27. Video and Still Photography of the stretch to be improved/renewed before and after execution of the
work should be invariably done and records sent to the Ministry through this office for appreciation of work done.
28. The IRC SP:53 on “Guideline on use of polymer and rubber modified bitumen “ in road construction
(latest revision ) should be strictly followed during construction.
29. Before actual execution, the borrow area for selected earth shall be exactly identified and got inspected and
approved from an officer to be appointed by the employer.
30. As per Ministry’s circular issued vide NH-12013/45/2007/Misc/NH-10 dated 02.04.08 an interest @ 10%
per annum (compounded quarterly) will be levied on the amount of advance drawn by the contractors for SARDP-
NE works.
31. All bitumen and modified bitumen will have to be procured by the contractors from the refinery sources
only. Verification of related documents for purchase & testing of bitumen/ modified bitumen from Engineer-in-
Charge is compulsory.
32. Disposal of excavated materials: All the excavated materials shall be the property of the Accepting Officer.
The material obtained from the excavation of roadway, shoulders, verges, drains, cross-drainage works etc., shall be
used for filling up of (i) roadway embankment, (ii) the existing pits in the right-of-way and (iii) for landscaping of the
road as directed by the Engineer-in-Charge/OC Contract, including levelling and spreading with all lifts and lead as
specified and no extra payment shall be made for the same. Further all excess excavated materials shall be
disposed of at km 67.40 on NH-31A on Sevoke Gangtok Road.
33. Retrieved Material: All retrieved materials (esp: stone retrieved from Hard Rock) which are useful in the
construction works shall be used for permanent works and GSB/WMM/DBM/BC works as per the directions of the
Engineer-in-Charge/OC Contract. However, contractor can use retrieved materials (esp: stone retrieved from Hard
Rock) only to the extent up to the total requirement of the materials required for total scope of PMT/
GSB/WMM/DBM/BC works provisioned in the subject contract. The royalty for the same is to be cleared by the
contractor.
34. Royalties: No quarries on charge of department are available. The Contractor shall make his own
arrangements for obtaining land for quarrying sand/stone & obtaining other materials including retrieved materials
required for the work. Payment of royalties of such materials is to be borne by the Contractor, and his quoted rates
shall be deemed to include for the same. The contractor shall submit a royalty clearance certificates issued by the
department of Forests Minerals, Government of Sikkim along with the RAR(s) /final bill failing which, the said
amount of royalty shall be deducted from their RAR(s)/final bill and shall be deposited with state Government.
35 Blasting rocks:
a) The Tenderer must make himself aware about the procedure for obtaining licence for storage of explosive
and doing blasting operation. The department does not owe any responsibility if State/Central Govt ceases explosive
and take legal action against the Tenderer or his staff in case of non holding/procession of such licence.
(b) The contractor shall be responsible for the safe custody and storage of blasting materials in accordance
with the rules on the subject. Written authority of the OC shall be obtained before any blasting operations are
commenced.
(c ) The contractor shall ensure that the charges in blasting are not excessive and that the charged bore holes
are properly protected before firing and that proper precautions are taken for the safety of men and property.
(d) Blasting in general must be avoided. In case it is unavoidable only controlled blasting may be resorted
with the prior permission of the Engineer-in-Charge. The contractor shall be bound to abide by the
instructions of the Officer Commanding(OC) regarding the necessity of blasting and the type, number size and
pattern of holes to be drilled and also the type, amount and method of firing of explosive to be used. The OC
shall reserve the right to restrict the number of charge to be fired at a time so that the hillside is not adversely
affected. The contractor shall fire the charges only at such time as approved by the OC and shall have no
claim, whatsoever, on account of any delay and extra cost due to carrying out the instructions of the OC and/or
taking the safety precautions directed by him.
