The Site is <strong>the</strong> area def<strong>in</strong>ed as such <strong>in</strong> <strong>the</strong> Contract Data.<br />

Site Investigation Reports are those, which were <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> bidd<strong>in</strong>g documents and are factual<br />

<strong>in</strong>terpretative reports about <strong>the</strong> surface and sub-surface conditions at <strong>the</strong> site.<br />

Specification means <strong>the</strong> specifications <strong>of</strong> <strong>the</strong> works <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> contract and any modification or addition<br />

made or approved by <strong>the</strong> Eng<strong>in</strong>eer.<br />

The Start Date is given <strong>in</strong> <strong>the</strong> Contract data. It is <strong>the</strong> date when <strong>the</strong> contractor shall commence execution <strong>of</strong><br />

<strong>the</strong> works. It does not necessarily co<strong>in</strong>cide with any <strong>of</strong> <strong>the</strong> Site Possession Dates.<br />

A Sub-Contractor is a person or corporate body who has a contract with <strong>the</strong> Contractor to carry out a part<br />

work <strong>in</strong> <strong>the</strong> contract, which <strong>in</strong>cludes work on <strong>the</strong> site.<br />

Temporary works are works designed, constructed, <strong>in</strong>stalled, and removed by <strong>the</strong> Contractor, which are<br />

needed for construction or <strong>in</strong>stallation <strong>of</strong> <strong>the</strong> works.<br />

A Variation is an <strong>in</strong>struction given by <strong>the</strong> Eng<strong>in</strong>eer, which varies <strong>the</strong> works.<br />

The Works are what <strong>the</strong> contract requires <strong>the</strong> contractor to construct, <strong>in</strong>stall, and turn over to <strong>the</strong> Employer,<br />

as def<strong>in</strong>ed <strong>in</strong> <strong>the</strong> contract data.<br />

2. Interpretation.<br />

2.1 In <strong>in</strong>terpret<strong>in</strong>g <strong>the</strong>se conditions <strong>of</strong> contract, s<strong>in</strong>gular also means plurals, male also means female or neuter, and<br />

<strong>the</strong> o<strong>the</strong>r way around. Head<strong>in</strong>gs have no significance. Words have <strong>the</strong>ir normal mean<strong>in</strong>g under <strong>the</strong> language <strong>of</strong> <strong>the</strong><br />

contract unless specially def<strong>in</strong>ed. The Eng<strong>in</strong>eer will provide <strong>in</strong>structions clarify<strong>in</strong>g queries about <strong>the</strong> conditions <strong>of</strong> <strong>the</strong><br />

contract.<br />

2.2 If sectional completion is specified <strong>in</strong> <strong>the</strong> Contract Data, references <strong>in</strong> <strong>the</strong> conditions <strong>of</strong> contract to <strong>the</strong> works,<br />

<strong>the</strong> completion date, and <strong>the</strong> <strong>in</strong>tended completion date apply to any section <strong>of</strong> <strong>the</strong> works (o<strong>the</strong>r than references to <strong>the</strong><br />

completion date and <strong>in</strong>tended completion date for <strong>the</strong> whole <strong>of</strong> <strong>the</strong> works).<br />

2.3 The documents form<strong>in</strong>g <strong>the</strong> Contract shall be <strong>in</strong>terpreted <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g order <strong>of</strong> priority:<br />

(1) Agreement<br />

(2) Letter <strong>of</strong> Acceptance, notice to proceed with <strong>the</strong> works<br />

(3) Contractor’s Bid<br />

(4) Contract Data<br />

(5) Additional special conditions <strong>of</strong> contract, special condition <strong>of</strong> contract and General Conditions <strong>of</strong><br />

Contract (to be <strong>in</strong>terpreted <strong>in</strong> <strong>the</strong> same order <strong>of</strong> priority as listed here)<br />

(6) Specifications<br />

(7) Bill <strong>of</strong> Quantities and<br />

(8) Any o<strong>the</strong>r document listed <strong>in</strong> <strong>the</strong> Contract Data as form<strong>in</strong>g part <strong>of</strong> <strong>the</strong> Contract<br />

3. Languages and Law.<br />

3.1 The language <strong>of</strong> <strong>the</strong> Contract and <strong>the</strong> law govern<strong>in</strong>g <strong>the</strong> Contract are stated <strong>in</strong> <strong>the</strong> Contract Data.<br />

4. Eng<strong>in</strong>eer‟s Decisions.<br />

4.1 Except where o<strong>the</strong>rwise specifically stated, <strong>the</strong> Eng<strong>in</strong>eer will decide contractual matters between <strong>the</strong><br />

Employer and <strong>the</strong> Contractor <strong>in</strong> role represent<strong>in</strong>g <strong>the</strong> Employer.
