More than one natural or legal persons by setting up a joint venture can submit tenders. Partners
of joint venture form a partnership to fulfil their rights and responsibilities, and all the work together.
In joint venture agreements (Joint Venture Declaration) the pilot partner is determined. In case the
contract is awarded to the joint venture, a notary-certified partnership contract shall be submitted
prior to signing of the contract. In both partnership agreement (Joint Venture Declaration) and
partnership contract, it is stated that the natural or legal persons setting the joint venture are jointly
and severally liable in the fulfillment of the commitment. Joint Venture Declarations shall be filled in
accordance with the sample in APPENDIX-3and it will be submitted with the bid.
15.2. Ortak Girişimin; mesleki ve teknik yeterlilik almış olması, ortak girişim ortaklarının her
birinin ayrı ayrı yeterlilik aldığını göstermez ve yeterlilik değerlendirilmesi sonucu yeterli görülen İş
ortaklığının ihaleden önce bozulması halinde, ortaklardan birinin tek istekli olarak devam etme
talebi geçersiz sayılır.
Joint venture’s technical and professional adequacy does not mean that each partner of the joint
venture is adequate, and in case the joint venture, accepted as adequate breaks down before the
tender, the demand of any particular partner to attend the tender as the only tenderer is
invalidated.
15.3. İş ortaklığında pilot ortak, en çok hisseye sahip ortak olmalıdır. Ortakların hisse oranları,
ortaklık anlaşmasında (İş Ortaklığı Beyannamesi) ve ortaklık sözleşmesinde gösterilir.
The pilot partner in joint venture must be the partner with the most shares. The share rates of the
partners are shown in partnership agreement (Joint Venture Declaration) and partnership contract.
15.4. Bu ihaleye konsorsiyumlarca teklif verilemez.
Consortiums cannot submit bids for this tender.
16. ALT YÜKLENİCİLER / SUBCONTRACTORS :
İhale konusu işin tamamı veya bir kısmı alt yüklenicilere yaptırılamaz.
Subcontractors shall not be employed for any part or the whole job.
III. TEKLİFLERİN HAZIRLANMASI VE SUNULMASINA İLİŞKİN HUSUSLAR
TERMS AND CONDITIONS FOR DESIGNING AND SUBMISSION OF BIDS :
17. TEKLİF VE SÖZLEŞME TÜRÜ: TYPE OF THE BID AND THE CONTRACT:
Fiyat üzerinde görüşme yapılmadan yapılan değerlendirmeler neticesinde ayrıntılı özelliklerine
dayalı olarak; idarece hazırlanmış cetvelde yer alan her bir iş kaleminin miktarı ile bu iş kalemleri
için tespit edilen birim fiyatların çarpımı sonucu bulunan toplam bedel üzerinden birim fiyatlı
sözleşme düzenlenir.
Based on the assesments made without negotiations on the price, a firm fixed unit price contract
shall be concluded over a total price determined by multiplying quantities and unit prices specified
in the requirement list.
18. TEKLİFİN DİLİ : LANGUAGE OF THE BID
18.1. Teklifi oluşturan bütün belgeler ve ekleri ile diğer dokümanlar Türkçe olacaktır. Başka bir
dilde sunulan belgeler, onaylı Türkçe tercümesi ile birlikte verilmesi halinde geçerli sayılacaktır. Bu
durumda teklifin veya belgenin yorumlanmasında Türkçe tercüme esas alınır.
All documents and annexes included by the bid and other documents shall be written in Turkish.
Documents presented in other languages shall be deemed as applicable after its notarized Turkish
translation is provided. In this case, Turkish translation shall be superior in the interpretation of the
bid or the document.
18.2. Ancak Teknik Şartnameye veya Teknik Şartname yerine geçen dokümanlara verilen
cevaplarda Türkçeye çevrilememiş bölümlerle ilgili hususlarda İngilizce geçerli olabilecektir.
English shall only prevail on the parts in the answers for Technical Specification or the documents
replacing Technical Specification not translated into Turkish.
18.3. Günlük yazışma ve iletişim Türkçe dilinde olacaktır. İstekli tarafından, Türkçe dışındaki
belgeler Türkçe tercümeleri ile birlikte gönderilecektir. İhale dokümanı ve eklerinde farklılık olması,
belgeler arasında uyuşmazlık bulunması halinde, Türkçe metinler geçerli olacaktır.
