For Class “A” and “B” eligibility documents, as mentioned under Section 23 of the Revised IRR and as enumerated under Clause 12.1 of the ITB which are in other foreign language, their translation in English must be CERTIFIED by the appropriate foreign embassy or consulate here in the Philippines. In case the concerned foreign embassy or consulate here in the Philippines does not issue the required certification, the bidder shall submit a certification issued by the concerned foreign embassy or consulate stating that they are not issuing the said documents. 12.1(a) All documents mentioned under Section 23. 1 of the Revised IRR and Clause 12.1 of the ITB shall be included in the first envelope and shall be submitted by the bidders not later than the scheduled bid opening. For legal requirements under Class “A” documents, the following shall be submitted: a. DTI/SEC/CDA Registration or, in case of foreign bidders, any equivalent document. b. Mayor’s permit issued by the city or municipality where the principal place of business of the bidder is located; or, any equivalent document in case of foreign bidders and bidders with business address located within the Special Economic Zone. Equivalent documents aforementioned shall be subject to final determination as to their admissibility by the BAC upon recommendation of the TWG during the post-qualification. The foregoing documents shall comply with the required formalities as provided under Clauses 5.2, 11 and 19 of the BDS. 12.1(a)(i) 12.1(a)(iii) 12.1.a.iv No other acceptable proof of registration is recognized. Bidders shall submit a statement of all its ongoing and completed government and private contracts, including contracts awarded but not yet started, if any, within the period of five (5) years from the date of submission and receipt of bid. income tax return shall also be received in the same manner as above, but for the attached financial statements the same shall be stamped received only on the page of the Audit Certificate, the Balance Sheet and the Income Statement. Accordingly, the other pages of the financial statements and its attachments need not anymore be stamped received.” [Emphasis ours.] Revenue Memorandum Circular No. 33-2010: “In certifying photocopies of the ITRs and the AFS, the BIR officer shall stamp the words “Certified True Copy” and affix his/her signature on each and every page of the photocopied ITR and AFS.” [Emphasis ours.] 13.1 The second envelop shall contain documents mentioned in Clause 13 of the ITB. The said documents shall comply with the required formalities as provided under Clause 5.2 and Clause 11 of the BDS.
