Trade Unions Act 1926:- The Act lays down <strong>the</strong> procedure for registration <strong>of</strong> trade unions <strong>of</strong><br />

workmen and employers. The Trade Unions registered under <strong>the</strong> Act have been given certa<strong>in</strong><br />

immunities from Civil and crim<strong>in</strong>al liabilities.<br />

Child Labour (Prohibition & Regulation) Act 1986:- The Act prohibits employment <strong>of</strong> children below<br />

14 years <strong>of</strong> age <strong>in</strong> certa<strong>in</strong> occupations and processes and provides for regulation <strong>of</strong> employment <strong>of</strong><br />

children <strong>in</strong> all o<strong>the</strong>r occupations and processes. Employment <strong>of</strong> Child Labour is prohibited <strong>in</strong><br />

Build<strong>in</strong>g and Construction Industry.<br />

(n) Inter-State Migrant Workmen’s (Regulation <strong>of</strong> Employment & Condi t ions <strong>of</strong> Service ) Act 1979<br />

:- The Act is applicable to an establishment which employs 5 or more <strong>in</strong>ter-state migrant workmen<br />

through an <strong>in</strong>termediary (who has recruited workmen <strong>in</strong> one state for employment <strong>in</strong> <strong>the</strong> establishment<br />

situated <strong>in</strong> ano<strong>the</strong>r State). The Inter-State migrant workmen, <strong>in</strong> an establishment to which this Act<br />

becomes applicable, are required to be provided certa<strong>in</strong> facilities such as hous<strong>in</strong>g, medical aid,<br />

travell<strong>in</strong>g expenses from home up to <strong>the</strong> establishment and back, etc.<br />

The Build<strong>in</strong>g and O<strong>the</strong>r Construction Workers (Regulation <strong>of</strong> Employment and Conditions <strong>of</strong><br />

Service) Act 1<strong>99</strong>6 and <strong>the</strong> Cess Act <strong>of</strong> 1<strong>99</strong>6:- All <strong>the</strong> establishments who carry on any build<strong>in</strong>g or<br />

o<strong>the</strong>r construction work and employs 10 or more workers are covered under this Act. All such<br />

establishments are required to pay cess at <strong>the</strong> rate not exceed<strong>in</strong>g 2% <strong>of</strong> <strong>the</strong> cost <strong>of</strong> construction as may<br />

be modified by <strong>the</strong> Government. The Employer <strong>of</strong> <strong>the</strong> establishment is required to provide safety<br />

measures at <strong>the</strong> Build<strong>in</strong>g or Construction work and o<strong>the</strong>r welfare measures, such as Canteens, First-<br />

Aid facilities, Ambulance, hous<strong>in</strong>g accommodation for workers near <strong>the</strong> work place etc. The<br />

Employer to whom <strong>the</strong> Act applies has to obta<strong>in</strong> a registration certificate from <strong>the</strong> Register<strong>in</strong>g Officer<br />

appo<strong>in</strong>ted by <strong>the</strong> Government.<br />

Factories Act 1948:- The Act lays down <strong>the</strong> procedure for approval <strong>of</strong> plans before sett<strong>in</strong>g up a<br />

factory, health and safety provisions, welfare provisions, work<strong>in</strong>g hours, annual earned leave and<br />

render<strong>in</strong>g <strong>in</strong>formation regard<strong>in</strong>g accidents or dangerous occurrence to designated authorities. It is<br />

applicable to premises employ<strong>in</strong>g 10 persons or more with aid <strong>of</strong> power or 20 or more persons<br />

without <strong>the</strong> aid <strong>of</strong> power engaged <strong>in</strong> manufactur<strong>in</strong>g process.<br />

3. ARBITRATION (GCC Clause 25.3)<br />

The procedure for arbitration will be as follows:<br />

25.3 (a) In case <strong>of</strong> Dispute or difference aris<strong>in</strong>g between <strong>the</strong> Employer and a domestic contractor relat<strong>in</strong>g to<br />

any matter aris<strong>in</strong>g out <strong>of</strong> or connected with this Agreement, such dispute or difference shall be settled<br />

<strong>in</strong> accordance with <strong>the</strong> Arbitration and Conciliation Act, 1<strong>99</strong>6. The parties shall make efforts to agree<br />

on a sole arbitrator and only if such an attempt does not succeed and <strong>the</strong> Arbitral Tribunal consist<strong>in</strong>g<br />

<strong>of</strong> 3 arbitrators one each to be appo<strong>in</strong>ted by <strong>the</strong> employer and <strong>the</strong> Contractor and <strong>the</strong> third Arbitrator<br />

to be chosen by <strong>the</strong> two Arbitrators so appo<strong>in</strong>ted by <strong>the</strong> parties to act as Presid<strong>in</strong>g Arbitrator shall be<br />

considered. In case <strong>of</strong> failure <strong>of</strong> <strong>the</strong> two arbitrators appo<strong>in</strong>ted by <strong>the</strong> parties to reach upon a consensus<br />

with<strong>in</strong> a period <strong>of</strong> 30 days from <strong>the</strong> appo<strong>in</strong>tment <strong>of</strong> <strong>the</strong> arbitrator appo<strong>in</strong>ted subsequently, <strong>the</strong><br />

Presid<strong>in</strong>g Arbitrator shall be appo<strong>in</strong>ted by <strong>the</strong> * Council, Indian Roads Congress.<br />

The Arbitral tribunal shall consist <strong>of</strong> three Arbitrators one each to be appo<strong>in</strong>ted by <strong>the</strong> Employer and<br />

<strong>the</strong> Contractor. The third Arbitrator shall be chosen by <strong>the</strong> two Arbitrators so appo<strong>in</strong>ted by <strong>the</strong> Parties,<br />

and shall act a presid<strong>in</strong>g arbitrator. In case <strong>of</strong> failure <strong>of</strong> <strong>the</strong> two arbitrators by <strong>the</strong> parties to reach upon<br />

a consensus with<strong>in</strong> a period <strong>of</strong> 30 days from <strong>the</strong> appo<strong>in</strong>tment <strong>of</strong> <strong>the</strong> arbitrator appo<strong>in</strong>ted consequently,<br />

<strong>the</strong> Presid<strong>in</strong>g arbitrator shall be appo<strong>in</strong>ted by <strong>the</strong> * Council, Indian Roads Congress.<br />

If one <strong>of</strong> <strong>the</strong> parties fails to appo<strong>in</strong>t its arbitrator <strong>in</strong> pursuance <strong>of</strong> sub-clause (a) and (b) above with<strong>in</strong><br />

30 days after receipt <strong>of</strong> <strong>the</strong> notice <strong>of</strong> <strong>the</strong> appo<strong>in</strong>tment <strong>of</strong> its arbitrator by <strong>the</strong> o<strong>the</strong>r party, <strong>the</strong>n <strong>the</strong> *<br />

Council, Indian Roads Congress shall appo<strong>in</strong>t <strong>the</strong> Arbitrator. A certified copy <strong>of</strong> <strong>the</strong> order <strong>of</strong> <strong>the</strong><br />

Council, Indian Roads Congress, mak<strong>in</strong>g such an appo<strong>in</strong>tment shall be furnished to each <strong>of</strong> <strong>the</strong><br />

parties.<br />

Arbitration proceed<strong>in</strong>gs shall be held <strong>in</strong> India, and <strong>the</strong> language <strong>of</strong> <strong>the</strong> arbitration proceed<strong>in</strong>gs and that<br />

<strong>of</strong> all documents and commu<strong>nic</strong>ations between <strong>the</strong> parties shall be English.
