33. AŞIRI DÜŞÜK TEKLİFLER/EXCESSIVELY LOW BIDS:
İhale komisyonu, teklifleri değerlendirdikten sonra, diğer tekliflere veya idarenin tespit ettiği
yaklaşık maliyete göre teklif fiyatı aşırı düşük olanları tespit eder ve imalat sürecinin, verilen
hizmetin ekonomik olması, seçilen teknik çözümler ve teklif sahibinin mal/hizmetlerin temini veya
yerine getirilmesinde kullanacağı avantajlı koşullar, teklif edilen mal ve hizmet işinin özgünlüğü
hususları gibi vb. durumları, belgelendirilmek suretiyle yapılan yazılı açıklamaları dikkate alarak,
aşırı düşük teklifleri değerlendirir. Bu değerlendirme sonucunda, açıklamaları yeterli görülmeyen
veya yazılı açıklamada bulunmayan isteklilerin teklifleri reddedilir.
Following the evaluation of the bids by the tender commission, it determines the excessively low
ones compared to other bids or the estimated cost determined by the Contracting Entity and
evaluates the low bids considering the written explanations upon documentation of the economical
character of the production process, the service supplied; the preferred technical solutions and the
advantageous conditions that the tenderer shall use in supplying the material/service; authenticity
of the proposed material and service. Following this evaluation, the bids of the bidders who don’t
make the written explanation or the explanations are not sufficient.
34. BÜTÜN TEKLİFLERİN REDDEDİLMESİ VE İHALENİN İPTAL EDİLMESİNDE İDARENİN
SERBESTLİĞİ:
REJECTION OF ALL BIDS AND AUTHORTY OF THE CONTRACTING ENTITY TO CANCEL
THE TENDER:
34.1. İhale yetkilisinin onayından önceki herhangi bir aşamada ihale komisyonu kararı üzerine
idare, verilmiş olan bütün teklifleri reddederek ihaleyi iptal etmekte serbesttir. İdare bütün tekliflerin
reddedilmesi nedeniyle herhangi bir yükümlülük altına girmez.
Upon the decision of the tender commission at any stage before the approval of the tender officer,
the Contracting Entity is free to reject all bids thus cancel the tender. The Contracting Entity shall
not undertake any commitment resulting from the cancellation of the tender.
34.2. İhalenin iptal edilmesi halinde durum bütün isteklilere derhal bildirilir.
The cancellation of the tender shall immediately be notified to all Tenderers.
34.3. Ayrıca, isteklilerin talepte bulunması halinde, idare ihalenin iptal edilme gerekçelerini talep
eden istekliye bildirecektir.
In case a tenderer requests the Contracting Entity to disclose the reasons of canceling the tender,
the requesting tenderer shall be advised of the reasons.
35. EKONOMİK AÇIDAN EN AVANTAJLI TEKLİFİN BELİRLENMESİ:
DETERMINING THE MOST ECONOMICAL BID
35.1.Bu ihalede ekonomik açıdan en avantajlı teklif, teklif edilen fiyatların en düşük olanıdır.
The most economical bid, offer of the tenderer with the lowest price shall be evaluated as the most
economical bid.
35.2. Fiyat dışı unsurlar: İhale komisyonu mevcut tekliflerde nispi ağırlık yöntemini uygulamayarak,
ihale dokümanındaki şartları sağlayan en düşük fiyat teklifini esas alır.
The tender commission, shall take the lowest price offer, which provides the conditions in tender
document as the basis, by not applying the relative weight method.
35.3. İhale komisyonu; tekliflerin değerlendirilmesi sonucunda ekonomik açıdan en avantajlı teklif
veren isteklinin belirlenmesinin yanında, ekonomik açıdan en avantajlı ikinci teklif veren istekliyi de
belirleyebilir.
The tender commission, besides determining the most economical bid as a result of the evaluation
of the bids, can also determine the tenderer with the second most advantageous bid.
İhale komisyonunca ekonomik açıdan en avantajlı ikinci teklif veren isteklinin belirlenmesi halinde;
en ekonomik teklif veren isteklinin teklifine, bu isteklinin geçici teminatı ilave edilerek bulunan
meblağ, ikinci en ekonomik teklif sahibi isteklinin teklifine eşit veya fazla ise, ikinci en ekonomik
teklif sahibi istekli ile de sözleşme yapılabileceği ihale komisyon kararında belirtilerek, (Ekonomik
açıdan en avantajlı teklif sahibi istekli ve ekonomik açıdan en avantajlı ikinci teklif sahibi isteklinin
ihaleye katılmaktan yasaklı olmadığının tespitini müteakip) ihale yetkilisinin onayına sunulur.
