a. Must be at least 5% of the ABC with the phrase “callable upon<br />

demand” indicated in the surety bond;<br />

b. Issued by a bonding company duly accredited/authorized by the<br />

Insurance Commission (Certificate of Authority); and<br />

c. A certification from the Insurance Commission unequivocally<br />

stating that the surety or insurance company is authorized to<br />

issue surety bond “callable upon demand”. (Reference: GPPB<br />

NPM No. 13-2010 and NPM 024-2010) (BDS Form 2).<br />

18.2 The bid security shall be valid one hundred twenty (120) calendar days<br />

from the bid opening.<br />

19 Bidders shall submit the first and second envelope in three (3) copies each<br />

(Copy 1, Copy 2 and Copy 3).<br />

COPY 1 - Bidders may submit either the following:<br />

a. Original documents; or,<br />

b. Photocopies of the original duly authenticated by the issuing<br />

agency/entity.<br />

Absence of authentication by the issuing agency/entity on any page of the<br />

photocopies of the original documents submitted, or submission of<br />

photocopies of authenticated copies of the documents shall be considered<br />

as non-compliance under this clause and shall be a ground for<br />

disqualification.<br />

COPY 2 and COPY 3 - Bidders shall submit photocopies of the original<br />

or photocopies of the authenticated documents provided it is originally<br />

signed by the bidder/ representative on each and every page. However,<br />

bidders are not precluded from submitting original documents, or<br />

photocopies of the original duly authenticated by the issuing agency/entity.<br />

Absence of the signature of the bidder/representative on any page of the<br />

photocopies of the original or authenticated documents submitted shall be a<br />

ground for disqualification.<br />

The foregoing documents shall comply with the required formalities as<br />

provided under Clause 5.2 and 11 of BDS.<br />

20.3 Packaging of Folders/Envelopes: All sets of documents/folders submitted<br />

must be:<br />

(1) Arranged according to the sequence by which the same are<br />

listed in the Bidding Documents;<br />

(2) Contain a Table of Contents listing down the different<br />

documents submitted which shall serve as cover for every set of<br />

documents/folders; and<br />

(3) Tabbed to easily identify/locate each type of document. One<br />
