54 (e) (f) The decision of the majority of Arbitrators shall be final and binding upon both parties. The cost and expenses of Arbitration proceedings will be paid as determined by the arbitral tribunal. However, the expenses incurred by each party in connection with the preparation, presentation, etc. of its proceedings as also the fees and expenses paid to the arbitrator appointed by such party or on its behalf shall be borne by each party itself. Performance under the contract shall continue during the arbitration proceedings and payments due to the contractor by the owners shall not be withheld, unless they are the subject matter of the arbitration Proceedings. 4. INSPECTION AND PLANTS AND ALLIED MACHINERY: The plant and allied machinery required for execution work of mainly DBM, BC, WMM, etc. shall be inspected/examined by the technical committee constituted by the Ministry vide their letter No. RW/24011/1/2002- Mech dtd. 04.12.01 & 28.02.02, to obtain their clearance before commencement of the work.

ADDITIONAL SPECIAL CONDITIONS 1(A) In addition to definition mentioned in General Condition of Contract under clause 1, following definitions will also be used in this contract:- a) Chief Engineer and Employer are synonymous and have same connotation in respect of this contract. b) Commander is person holding the appointment of Commander 764 BRTF or in his absence, a person officiating as Commander 764 BRTF. The word Commander, Commander Task Force and Commander Work Engineer (CWE) are synonymous of contract and have same connotation in respect of this contract. c) Engineer In Charge is a person appointed by the Engineer to act his authorized representative in terms of clause 5.1 of conditions of Contract and item No. 2 of Contract Data. Engineer In Charge will report to Engineer, will perform the duties and exercise the power to the extent delegated to him by the Engineer and receive instructions from Engineer for day to day performance of his duties. d) Officer Commanding Contract (OC Contract in short) and Engineer are synonymous of contract and have same connotation in respect of this contract. 1(B) In order to ensure submission of the work programme and approval of the same by the department before commencement of the work the following target dates are fixed for the related activities for compliance by all concerned: a) The contractor after receiving the Letter of Acceptance shall furnish the work programme to the Engineer within 14 (fourteen) days from the date of issue of the Letter of Acceptance. b) OC Contract in turn shall forward the same after necessary scrutiny to the Commander for onward transmission to the Chief Engineer within 21 (twenty one) days from the date of issue of Letter of Acceptance. The work program should be based upon MS Project. c) The signing of the contract agreement will be subject to the acceptance of the work programme by the Chief Engineer. d) On matters where decision of Employer is required, Engineer will initiate the case through Commander. 2. The grade of bitumen for the various types of bituminous works course should be as follows a) Dense Bituminous Macadam - Paving Bitumen grade VG 10/ Penetration Grade 80/100 (IS:73) b) Bituminous Concrete - Polymer Modified Bitumen -70 (Electrometric / Plastomeric)/CRMB 55 c) Prime Coat - With bitumen emulsion-CSS-1h(IS-8887-2004) d) Tack Coat - With bitumen emulsion-CSS-1h (IS-8887-2004) 4. The Hot Mix Plant should be set up within a linear distance of 20 to 30 km from the work site, as per IRC SP: 24. 5. The record of quality control test carried out in conformity with the Section No.900 of MORT&H specification for roads & bridges and authenticated by the Engineer - In - Charge shall be submitted to the OC Contract with every works bill and secured advance bill. The following quality control equipments for field laboratory are to be kept at site for quality control tests. A) For Earthwork:- i) Moisture Meter with chemicals ii) Apparatus for measuring Dry density by sand replacement method iii) Apparatus for measuring Dry density by core cutter method iv) Oven,electrically operated and thermostatically controlled upto 200 0 C & 300 0 C (sensitivity1 0 C) v) Electronic balance of 200gm capacity 0.01gm accuracy. vi) Madras Sand
