27. Video and Still Photography <strong>of</strong> <strong>the</strong> stretch to be improved/renewed before and after execution <strong>of</strong> <strong>the</strong><br />

work should be <strong>in</strong>variably done and records sent to <strong>the</strong> M<strong>in</strong>istry through this <strong><strong>of</strong>fice</strong> for appreciation <strong>of</strong> work done.<br />

28. The IRC SP:53 on “Guidel<strong>in</strong>e on use <strong>of</strong> polymer and rubber modified bitumen “ <strong>in</strong> road construction<br />

(latest revision ) should be strictly followed dur<strong>in</strong>g construction.<br />

29. Before actual execution, <strong>the</strong> borrow area for selected earth shall be exactly identified and got <strong>in</strong>spected and<br />

approved from an <strong><strong>of</strong>fice</strong>r to be appo<strong>in</strong>ted by <strong>the</strong> employer.<br />

30. As per M<strong>in</strong>istry’s circular issued vide NH-12013/45/2007/Misc/NH-10 dated 02.04.08 an <strong>in</strong>terest @ 10%<br />

per annum (compounded quarterly) will be levied on <strong>the</strong> amount <strong>of</strong> advance drawn by <strong>the</strong> contractors for SARDP-<br />

NE works.<br />

31. All bitumen and modified bitumen will have to be procured by <strong>the</strong> contractors from <strong>the</strong> ref<strong>in</strong>ery sources<br />

only. Verification <strong>of</strong> related documents for purchase & test<strong>in</strong>g <strong>of</strong> bitumen/ modified bitumen from Eng<strong>in</strong>eer-<strong>in</strong>-<br />

Charge is compulsory.<br />

32. Disposal <strong>of</strong> excavated materials: All <strong>the</strong> excavated materials shall be <strong>the</strong> property <strong>of</strong> <strong>the</strong> Accept<strong>in</strong>g Officer.<br />

The material obta<strong>in</strong>ed from <strong>the</strong> excavation <strong>of</strong> roadway, shoulders, verges, dra<strong>in</strong>s, cross-dra<strong>in</strong>age works etc., shall be<br />

used for fill<strong>in</strong>g up <strong>of</strong> (i) roadway embankment, (ii) <strong>the</strong> exist<strong>in</strong>g pits <strong>in</strong> <strong>the</strong> right-<strong>of</strong>-way and (iii) for landscap<strong>in</strong>g <strong>of</strong> <strong>the</strong><br />

road as directed by <strong>the</strong> Eng<strong>in</strong>eer-<strong>in</strong>-Charge/OC Contract, <strong>in</strong>clud<strong>in</strong>g levell<strong>in</strong>g and spread<strong>in</strong>g with all lifts and lead as<br />

specified and no extra payment shall be made for <strong>the</strong> same. Fur<strong>the</strong>r all excess excavated materials shall be<br />

disposed <strong>of</strong> at km 67.40 on NH-31A on Sevoke Gangtok Road.<br />

33. Retrieved Material: All retrieved materials (esp: stone retrieved from Hard Rock) which are useful <strong>in</strong> <strong>the</strong><br />

construction works shall be used for permanent works and GSB/WMM/DBM/BC works as per <strong>the</strong> directions <strong>of</strong> <strong>the</strong><br />

Eng<strong>in</strong>eer-<strong>in</strong>-Charge/OC Contract. However, contractor can use retrieved materials (esp: stone retrieved from Hard<br />

Rock) only to <strong>the</strong> extent up to <strong>the</strong> total requirement <strong>of</strong> <strong>the</strong> materials required for total scope <strong>of</strong> PMT/<br />

GSB/WMM/DBM/BC works provisioned <strong>in</strong> <strong>the</strong> subject contract. The royalty for <strong>the</strong> same is to be cleared by <strong>the</strong><br />

contractor.<br />

34. Royalties: No quarries on charge <strong>of</strong> department are available. The Contractor shall make his own<br />

arrangements for obta<strong>in</strong><strong>in</strong>g land for quarry<strong>in</strong>g sand/stone & obta<strong>in</strong><strong>in</strong>g o<strong>the</strong>r materials <strong>in</strong>clud<strong>in</strong>g retrieved materials<br />

required for <strong>the</strong> work. Payment <strong>of</strong> royalties <strong>of</strong> such materials is to be borne by <strong>the</strong> Contractor, and his quoted rates<br />

shall be deemed to <strong>in</strong>clude for <strong>the</strong> same. The contractor shall submit a royalty clearance certificates issued by <strong>the</strong><br />

department <strong>of</strong> Forests M<strong>in</strong>erals, Government <strong>of</strong> Sikkim along with <strong>the</strong> RAR(s) /f<strong>in</strong>al bill fail<strong>in</strong>g which, <strong>the</strong> said<br />

amount <strong>of</strong> royalty shall be deducted from <strong>the</strong>ir RAR(s)/f<strong>in</strong>al bill and shall be deposited with state Government.<br />

35 Blast<strong>in</strong>g rocks:<br />

a) The Tenderer must make himself aware about <strong>the</strong> procedure for obta<strong>in</strong><strong>in</strong>g licence for storage <strong>of</strong> explosive<br />

and do<strong>in</strong>g blast<strong>in</strong>g operation. The department does not owe any responsibility if State/Central Govt ceases explosive<br />

and take legal action aga<strong>in</strong>st <strong>the</strong> Tenderer or his staff <strong>in</strong> case <strong>of</strong> non hold<strong>in</strong>g/procession <strong>of</strong> such licence.<br />

(b) The contractor shall be responsible for <strong>the</strong> safe custody and storage <strong>of</strong> blast<strong>in</strong>g materials <strong>in</strong> accordance<br />

with <strong>the</strong> rules on <strong>the</strong> subject. Written authority <strong>of</strong> <strong>the</strong> OC shall be obta<strong>in</strong>ed before any blast<strong>in</strong>g operations are<br />

commenced.<br />

(c ) The contractor shall ensure that <strong>the</strong> charges <strong>in</strong> blast<strong>in</strong>g are not excessive and that <strong>the</strong> charged bore holes<br />

are properly protected before fir<strong>in</strong>g and that proper precautions are taken for <strong>the</strong> safety <strong>of</strong> men and property.<br />

(d) Blast<strong>in</strong>g <strong>in</strong> general must be avoided. In case it is unavoidable only controlled blast<strong>in</strong>g may be resorted<br />

with <strong>the</strong> prior permission <strong>of</strong> <strong>the</strong> Eng<strong>in</strong>eer-<strong>in</strong>-Charge. The contractor shall be bound to abide by <strong>the</strong><br />

<strong>in</strong>structions <strong>of</strong> <strong>the</strong> Officer Command<strong>in</strong>g(OC) regard<strong>in</strong>g <strong>the</strong> necessity <strong>of</strong> blast<strong>in</strong>g and <strong>the</strong> type, number size and<br />

pattern <strong>of</strong> holes to be drilled and also <strong>the</strong> type, amount and method <strong>of</strong> fir<strong>in</strong>g <strong>of</strong> explosive to be used. The OC<br />

shall reserve <strong>the</strong> right to restrict <strong>the</strong> number <strong>of</strong> charge to be fired at a time so that <strong>the</strong> hillside is not adversely<br />

affected. The contractor shall fire <strong>the</strong> charges only at such time as approved by <strong>the</strong> OC and shall have no<br />

claim, whatsoever, on account <strong>of</strong> any delay and extra cost due to carry<strong>in</strong>g out <strong>the</strong> <strong>in</strong>structions <strong>of</strong> <strong>the</strong> OC and/or<br />

tak<strong>in</strong>g <strong>the</strong> safety precautions directed by him.
