail to
the tenderer’s or its representative’s address to sign the contract. In this case, following its mailing,
the 7th (seventh) day for the domestic tenderers and the 19th (nineteenth) day for the foreign
tenderers shall be date of notification of the contract sign to the tenderer awarded.
39.3. Yabancı isteklilerin tebliğ tarihini izleyen 22 (yirmiiki) gün, yerli isteklilerin ise tebliğ tarihini
izleyen 10 (on) gün içinde kesin teminatı idareye teslim etmesi ve sözleşmeyi imzalaması
gerekmektedir.
