31.2 The Eng<strong>in</strong>eer shall record <strong>the</strong> bus<strong>in</strong>ess <strong>of</strong> management meet<strong>in</strong>gs and is to provide copies <strong>of</strong> his record to those<br />

attend<strong>in</strong>g <strong>the</strong> meet<strong>in</strong>g and to <strong>the</strong> Employer. The responsibility <strong>of</strong> <strong>the</strong> parties for actions to be taken is to be decided by<br />

<strong>the</strong> Eng<strong>in</strong>eer ei<strong>the</strong>r at <strong>the</strong> Management meet<strong>in</strong>g or after <strong>the</strong> management meet<strong>in</strong>g and stated <strong>in</strong> writ<strong>in</strong>g to all who<br />

attended <strong>the</strong> meet<strong>in</strong>g.<br />

32. Early Warn<strong>in</strong>g<br />

32.1 The Contractor is to warn <strong>the</strong> Eng<strong>in</strong>eer at <strong>the</strong> earliest opportunity <strong>of</strong> specific likely future events or<br />

circumstances that may adversely affect <strong>the</strong> quality <strong>of</strong> <strong>the</strong> work <strong>in</strong>crease <strong>the</strong> Contract Price or delay <strong>the</strong> execution <strong>of</strong><br />

works. The Eng<strong>in</strong>eer may require <strong>the</strong> Contractor to provide an estimate <strong>of</strong> <strong>the</strong> expected effect <strong>of</strong> <strong>the</strong> future event or<br />

circumstance on <strong>the</strong> Contract Price and Completion Date. The estimate is to be provided by <strong>the</strong> Contractor as soon as<br />

reasonably possible.<br />

32.2 The Contractor shall cooperate with <strong>the</strong> Eng<strong>in</strong>eer <strong>in</strong> mak<strong>in</strong>g and consider<strong>in</strong>g proposals for how <strong>the</strong> effect <strong>of</strong><br />

such an event or circumstance can be avoided or reduced by anyone <strong>in</strong>volved <strong>in</strong> <strong>the</strong> work and <strong>in</strong> carry<strong>in</strong>g out any<br />

result<strong>in</strong>g <strong>in</strong>struction <strong>of</strong> <strong>the</strong> Eng<strong>in</strong>eer.<br />

33. Identify<strong>in</strong>g Defects<br />

C. QUALITY CONTROL<br />

33.1 The Eng<strong>in</strong>eer shall check <strong>the</strong> Contractor’s work and notify <strong>the</strong> Contractor <strong>of</strong> any defects that are found. Such<br />

check<strong>in</strong>g shall not affect <strong>the</strong> Contractor’s responsibilities. The Eng<strong>in</strong>eer may <strong>in</strong>struct <strong>the</strong> Contractor to search for a<br />

Defect to uncover and test any work that <strong>the</strong> Eng<strong>in</strong>eer considers may have a Defect.<br />

34. Tests<br />

34.1 If <strong>the</strong> Eng<strong>in</strong>eer <strong>in</strong>structs <strong>the</strong> Contractor to carry out a test not specified <strong>in</strong> <strong>the</strong> Specification to check whe<strong>the</strong>r<br />

any work has a Defect and <strong>the</strong> test shows that it does, <strong>the</strong> Contractor shall pay for <strong>the</strong> test and any samples. If <strong>the</strong>re is<br />

no Defect <strong>the</strong> test shall be a Compensation Event.<br />

35. Correction <strong>of</strong> Defects<br />

35.1 The Eng<strong>in</strong>eer shall give notice to <strong>the</strong> Contractor <strong>of</strong> any Defects before <strong>the</strong> end <strong>of</strong> <strong>the</strong> Defects Liability Period,<br />

which beg<strong>in</strong>s at Completion and is def<strong>in</strong>ed <strong>in</strong> <strong>the</strong> Contract Data. The Defects Liability Period shall be extended for as<br />

long as Defects rema<strong>in</strong> to be corrected.<br />

35.2 Every time notice <strong>of</strong> a Defect is given, <strong>the</strong> Contractor shall correct <strong>the</strong> notified Defect with<strong>in</strong> <strong>the</strong> length <strong>of</strong><br />

time specified by <strong>the</strong> Eng<strong>in</strong>eer’s notice.<br />

36. Uncorrected Defects<br />

36.1 If <strong>the</strong> Contractor has not corrected a Defect with<strong>in</strong> <strong>the</strong> time specified <strong>in</strong> <strong>the</strong> Eng<strong>in</strong>eer’s notice, <strong>the</strong> Eng<strong>in</strong>eer<br />

will assess <strong>the</strong> cost <strong>of</strong> hav<strong>in</strong>g <strong>the</strong> Defect corrected, and <strong>the</strong> Contractor will pay this amount.<br />

37. Bill <strong>of</strong> Quantities<br />

D. COST CONTROL<br />

37.1 The Bill <strong>of</strong> Quantities shall conta<strong>in</strong> items for <strong>the</strong> construction, <strong>in</strong>stallations, test<strong>in</strong>g, and commission<strong>in</strong>g work<br />

to be done by <strong>the</strong> Contractor.<br />

37.2 The Bill <strong>of</strong> Quantities is used to calculate <strong>the</strong> Contract Price. The Contractor is paid for <strong>the</strong> quantity <strong>of</strong> <strong>the</strong><br />

work done at <strong>the</strong> rate <strong>in</strong> <strong>the</strong> Bill <strong>of</strong> Quantities for each item.
