38. Changes <strong>in</strong> <strong>the</strong> Quantities<br />

38.1 If <strong>the</strong> f<strong>in</strong>al quantity <strong>of</strong> <strong>the</strong> work done differs from <strong>the</strong> quantity <strong>in</strong> <strong>the</strong> Bill <strong>of</strong> Quantities for <strong>the</strong> particular item<br />

by more than 25 per cent provided <strong>the</strong> change exceeds 1% <strong>of</strong> <strong>in</strong>itial Contract Price, <strong>the</strong> Eng<strong>in</strong>eer shall adjust <strong>the</strong> rate<br />

to allow for <strong>the</strong> change, duly consider<strong>in</strong>g.<br />

Justification for rate adjustment as furnished by <strong>the</strong> contractor.<br />

Economies result<strong>in</strong>g from <strong>in</strong>crease <strong>in</strong> quantities by way <strong>of</strong> reduced plant, equipment, and overhead<br />

costs,<br />

Entitlement <strong>of</strong> <strong>the</strong> contractor to compensation events where such events are caused by any additional<br />

work.<br />

38.2 The Eng<strong>in</strong>eer shall not adjust rates from changes <strong>in</strong> quantities if <strong>the</strong>reby <strong>the</strong> Initial Contract Price is exceeded<br />

by more than 5 percent, except with <strong>the</strong> Prior approval <strong>of</strong> <strong>the</strong> Employer.<br />

38.3 If requested by <strong>the</strong> Eng<strong>in</strong>eer, <strong>the</strong> Contractor shall provide <strong>the</strong> Eng<strong>in</strong>eer with a detailed cost breakdown <strong>of</strong> any<br />

rate <strong>in</strong> <strong>the</strong> Bill <strong>of</strong> Quantities.<br />

39. Variations<br />

39.1 All Variations shall be <strong>in</strong>cluded <strong>in</strong> updated Programme produced by <strong>the</strong> Contractor.<br />

40. Payments <strong>of</strong> Variations<br />

40.1 The Contractor shall provide <strong>the</strong> Eng<strong>in</strong>eer with a quotation (with breakdown <strong>of</strong> unit rates) for carry<strong>in</strong>g out <strong>the</strong><br />

Variation when requested to do so by <strong>the</strong> Eng<strong>in</strong>eer. The Eng<strong>in</strong>eer shall assess <strong>the</strong> quotation, which shall be given with<br />

seven days or <strong>the</strong> request <strong>of</strong> with<strong>in</strong> any longer period stated by <strong>the</strong> Eng<strong>in</strong>eer and before <strong>the</strong> Variations is ordered.<br />

40.2 If <strong>the</strong> work <strong>in</strong> <strong>the</strong> Variations corresponds with an item description <strong>in</strong> <strong>the</strong> Bill <strong>of</strong> Quantities and if, <strong>in</strong> <strong>the</strong><br />

op<strong>in</strong>ion <strong>of</strong> <strong>the</strong> Eng<strong>in</strong>eer, <strong>the</strong> quantity <strong>of</strong> work above <strong>the</strong> limit stated <strong>in</strong> Sub-Clause 38.1 or <strong>the</strong> tim<strong>in</strong>g <strong>of</strong> its execution<br />

do not cause <strong>the</strong> cost per unit <strong>of</strong> quantity to change, <strong>the</strong> rate <strong>in</strong> <strong>the</strong> Bill <strong>of</strong> Quantities shall be used to calculate <strong>the</strong><br />

value <strong>of</strong> <strong>the</strong> Variation. If <strong>the</strong> cost per unit <strong>of</strong> quantity changes, or if <strong>the</strong> nature or tim<strong>in</strong>g <strong>of</strong> <strong>the</strong> work <strong>in</strong> <strong>the</strong> Variation<br />

does not correspond with items <strong>in</strong> <strong>the</strong> Bill <strong>of</strong> Quantities, <strong>the</strong> quotation by <strong>the</strong> Contractor shall be <strong>in</strong> <strong>the</strong> form <strong>of</strong> new<br />

rates for <strong>the</strong> relevant items <strong>of</strong> work.<br />

40.3 If <strong>the</strong> Contractor’s quotation is unreasonable, <strong>the</strong> Eng<strong>in</strong>eer may order <strong>the</strong> Variations and make a change to <strong>the</strong><br />

Contract Price which shall be based on Eng<strong>in</strong>eer’s own forecast <strong>of</strong> <strong>the</strong> effects <strong>of</strong> <strong>the</strong> Variation on <strong>the</strong> Contract’s costs.<br />

40.4 If <strong>the</strong> Eng<strong>in</strong>eer decides that <strong>the</strong> urgency <strong>of</strong> vary<strong>in</strong>g <strong>the</strong> work would prevent a quotation be<strong>in</strong>g given and<br />

considered without delay<strong>in</strong>g <strong>the</strong> work, no quotation shall be given and <strong>the</strong> Variation shall be treated as a<br />

Compensation Event.<br />

40.5 The Contractor shall not be entitled to additional payment for costs, which could have been avoided by giv<strong>in</strong>g<br />

early warn<strong>in</strong>g.<br />

41. Cash Flow Forecasts<br />

41.1 When <strong>the</strong> Programme is updated, <strong>the</strong> contractor is to provide <strong>the</strong> Eng<strong>in</strong>eer with an updated cash flow<br />

forecast.<br />

42. Payment Certificates<br />

42.1 The contractor shall submit to <strong>the</strong> Eng<strong>in</strong>eer monthly statements <strong>of</strong> <strong>the</strong> estimated value <strong>of</strong> <strong>the</strong> work completed<br />

less <strong>the</strong> cumulative amount certified previously.
