25. Clarification <strong>of</strong> F<strong>in</strong>ancial Bids<br />

25.1 To assist <strong>in</strong> <strong>the</strong> exam<strong>in</strong>ation, evaluation and comparison <strong>of</strong> Bids, <strong>the</strong> Employer may, at his discretion, ask any<br />

Bidder for clarification <strong>of</strong> his Bid, <strong>in</strong>clud<strong>in</strong>g breakdown <strong>of</strong> unit rates. The request for clarification and <strong>the</strong><br />

response shall be <strong>in</strong> writ<strong>in</strong>g or by cable, but no change <strong>in</strong> <strong>the</strong> price <strong>of</strong> substance <strong>of</strong> <strong>the</strong> Bid shall be sought,<br />

<strong>of</strong>fered or permitted except as required to confirm <strong>the</strong> correction <strong>of</strong> arithmetic errors discovered by <strong>the</strong><br />

Employer <strong>in</strong> <strong>the</strong> evaluation <strong>of</strong> <strong>the</strong> Bids <strong>in</strong> accordance with Clause 27.<br />

25.2 Subject to sub-clause 25.1, no Bidder shall contact <strong>the</strong> Employer on any matter relat<strong>in</strong>g to his bid from <strong>the</strong><br />

time <strong>of</strong> <strong>the</strong> bid open<strong>in</strong>g to <strong>the</strong> time <strong>of</strong> <strong>the</strong> contract is awarded. If <strong>the</strong> Bidder wishes to br<strong>in</strong>g additional<br />

<strong>in</strong>formation to <strong>the</strong> notice <strong>of</strong> <strong>the</strong> Employer, it should be do so <strong>in</strong> writ<strong>in</strong>g.<br />

25.3 Any effort by <strong>the</strong> Bidder to <strong>in</strong>fluence <strong>the</strong> Employer <strong>in</strong> <strong>the</strong> Employer’s Bid evaluation, bid comparison or<br />

contract award decisions may result <strong>in</strong> <strong>the</strong> rejection <strong>of</strong> <strong>the</strong> Bidder’s bid.<br />

26. Exam<strong>in</strong>ation <strong>of</strong> Bids and Determ<strong>in</strong>ation <strong>of</strong> Responsiveness<br />

26.1 Dur<strong>in</strong>g <strong>the</strong> detailed evaluation <strong>of</strong> “Tech<strong>nic</strong>al Bids”, <strong>the</strong> Employer will determ<strong>in</strong>e whe<strong>the</strong>r each Bid (a) meets<br />

<strong>the</strong> eligibility criteria def<strong>in</strong>ed <strong>in</strong> Clause 3 and 4, (b) has been properly signed; (c) is accompanied by <strong>the</strong><br />

required securities and (d) substantially responsive to <strong>the</strong> requirement <strong>of</strong> <strong>the</strong> Bidd<strong>in</strong>g documents. Dur<strong>in</strong>g <strong>the</strong><br />

detailed evaluation <strong>of</strong> <strong>the</strong> “F<strong>in</strong>ancial Bid”, <strong>the</strong> responsiveness <strong>of</strong> <strong>the</strong> bids will be fur<strong>the</strong>r determ<strong>in</strong>ed with<br />

respect to <strong>the</strong> rema<strong>in</strong><strong>in</strong>g bid conditions i.e., priced Bill <strong>of</strong> Quantities, Tech<strong>nic</strong>al specifications, and Draw<strong>in</strong>gs.<br />

26.2 A substantially responsive “F<strong>in</strong>ancial Bid” is one which conforms to all <strong>the</strong> terms, conditions, and<br />

specifications <strong>of</strong> <strong>the</strong> Bidd<strong>in</strong>g documents, without material deviation or reservation. A material deviation is<br />

one (a) which affects <strong>in</strong> any substantial way <strong>the</strong> scope, quality, or performance <strong>of</strong> <strong>the</strong> works; (b) which limits<br />

<strong>in</strong> any substantial way, <strong>in</strong> consistent with <strong>the</strong> bidd<strong>in</strong>g documents, <strong>the</strong> Employer’s rights or <strong>the</strong> bidder’s<br />

obligations under <strong>the</strong> contract; or (c) whose rectification would affect unfairly <strong>the</strong> competitive position <strong>of</strong><br />

o<strong>the</strong>r Bidders present<strong>in</strong>g substantially responsive Bids.<br />

26.3 If a “F<strong>in</strong>ancial Bid” is not substantially responsive, it will be rejected by <strong>the</strong> Employer, and may not<br />

subsequently be made responsive by correction or withdrawal <strong>of</strong> <strong>the</strong> non-conform<strong>in</strong>g deviation or reservation.<br />

27. Correction <strong>of</strong> Errors<br />

27.1 “F<strong>in</strong>ancial Bids” determ<strong>in</strong>ed to be substantially responsive will be checked by <strong>the</strong> Employer for any<br />

arithmetic errors. Errors will be corrected by <strong>the</strong> Employer as follows:<br />

(a)<br />

(b)<br />

where <strong>the</strong>re is discrepancy between <strong>the</strong> rates <strong>in</strong> figures and <strong>in</strong> words, <strong>the</strong> rate <strong>in</strong> words will govern;<br />

and<br />

where <strong>the</strong>re is discrepancy between <strong>the</strong> unit rate and <strong>the</strong> l<strong>in</strong>e item total result<strong>in</strong>g from multiply<strong>in</strong>g <strong>the</strong><br />

unit rate by <strong>the</strong> quantity, <strong>the</strong> unit rate as quoted will govern.<br />

27.2 The amount stated <strong>in</strong> <strong>the</strong> “F<strong>in</strong>ancial Bid” will be corrected by <strong>the</strong> Employer <strong>in</strong> accordance with <strong>the</strong> above<br />

procedure and <strong>the</strong> Bid amount adjusted with <strong>the</strong> concurrence <strong>of</strong> <strong>the</strong> Bidder <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g manner.<br />

If <strong>the</strong> Bid price <strong>in</strong>creases as a result <strong>the</strong>se corrections, <strong>the</strong> amount as stated <strong>in</strong> <strong>the</strong> bid will be <strong>the</strong> “Bid<br />

Price” and <strong>the</strong> <strong>in</strong>crease will be treated as rebate;<br />

If <strong>the</strong> Bid price decreases as a result <strong>of</strong> <strong>the</strong> corrections, <strong>the</strong> decreased amount will be treated as “bid<br />

price”.<br />

Such adjusted bid price shall be considered as b<strong>in</strong>d<strong>in</strong>g upon <strong>the</strong> Bidder. If <strong>the</strong> Bidder does not accept <strong>the</strong><br />

corrected amount <strong>the</strong> Bid will be rejected, and <strong>the</strong> Bid security may be forfeited <strong>in</strong> accordance with Sub-<br />

Clause 16.6 (b).
