5. Delegation.<br />

5.1 The Eng<strong>in</strong>eer may delegate any <strong>of</strong> his duties and responsibilities to o<strong>the</strong>r people except to <strong>the</strong> Adjudicator<br />

after notify<strong>in</strong>g <strong>the</strong> Contract and may cancel any delegation after notify<strong>in</strong>g <strong>the</strong> contractor.<br />

6. Commu<strong>nic</strong>ations.<br />

6.1 Commu<strong>nic</strong>ations between parties which are referred to <strong>in</strong> <strong>the</strong> conditions are effective only when <strong>in</strong> writ<strong>in</strong>g. A<br />

notice shall be effective only when it is delivered (<strong>in</strong> terms <strong>of</strong> Indian Contract Act).<br />

7. Sub-Contract<strong>in</strong>g.<br />

7.1 The Contractor may Sub-Contract any portion <strong>of</strong> work, up to a limit specified <strong>in</strong> Contract Data, with <strong>the</strong><br />

approval <strong>of</strong> <strong>the</strong> Eng<strong>in</strong>eer <strong>in</strong> writ<strong>in</strong>g. Sub-Contract<strong>in</strong>g does not alter <strong>the</strong> Contractor’s obligations.<br />

8. O<strong>the</strong>r Contractors.<br />

8.1 The Contractor shall co-operate and share <strong>the</strong> site with o<strong>the</strong>r contractors, public authorities, utilities and <strong>the</strong><br />

Employer between <strong>the</strong> dates given <strong>in</strong> <strong>the</strong> schedule <strong>of</strong> o<strong>the</strong>r contractors. The Contractor shall as referred to <strong>in</strong> <strong>the</strong><br />

contract data, also provide facilities and services for <strong>the</strong>m as described <strong>in</strong> <strong>the</strong> schedule. The Employer may modify <strong>the</strong><br />

schedule <strong>of</strong> o<strong>the</strong>r contractors and shall notify <strong>the</strong> contractor <strong>of</strong> any such modification.<br />

9. Personnel.<br />

9.1 The Contractor shall employ <strong>the</strong> Key Personnel named <strong>in</strong> <strong>the</strong> Schedule <strong>of</strong> Key Personnel as referred to <strong>in</strong> <strong>the</strong><br />

Contract Data to carry out <strong>the</strong> function stated <strong>in</strong> <strong>the</strong> schedule or o<strong>the</strong>r personnel approved by <strong>the</strong> Eng<strong>in</strong>eer. The<br />

Eng<strong>in</strong>eer will approve any proposed replacement <strong>of</strong> Key Personnel only if <strong>the</strong>ir Qualifications, Abilities and Relevant<br />

Experience are substantially equal to or better than those <strong>of</strong> <strong>the</strong> personnel listed <strong>in</strong> <strong>the</strong> schedule.<br />

The names <strong>of</strong> <strong>the</strong> Key personnel present at <strong>the</strong> site <strong>of</strong> work are to be recorded <strong>in</strong> <strong>the</strong> certificate <strong>of</strong> Bill <strong>of</strong><br />

MB‟ s while prepar<strong>in</strong>g and pass<strong>in</strong>g runn<strong>in</strong>g/f<strong>in</strong>al bills. In <strong>the</strong> event <strong>of</strong> absence/non deployment <strong>of</strong> Key personnel<br />

dur<strong>in</strong>g <strong>the</strong> contract period <strong>the</strong> amount stated at Annexure-I <strong>of</strong> Condition <strong>of</strong> Contract are to be deducted per month on<br />

Pro-Rata Basic from <strong>the</strong> contractor’s bill(s).<br />

9.2 If <strong>the</strong> Eng<strong>in</strong>eer ask <strong>the</strong> Contractor to remove a person who is a member <strong>of</strong> <strong>the</strong> contractor’s staff or his work<br />

force stat<strong>in</strong>g <strong>the</strong> reasons <strong>the</strong> contractor shall ensure that <strong>the</strong> person leaves <strong>the</strong> site with<strong>in</strong> 7 days and has no fur<strong>the</strong>r<br />

connection with work <strong>in</strong> <strong>the</strong> contract.<br />

10. Employer‟s and Contractor‟s Risks.<br />

10.1 The Employer carries <strong>the</strong> risks which this contract states are Employer’s risks and <strong>the</strong> Contractor carries <strong>the</strong><br />

risks which this contract states are contractor’s risks.<br />

11. Employer‟s Risks.<br />

11.1 The Employer is responsible for <strong>the</strong> excepted risks which are (a) <strong>in</strong> so far as <strong>the</strong>y directly affect <strong>the</strong> execution<br />

<strong>of</strong> <strong>the</strong> works <strong>in</strong> India, <strong>the</strong> risks <strong>of</strong> War, hostilities, <strong>in</strong>vasion, act <strong>of</strong> foreign enemies, rebellion, revolution, <strong>in</strong>surrection<br />

or military or usurped power, civil work, riot commotion or disorder (unless restricted to <strong>the</strong> contractor’s employees)<br />

and contam<strong>in</strong>ation from any nuclear fuel or nuclear waste or radioactive toxic explosive or (b) a cause due solely to<br />

<strong>the</strong> design <strong>of</strong> <strong>the</strong> works, o<strong>the</strong>r than <strong>the</strong> contractor’s design.<br />

12. Contractor‟s Risks<br />

12.1 All risks <strong>of</strong> loss <strong>of</strong> or damage to physical property and <strong>of</strong> personnel <strong>in</strong>jury and death which arise dur<strong>in</strong>g and <strong>in</strong><br />

consequence <strong>of</strong> <strong>the</strong> performance <strong>of</strong> <strong>the</strong> contract o<strong>the</strong>r than <strong>the</strong> expected risks are <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> contractor.
