31.3.3. Bahsedilen aritmetik hatanın düzeltilmesi sonucunda, Proforma Fatura ve isteklinin sunmuş
olduğu Geciçi Teminat Tutarı, Yeni Teklif Bedelinin % 3 (yüzdeüç)’ünün altında kalmış ise; Geçici
Teminat düzeltilerek/tamamlatılarak İdare’ye teslim edilecektir. Düzeltilmiş Geçici Teminat idare’ye
teslim edilmeden, eski geçici teminat İstekliye iade edilmeyecektir.
After the correction of the subject arithmetic mistake, if the quotation of Proforma Invoice and
Temporary Letter of Guarantee, which is submitted by the Tenderer, is below than 3% (three
percent) of new bid price; Temporary Guarantess is corrected/completed and shall be delivered to
Contracting Entity. The old temporary Guarantee shall not be returned back unless the new one is
submitted to Contracting Entity.
31.3.4. İstekli’nin düzeltilen teklif bedelini kabul etmemesi veya süresi içerisinde herhangi bir cevap
vermemesi veya Geçici Teminatı düzeltmemesi/tamamlamaması halinde, teklifi değerlendirme dışı
bırakılır ve geçici teminatı gelir kaydedilir.
In the event that the Tenderer does not accept the corrected bid value or not answer within its
period or not correct/complete the Bid Bond, its bid shall be kept out of evaluation and the bid bond
shall be registered as revenue.
31.4. İdari Şartname gereklerini karşılayan istekliler tespit edilir. Yapılan değerlendirme
sonucunda ihale komisyonu tarafından ihale, ekonomik açıdan en avantajlı teklifi veren
istekli/istekliler üzerinde bırakılır. Fiyat üzerinde herhangi bir görüşme yapılmayacaktır.
The Tenderers meeting the Administrative Specifications’ requirements are determined. At the end
of the evaluations, the contract shall be awarded by the tender commission for the tenderer/s who
submitted the most economical bid. Any negotiation on price shall not be executed.
31.5. Tekliflerin değerlendirilmesi sırasında, İdarenin arzın sürekliliğinin sağlanmasını gerekli
görmesi halinde; istekli/isteklilerden taahhüt istenebilir. İstekli malzeme sevkıyatı için ilgili ülkenin
yetkili makamlarından alacağı güvence veya taahhüt belgesini, Apostille kaşeli veya ilgili ülkedeki
Türk Konsolosluğunca onaylı veya T.C.Dış İşleri Bakanlığınca onaylı olarak ihale komisyonuna
verecektir. İstekli tarafından, güvence verilmemesi halinde, İdare istekliyi ihale dışı bırakmakta
serbest olacaktır.
During the evaluation of bids, in case Contracting Entity decides necessary to provide continuation
of supply; commitment may be demanded from tenderer/tenderers. Tenderer shall submit the
guarantee or commitment document, which shall be apostille stamped or approved by Turkish
Consulate in relevant country or approved by T.R. Ministry of Foreign Affairs, obtained from
authorized offices of relevant country for the purpose of material’s transportation. If tenderer does
not deliver this guarantee, Contracting Entity is free to exclude or include, tenderer from tender
proceedings.
32. İSTEKLİLERDEN TEKLİFLERİNE AÇIKLIK GETİRİLMESİNİN İSTENİLMESİ:
ASKING TENDERERS FOR CLARIFICATION OF THEIR BIDS
32.1. İhale komisyonunun talebi üzerine idare, tekliflerin incelenmesi, karşılaştırılması ve
değerlendirilmesinde yararlanmak üzere net olmayan hususlarla ilgili isteklilerden tekliflerini
açıklamalarını isteyebilir.
Upon the request of the tender comission, Contracting Entity may ask tenderers for clarification of
their tenders in writing on the unclear aspects of the tender, in order to use in the examination,
evaluation and comparison of tenders.
32.2. Bu açıklama, hiçbir şekilde teklif fiyatında değişiklik yapılması veya ihale dokümanında yer
alan şartlara uygun olmayan tekliflerin uygun hale getirilmesi amacıyla istenilemez ve bu sonucu
doğuracak şekilde kullanılamaz.
However; in this explanation, no change in a matter of substance in the tender, including changes
in price and changes aimed at making an unresponsive tender responsive, are sought, offered or
permitted until prices are negotiated.
32.3. İdarenin açıklama talebi ve isteklinin bu talebe vereceği cevaplar yazılı olacaktır.
The Contracting Entity’s demand and the Tenderer’s answer shall be in written.
