önceden yazılı izni olmaksızın ihale ve/veya sözleşmenin herhangi bir aşamasında her hangi bir
detayı ifşa etmeyecek veya yayınlamayacaktır. Türk yargı mercilerinin kararları saklı kalmak
kaydıyla imzalanacak olan sözleşmenin amaçları doğrultusunda her hangi bir ifşa veya yayınlama
gerekliliği konusunda bir uyuşmazlık ortaya çıkarsa İDARE’nin bu konudaki kararı nihai olacaktır.
The Contractor shall keep all data and documents secret regarding the material and not disclose or
publish any information related to the contract in any phase of the tender/contract without the
written approval of the Contracting Entity excluding the conditions required for the performance of
the contract. In case any dispute arises due to the need for disclosing or publishing information
within the framework of the contract, the final decision shall be made by the Contracting Entity
provided that the decisions of Turkish judicial authorities shall be reserved.
6.2.10.2. İstekliler tarafından verilecek Tedarik Taahhütnamesi
Certificate of Commitment for acquisition
İstekli/isteklilerin yetkili/yetkilileri LAHİKA-5’de yer alan taahhütnameyi imzalayarak, teklifi ile
idareye teslim edeceklerdir. Taahhütnamedeki yasaklara uymayanlar hakkında bu şartnamenin
6.2.10.1. ve 10.3’üncü madde hükümleri uygulanır
Representative/s of the tenderer/s shall sign the Certificate of Commitment at APPENDIX-5 and
submit it with the bid. For the persons who do not obey the prohibitions in .the Certificate of
Commitment, terms of Articles 6.2.10.1. and 10.3 of this Specification shall apply.
6.2.11. İsteklilerin İmalatçı veya Yetkili Satıcı olması halinde
If Tenderers are Manufacturer;or Authorized Seller
6.2.11.1. İstekli İmalatçı ise; ilk ilan veya ihale tarihinin içinde bulunduğu yılda alınmış, malzemenin
imalatçısı olduğunu belgeleyen Ticaret ve Sanayi Odasınca tasdik edilmiş imalatçı belgesini aslı
veya noter tasdikli suretini verecektir.
If a manufacturer, shall present an original or notarized copy of the manufacturer certificate
received in the year of announcement or tender date indicating that he is the manufacturer of the
item and approved by Chamber of Commerce and Industry.
6.2.11.2. İstekli Yetkili satıcı ise;
6.2.11.2.1. İstekli, imalatçı Firmadan alınacak, malın kendi imalatı ve teklif tarihinde yetkinin geçerli
olduğunu belirleyen, imalatçı firmanın yetkili satıcısı olduklarını gösteren Yetkili Satıcılık belgesini
verecektir. Bu belge, imalatçı firmanın yerleşik olduğu ülkenin Ticaret ve Sanayi Odasınca veya
mevzuatına uygun yetkili kurumunca tasdik edilmiş olacaktır.
If an authorized seller; he shall present Authorized Seller Certificate indicating that the item to be
accepted from the Manufacturer is his own production and the authorization is valid in the bidding
date, they are the authorized seller of the manufacturer . This certificate shall be approved by the
authorized agency or Chamber of Commerce and Industry in manufacturer’s country.
6.2.11.2.2. İmalatçının yabancı olması halinde; belge, Apostille kaşeli veya ilgili ülkenin Türk
Konsolosluğunca veya Türk Dışişleri Bakanlığınca onaylı olacak belgenin aslı veya noter tasdikli
sureti, onaylı Türkçe tercümesi ile birlikte verilecektir. Yerli imalatçı olması halinde ise, belgenin
aslı veya noter tasdikli suretini verecektir.
If the manufacturer is foreigner, the document shall be with Apostille cachet or approved by the
related country’s Consulate of the Republic of Turkey. The original or notarized copy of the
document shall be submitted with its approved Turkish translation. If the manufacturer is domestic
manufacturer, he shall submit the original or notarized copy of the document.
6.2.11.3. İsteklinin Türkiye’deki Serbest Bölgelerde faaliyet gösteren İmalatçı veya Yetkili Satıcı
olması durumunda; İmalatçı belgesi veya yetkili satıcılık belgesinin yanı sıra, İsteklinin hangi
serbest bölgede ve hangi konuda faaliyette bulunduğunu gösteren ve teklif tarihinde geçerli olan
Serbest Bölge Faaliyet Belgesini ilgili makamlardan onaylı olarak teklifine ekleyecektir.
In case the tenderer is a Manufacturer or an Authorized Seller in the Free Zone in Turkey, in
addition to the Manufacturer Certificate or authorized seller certificate, tenderer shall submit with
his bid the certificate of authorization for working in free zones valid in bidding date indicating the
free zone where the tenderer works in and the subject of the work and confirmed by the competent
authorities.
