29. Evaluation and Comparison <strong>of</strong> F<strong>in</strong>ancial Bids.<br />

29.1 The Employer will evaluate and compare only <strong>the</strong> Bids determ<strong>in</strong>ed to be substantially responsive <strong>in</strong><br />

accordance with Sub-Clause 26.2.<br />

29.2 In evaluat<strong>in</strong>g <strong>the</strong> Bids, <strong>the</strong> Employer will determ<strong>in</strong>e for each Bid <strong>the</strong> evaluated Bid price by adjust<strong>in</strong>g <strong>the</strong> Bid<br />

price as follows:<br />

(a)<br />

(b)<br />

(c)<br />

Mak<strong>in</strong>g any correction for errors pursuant to Clause 27; or<br />

Mak<strong>in</strong>g an appropriate adjustment for any o<strong>the</strong>r acceptable variations, deviation; and<br />

Mak<strong>in</strong>g appropriate adjustments to reflect discounts or o<strong>the</strong>r price modifications <strong>of</strong>fered <strong>in</strong><br />

accordance with Sub-Clause 23.6.<br />

29.3 The Employer reserves <strong>the</strong> right to accept or reject any variation or deviation. Variations and deviations and<br />

o<strong>the</strong>r factors, which are <strong>in</strong> excess <strong>of</strong> requirements <strong>of</strong> <strong>the</strong> Bidd<strong>in</strong>g documents or o<strong>the</strong>rwise result <strong>in</strong> unsolicited<br />

benefits for <strong>the</strong> Employer shall not be taken <strong>in</strong>to account <strong>in</strong> Bid evaluation.<br />

29.4 The estimated effect <strong>of</strong> <strong>the</strong> price adjustment conditions under Clause 47 <strong>of</strong> <strong>the</strong> Conditions <strong>of</strong> Contract, dur<strong>in</strong>g<br />

<strong>the</strong> period <strong>of</strong> implementation <strong>of</strong> <strong>the</strong> contract, will not be taken <strong>in</strong>to account <strong>in</strong> Bid evaluation.<br />

29.5 If <strong>the</strong> Bid <strong>of</strong> <strong>the</strong> successful Bidder is seriously unbalanced <strong>in</strong> relation to <strong>the</strong> Eng<strong>in</strong>eer’s estimate <strong>of</strong> <strong>the</strong> cost <strong>of</strong><br />

work to be performed under contract, <strong>the</strong> Employer may require <strong>the</strong> bidder to produce detailed price analysis<br />

for any or all items <strong>of</strong> <strong>the</strong> Bill <strong>of</strong> Quantities, to demonstrate <strong>the</strong> <strong>in</strong>ternal consistency <strong>of</strong> those prices with <strong>the</strong><br />

construction methods and schedule proposed. After evaluation <strong>of</strong> <strong>the</strong> price analysis, <strong>the</strong> Employer may require<br />

that amount <strong>of</strong> <strong>the</strong> performance security set forth <strong>in</strong> Clause 34 be <strong>in</strong>creased at <strong>the</strong> expense <strong>of</strong> <strong>the</strong> successful<br />

Bidder to a level sufficient to protect <strong>the</strong> Employer aga<strong>in</strong>st f<strong>in</strong>ancial loss <strong>in</strong> <strong>the</strong> event <strong>of</strong> default <strong>of</strong> <strong>the</strong><br />

successful Bidder under <strong>the</strong> Contract.<br />

29.6 A Bid, which conta<strong>in</strong>s several items <strong>in</strong> <strong>the</strong> Bill <strong>of</strong> Quantities which are unrealistically priced low and which<br />

cannot be substantiated satisfactorily by <strong>the</strong> Bidder, may be rejected as non-responsive.<br />
