In case the Tenderer is a joint venture, the documents stated in Article 6.1.2., 6.1.3., 6.1.4.
and 6.1.15. shall be presented one by one.
6.1.9. İstekliler tekliflerinde, şahıs şirketi ise şirket ortaklarını, sermaye şirketi ise sermayesinin
yarısından fazlasına sahip olan ortaklarını LAHİKA-4`de örneği bulunan forma uygun olarak beyan
edecektir. Ayrıca, başka bir şahıs şirketinde ortak olmaları durumunda bu şirketi, sermaye
şirketinde ortak olmaları durumunda ise sermaye şirketinin yarısından fazlasına sahip olmaları
durumunu beyan edecektir.
The Tenderer shall specify company partners according to the attached document at APPENDIX-4
if the company is an individual company and if a stock corporation, the name of the shareholder
possessing more than half of the company’s capital. Furthermore, if the Tenderer serves a partner
in another company, he shall note the name of the company and if he possesses more than half of
the capital of this, he shall underline that.
6.1.10. Gizlilik ve Güvenlik Confidentiality and Security:
6.1.10.1. YÜKLENİCİ, malzeme ile bağlantılı olarak elde ettiği her tür bilgi ve dokümanı özel ve
gizli tutacaktır. İmzalanacak olan sözleşmenin yerine getirilmesi amaçları dışında, İDARE’nin
önceden yazılı izni olmaksızın ihale ve/veya sözleşmenin herhangi bir aşamasında her hangi bir
detayı ifşa etmeyecek veya yayınlamayacaktır. Türk yargı mercilerinin kararları saklı kalmak
kaydıyla imzalanacak olan sözleşmenin amaçları doğrultusunda her hangi bir ifşa veya yayınlama
gerekliliği konusunda bir uyuşmazlık ortaya çıkarsa İDARE’nin bu konudaki kararı nihai olacaktır.
The Contractor shall keep all data and documents secret regarding the goods and not disclose or
publish any information related to the contract without the written approval of the Contracting Entity
excluding the conditions required for the performance of the contract. In case any dispute arises
due to the need for disclosing or publishing information within the framework of the contract, the
final decision shall be made by the Contracting Entity provided that the decisions of Turkish judicial
authorities shall be reserved.
6.1.10.2. İstekliler tarafından verilecek Tedarik Taahhütnamesi
Certificate of Commitment for acquisition
İstekli/isteklilerin yetkili/yetkilileri LAHİKA-5’de yer alan taahhütnameyi imzalayarak, teklifi ile
idareye teslim edeceklerdir. Taahhütnamedeki yasaklara uymayanlar hakkında bu şartnamenin
6.1.10.1. ve 10.3’üncü madde hükümleri uygulanır
Representative/s of the tenderer/s shall sign the Certificate of Commitment at APPENDIX-5 and
submit it with the bid. For the persons who do not obey the prohibitions in .the Certificate of
Commitment, terms of Articles 6.1.10.1. and 10.3 of this Specification shall apply.
6.1.11. İsteklilerin İmalatçı veya Yetkili Satıcı olması halinde
If Tenderers are Manufacturer or Authorized Seller;
6.1.11.1. İstekli İmalatçı ise; ilk ilan veya ihale tarihinin içinde bulunduğu yılda alınmış, malzemenin
imalatçısı olduğunu belgeleyen ve isteklinin yerleşik olduğu ülkenin ticaret ve sanayi odasınca veya
mevzuatına uygun yetkili kurumunca tasdik edilmiş imalatçı belgesini Apostille kaşeli veya ilgili
ülkenin Türk Konsolosluğunca veya Türk Dışişleri Bakanlığınca onaylı olarak verecektir.
If a manufacturer, shall present the manufacturer certificate with Apostille cachet or confirmed by
Consulate of the Republic of Turkey in the related country or Turkish Ministry of Foreign Affairs
received in the year of first announcement or tender date indicating that he is the manufacturer of
the item and approved by the authorized agency or Chamber of Commerce and Industry in
tenderer’s country.
6.1.11.2. İstekli Yetkili satıcı ise; İmalatçı firmadan alacakları malın kendi imalatları olduğunu ve
teklif tarihinde yetkinin geçerli olduğunu belirleyen, imalatçı firmanın yetkili satıcısı olduklarını
gösteren, imalatçının yerleşik olduğu ülkenin ticaret ve sanayi odasınca veya mevzuatına uygun
yetkili kurumunca tasdik edilmiş Yetkili Satıcılık Belgesini Apostille kaşeli veya ilgili ülkenin Türk
Konsolosluğunca veya Türk Dışişleri Bakanlığınca onaylı olarak teklifine ekleyecektir.
If an authorized seller; he shall present Authorized Seller Certificate with Apostille cachet or
confirmed by Consulate of the Republic of Turkey in the related country or Turkish Ministry of
Foreign Affairs indicating that the item to be accepted from the Manufacturer is their own
production and the authorization is valid in the bidding date, they are the authorized seller of the
