25.4. Muayeneye ilişkin her türlü masraflar (yol, iaşe ve ibate masrafları hariç) Yüklenici’ye aittir.
All expenses of inspection (excluding traveling, food and accommodation) shall be paid by the
Contractor.
25.5. Sözleşme giderleri Yükleniciye aittir.
Expenses of contract shall be paid by the Contractor.
26. GEÇİCİ TEMİNAT/ TEMPORARY GUARANTEE
26.1 İhale komisyonu; teklif değerlendirilmesinde, ilk önce Geçici Teminatı inceler. Geçici
Teminat; Mektup olarak verilecek ise, LAHİKA-8’ deki örneğe ve aşağıda yer alan maddelere
uygun şekilde düzenlememiş olan isteklilerin teklifleri değerlendirilmeyecek ve istekliler ihale dışı
bırakılacaktır.
Tender Commisssion first evaluates temporary letter of Guarantee during the evaluation of
proposals. If the Temporary Letter of Guarantee shall be submitted as a letter; The Temporary
Letters of Guarantee of Tenderers, which are not arranged in accordance with the following
matters and the sample in APPENDIX-8 and articles below, shall not be evaluated and those
tenderers shall be excluded from tender and their bids.
26.2. İstekliler, opsiyonlar dâhil (alternatif teklif verilmesi durumunda en yüksek teklif bedelinin)
teklif mektubunda sundukları bedelin % 3 (yüzdeüç)’ünden az olmamak üzere, kendi
belirleyecekleri tutarda Geçici Teminat vereceklerdir. Geçici Teminat Mektubu verilmesi halinde;
aşağıdaki ve LAHİKA-8’deki örneğe uygun olarak teklifi ile birlikte verilecektir.
Tenderer(s) shall submit a Temporary Guarantee at a rate that they will determine, not less than at
a rate of 3 % of bid price including the options(in case alternative bids are submitted, highest price
shall be taken basis). In case of submitting Temporary Letter of Guarantee, it shall be submitted in
accordance with sample in APPENDIX-8, along with their bids.
26.3. İsteklinin ortak girişim olması halinde, ortaklar hisseleri oranında teminat verebilecekleri gibi
toplam geçici teminat miktarı, en az teminat miktarının altında kalmamak koşulu ile ortaklardan biri
veya birkaçı tarafından karşılanabilir.
In case the tenderer is a joint venture, partners can submit temporary letter of guarantees in
proportion to their shares, however the total of the preliminary guarantee may be covered by one
or jointly by some of the partners, provided that the amount of such preliminary guarantee is not
less than the required minimum preliminary guarantee amount.
26.4. Kabul edilebilir bir geçici teminat ile birlikte verilmeyen teklifler, idare tarafından istenilen
katılma şartlarının sağlanamadığı gerekçesiyle değerlendirme dışı bırakılacaktır. Ancak, Birim Fiyat
Teklif Cetveli’ndeki /Teklif Mektubu (proforma fatura)’ndaki aritmetik hata durumunda ihtiyaç olması
halinde, geçici teminat yeniden istenebilir.
Bids not accompanied by an acceptable Temporary letter of guarantee shall be excluded from the
evaluation process on grounds that the required conditions of participation have not been met.
However, in case there appears a mathematical error on the proforma invoice, Temporary letter of
guarantee may be requested again.
26.5. Geçici teminat mektubu süresiz olabilecektir. Süreli olması halinde ise; tekliflerin geçerlilik
süresinin en az 30 (otuz) gün sonrasını kapsayacak şekilde süreli olacak, aynı zamanda İdarenin
ikazına lüzum kalmaksızın belirli devreler halinde (istekliye bağlı olarak .... gün/.... ay/.... yıl vb.)
otomatik olarak uzatılacağı hükmü yer alacaktır.
Preliminary Guarantee may have no time limit. If it has a time limit, it shall cover the period 30
(thirty) days following to the validity period of the bids and also the provision stating that this period
shall automatically be extended in periods in specific time intervals(i.e. ….day/….month/….year),
without the necessity of contracting entity’s notification shall be written.
26.6. İstekli tarafından; Geçici Teminat Mektubu Türkçe olarak verilecektir. Türkçe dışında bir
dilde sunulan geçici teminat mektubu kabul edilmeyecektir. LAHİKA-8’de yer alan İngilizce Geçici
Teminat Mektubu örneği, Teminat Mektubunun içeriğinin yabancı istekliler tarafından
anlaşılabilmesi maksadıyla verilmiştir. Yabancı dilde düzenlenmiş teminat mektubu kabul
edilmeyecektir.
Tenderer shall submit Temporary Letter of Guarantee in Turkish. Temporary Letter of Guarantee
submitted in another language shall not be accepted.A sample for Temporary Letter of Guarantee
