Upon the confirmation of the accuracy of the informer, in order to enlighten the issues in the
denunciation letter or in the report which the informer signed, the tenderer shall be required by the
tender commission to document (if it is the foreign tenderer, this document shall be with Apostille
cachet or be approved by the Turkish Consulate in related country or institutions of Turkish Ministry
of Foreign Affairs) the denunciation letter maximum in 1 (one) month after its notification date in
accordance with its legislation and to sent it to the tender commission.
9.7.3. İsteklinin 1 (bir) ay içerisinde bu bilgi ve belgeleri göndermemesi halinde, isteklinin teklifi
değerlendirme dışı bırakılır. Bu durumda istekli, ihalelere katılmaktan yasaklanır ve geçici teminatı
Türkiye Cumhuriyeti Hazinesine irad kaydedilir.
If the tenderer does not send this document and information within 1 (one) month, tenderer’s
proposal is kept out of evaluation. And in this case, tenderer is prohibited to join the tenders and
temporary letter of guarantee is registered as revenue to Treasury of Republic of Turkey.
10. YASAK FİİL VEYA DAVRANIŞLAR/FORBIDDEN ACTS OR BEHAVIORS:
10.1. İhalede aşağıda belirtilen fiil veya davranışlarda bulunmak yasaktır.
It is prohibited to commit below-mentioned acts or enjoy behaviors during the tender:
10.1.1. Hile, vaat, tehdit, nüfuz kullanma, çıkar sağlama, anlaşma, irtikâp, rüşvet suretiyle veya
başka yollarla ihaleye ilişkin işlemlere fesat karıştırmak veya buna teşebbüs etmek.
Conspiring about the operations concerning the tender through committing fraud, giving promises,
using influence, acting on interest, reaching an agreement, corruption, bribery and other ways.
10.1.2. İsteklileri tereddüde düşürmek, katılımı engellemek, isteklilere anlaşma teklifinde
bulunmak veya teşvik etmek, rekabeti veya ihale kararını etkileyecek davranışlarda bulunmak.
To cause the tenderers hesitate, to prevent bidding, to propose the other Tenderers to reach an
agreement, or to encourage them, to commit acts or behaviors to influence the tender decision.
10.1.3. Sahte belge veya sahte teminat düzenlemek, kullanmak veya bunlara teşebbüs etmek.
To design, use falsified documents or guarantees or try committing these.
10.1.4. Alternatif teklif verebilme halleri dışında, bir istekli tarafından kendisi veya başkaları adına
doğrudan veya dolaylı olarak, asaleten ya da vekâleten birden fazla teklif vermek.
To submit more than one bid in person or in proxy directly or indirectly except for alternative bids,
10.1.5. Bu şartnamenin 8’inci maddesine göre ihaleye katılamayacağı belirtildiği halde ihaleye
katılmak.
To bid in spite of being prohibited from bidding in accordance with Article 8.
10.2. İmzalanacak Sözleşmenin uygulanması sırasında aşağıda belirtilen fiil veya
davranışlarda bulunmak yasaktır.
It is forbidden to act the below mentioned acts or enjoy behaviors during the enforcement
of the contract:
10.2.1. Hile, vaat, tehdit, nüfuz kullanma, çıkar sağlama, anlaşma, irtikâp, rüşvet suretiyle veya
başka yollarla sözleşmeye ilişkin işlemlere fesat karıştırmak veya buna teşebbüs etmek.

ways or attempting thereto.
10.2.2. Sahte belge düzenlemek, kullanmak veya bunlara teşebbüs etmek.
To design, to use falsified documents or try committing these.
10.2.3. İmzalanacak sözleşme konusu işin yapılması veya teslimi sırasında hileli malzeme, araç
veya usuller kullanmak, fen ve sanat kurallarına aykırı, eksik, hatalı veya kusurlu imalat yapmak.
To use falsified materiel, equipment or methods, to manufacture contrary to scientific and artistic
rules as well as manufacturing in a deficient or faulty way.
10.2.4. Taahhüdünü yerine getirirken idareye zarar vermek.
To cause harm the Contracting Entity during the undertaking of the work for tender.
