When required, the Contracting Entity could request of Tenderers to extend the validity period of
bids for a maximum period stated above before the expiration of their validity. The Tenderers could
accept or reject this request. The bid bond of the tenderer who rejected the extension request of
the Contracting Entity shall be returned to the Tenderer.
24.3. Ancak bu sürenin bitimine rağmen ihalenin sonuçlandırılamayacağının ihale komisyonunca
belirlenmesi halinde ihale yetkilisinin onayı ve isteklinin kabulü ile bu süre en fazla 60 (altmış)
günlük süreler halinde yeteri kadar uzatılabilir.
However, in case it is observed that the tender could not be finalized despite the end of this period,
the validity time could be extended in intervals of maximum 60 (sixty) days by the authorization of
the Contracting Entity and acceptance of Tenderers.
24.4. Bu konudaki istek ve cevaplar yazılı olacaktır. Evraklar iadeli taahhütlü posta yoluyla
gönderilecek veya imza karşılığı elden teslim edilecektir.
Any request and answers concerning this topic shall be in written. Documents shall be sent by
registered and reply paid mail or be handed in return for signature.
25. TEKLİF FİYATINA DÂHİL OLAN MASRAFLAR/EXPENSES INCLUDED IN THE BID PRICE:
25.1. Yabancı istekliler için; sözleşmenin ve taahhüdün tamamının yerine getirilmesi sürecinde
malzemenin FOB/FCA teslimine kadar tahakkuk edecek her türlü vergi, resim, harç ve diğer
masraflar istekliye, FOB/FCA tesliminden sonra tahakkuk edecek vergi, resim ve harç masrafları
ise İdare’ye aittir.
For foreign tenderers; any duty, levy and charge and as such to be incurred to FOB/FCA delivery
shall be borne by the Tenderer and those after FOB/FCA by the Contracting Entity.
Yerli istekliler için; sözleşmenin ve taahhüdün tamamının yerine getirilmesine ait malzemenin
teslim yerine teslimine kadar tahakkuk edecek her türlü vergi, resim, harç ve diğer masraflar
istekliye, teslim yerine tesliminden sonra tahakkuk edecek vergi, resim ve harç masrafları ise
İdare’ye aittir. Ancak Tahakkukta doğacak vergi resim ve harçlar istekliye ait olacaktır. Ayrıca, satın
alınacak malzeme için, 31 Temmuz 2004 tarih ve 25539 sayılı Resmi Gazete’de yayımlanan 5228
sayılı kanunun 14 üncü maddesi ile 3065 sayılı Katma Değer Vergisi (KDV) Kanununun 13’üncü
maddesine eklenen (f) fıkrası gereği KDV ödenmeyecektir.
For domestic bidders; expenses to be incurred till delivery place for the enforcement of the
Contract and the commitment and taxes, levies and charges as well as other expenses regarding
the contract shall be borne by the Contractor and those after these points shall be borne by the
Contracting Entity. However, the duties, charges and levies during the performance of the Contract
and the commitment shall be borne by the Contractor. However, for the material to be procured,
VAT shall not be paid in accordance with Article 14 of the Law No.5228 issued in the Official
Gazzette dated 31 July 2004 and no.25539 and the subparagraph (f) added Article 13 of the Value
Added Tax (VAT) Law.
Serbest bölgeden teklif veren istekliler için; sözleşmenin ve taahhüdün tamamının yerine
getirilmesi sürecinde malzemenin Serbest Bölge Çıkış Kapısında teslimine kadar tahakkuk edecek
her türlü vergi, resim, harç ve diğer masraflar istekliye, Serbest Bölge Çıkış Kapısından sonra
tahakkuk edecek vergi, resim ve harç masrafları ise İdare’ye aittir.
For the tenderers located in Free Zone; any duty, levy and charge and as such to be incurred
to the delivery at the Free Zone Exit Gate shall be borne by the Tenderer and those after Free
Zone Exit Gate by the Contracting Entity.
25.2. Akreditifle ilgili İdare’nin ülkesindeki banka masrafları İdareye, yurt dışındaki muhabir banka
masrafları Yükleniciye ait olacaktır. Herhangi bir sebeple akreditifin süresinin uzatılması gerekirse,
akreditifin süresinin uzatılması ile ilgili yurt dışındaki muhabir banka masrafları da Yükleniciye ait
olacaktır.
Banking expenses of letter of credit incurring in the Contracting Entity’s country shall be paid by the
Contracting Entity and those of the correspondent bank at abroad by the Contractor. If any time
extension is required for the letter of credit for any reason, expenses of the correspondent bank
abroad shall be borne by the Contractor.
25.3. Teminat Mektupları ile ilgili tüm masraflar Yükleniciye aittir.
Expenses of letter of guarantees shall be borne by the Contractor.
