RULES AND REGULATIONS<br />

OF<br />

THE GRAND BELLAGIO AT BAYWATCH CONDOMINIUM<br />

1. Hallways, entrances, breezeways, sidewalks, stairways, <strong>and</strong> o<strong>the</strong>r common areas shall not be<br />

obstructed in any way or used for any purpose except as access to <strong>and</strong> from Units. Storage <strong>of</strong> any items<br />

in <strong>the</strong>se areas are a potential fire or building code viol<strong>at</strong>ion <strong>and</strong> is not permitted.<br />

2. Unit Owners, tenants, guests, or invitees shall not leave bicycles, strollers, toys, wagons,<br />

shopping carts, old furniture, clothing, brooms, mops, garbage cans, wood, newspapers, plants, planters,<br />

or any o<strong>the</strong>r item in <strong>the</strong> hallways, entrances, breezeways, sidewalks, stairways, or o<strong>the</strong>r common areas<br />

even for a short period <strong>of</strong> time.<br />

3. Nothing o<strong>the</strong>r than balcony-type furniture <strong>and</strong> plants may be kept on p<strong>at</strong>ios, balconies,<br />

<strong>at</strong>riums, terraces <strong>and</strong> ro<strong>of</strong> decks.<br />

4. No linens, cloths, clothing, curtains, rugs, mops, or laundry <strong>of</strong> any kind, or o<strong>the</strong>r articles,<br />

shall be shaken or hung from any <strong>of</strong> <strong>the</strong> windows, doors or balconies, terraces, ro<strong>of</strong> decks, p<strong>at</strong>ios or <strong>the</strong><br />

like.<br />

5. If Unit Owners, tenants, guests, or invitees leave any items in <strong>the</strong> hallways, entrances,<br />

breezeways, sidewalks, stairways, or o<strong>the</strong>r common areas, <strong>the</strong> Associ<strong>at</strong>ion may remove <strong>the</strong> same <strong>and</strong><br />

store <strong>the</strong>m <strong>at</strong> <strong>the</strong> Unit Owner’s expense. Repe<strong>at</strong>ed or serious viol<strong>at</strong>ions may result in a fine.<br />

6. No sign, advertisement, notice or o<strong>the</strong>r lettering shall be exhibited, inscribed, painted or<br />

affixed on <strong>the</strong> outside <strong>of</strong> a Condominium Unit or Building or on any part <strong>of</strong> <strong>the</strong> Common Elements<br />

without prior written consent <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion. Additionally, no awning, canopy, screens, shutter or<br />

o<strong>the</strong>r projection shall be <strong>at</strong>tached to or placed upon <strong>the</strong> outside walls or ro<strong>of</strong> <strong>of</strong> <strong>the</strong> building unless<br />

approved by <strong>the</strong> Associ<strong>at</strong>ion. Notwithst<strong>and</strong>ing <strong>the</strong> foregoing, <strong>the</strong> Developer may place signs or o<strong>the</strong>r<br />

displays or advertising on any part <strong>of</strong> <strong>the</strong> Common Elements, <strong>the</strong> outside <strong>of</strong> <strong>the</strong> building <strong>and</strong> <strong>the</strong> ro<strong>of</strong>.<br />

7. Nei<strong>the</strong>r <strong>the</strong> exterior <strong>of</strong> <strong>the</strong> Condominium Units, including all appurtenances, nor any part <strong>of</strong><br />

<strong>the</strong> Common Elements shall be painted, decor<strong>at</strong>ed or modified by any Condominium Unit Owner or<br />

resident without <strong>the</strong> prior written consent <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion, which consent may be withheld on purely<br />

aes<strong>the</strong>tic grounds within <strong>the</strong> sole discretion <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion.<br />

8. A Unit Owner shall not cause anything to be affixed or <strong>at</strong>tached to, hung, displayed or placed<br />

on <strong>the</strong> exterior walls, doors, balconies or windows <strong>of</strong> <strong>the</strong> building, nor shall such Unit Owner screen or<br />

o<strong>the</strong>rwise enclose his connecting balcony, <strong>at</strong>rium, terrace or ro<strong>of</strong> deck without <strong>the</strong> consent <strong>of</strong> <strong>the</strong><br />

Associ<strong>at</strong>ion. Curtains <strong>and</strong> drapes (or linings <strong>the</strong>re<strong>of</strong>) blinds, shutters, shades or o<strong>the</strong>r window covering<br />

which face on exterior windows or glass doors <strong>of</strong> Units shall be white or <strong>of</strong>f-white in color.<br />

9. The exterior portions <strong>of</strong> all doors which face Common Elements shall be uniform in<br />

appearance <strong>and</strong> color <strong>and</strong> all exterior hardware shall be identical. No screen, glass or storm doors may be<br />

installed without <strong>the</strong> prior written consent <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion, which consent may be arbitrarily denied.<br />

10. No doorm<strong>at</strong>s may be placed in <strong>the</strong> hallways or corridors <strong>and</strong> no ornaments or decor<strong>at</strong>ions<br />

may be hung on <strong>the</strong> walls <strong>of</strong> <strong>the</strong> hallways <strong>and</strong> corridors.<br />

11. No Unit Owner may install or permit to be installed any window air conditioning unit in his<br />

Unit or in <strong>the</strong> Common Elements.<br />

12. No radio or television install<strong>at</strong>ion may be permitted in a Unit which interferes with <strong>the</strong><br />

television or radio reception <strong>of</strong> ano<strong>the</strong>r Unit. No antenna or s<strong>at</strong>ellite dish may be erected or installed by a<br />

Unit Owner on <strong>the</strong> ro<strong>of</strong> or exterior walls <strong>of</strong> <strong>the</strong> building <strong>and</strong>, if same is erected or installed, it may be<br />

removed, without notice, by <strong>the</strong> Associ<strong>at</strong>ion <strong>at</strong> <strong>the</strong> cost <strong>of</strong> <strong>the</strong> Unit Owner who installed such antennae or<br />

s<strong>at</strong>ellite dish. Citizens b<strong>and</strong> <strong>and</strong> ham radio install<strong>at</strong>ions are strictly prohibited.<br />

13. All doors leading from <strong>the</strong> Condominium Unit to Common Elements shall be closed <strong>at</strong> all<br />

times except when in actual use for ingress <strong>and</strong> egress.<br />

14. Priv<strong>at</strong>e storage units are available for sale. Please see <strong>the</strong> property manager for availability.<br />

Storage <strong>of</strong> any personal property in any area except design<strong>at</strong>ed storage areas sold to your Unit is<br />

prohibited. Any personal property left in parking areas, on walkways, stairways, common breezeways or<br />

any area <strong>of</strong> <strong>the</strong> property not expressly design<strong>at</strong>ed for storage will be removed <strong>and</strong> discarded. Fur<strong>the</strong>r, <strong>the</strong><br />

owner/management assumes no responsibility or liability for items stored.<br />

15. Bicycles must be stored in storage areas or inside <strong>the</strong> Unit not left in breezeways, walkways,<br />

p<strong>at</strong>ios, lawns, sidewalks or in <strong>the</strong> street. Sk<strong>at</strong>eboarding through <strong>the</strong> property is prohibited.<br />

16. No door-to-door soliciting, including soliciting by Unit Owners, tenants, guests, or<br />

invitees is permitted within <strong>the</strong> Condominium. Unit Owners must notify <strong>the</strong> Associ<strong>at</strong>ion immedi<strong>at</strong>ely<br />

if <strong>the</strong>y see anyone soliciting door-to-door within <strong>the</strong> Condominium.<br />

17. All Unit Owners, tenants, guests or invitees must observe <strong>the</strong> following <strong>rules</strong> between 10:00<br />

p.m. <strong>and</strong> 9:00 a.m.:<br />

a. Unit Owners, tenants, guests <strong>and</strong> invitees shall not make or permit any disturbing noises,<br />

which, <strong>at</strong> <strong>the</strong> sole discretion <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion, unreasonably interfere with <strong>the</strong> rights,<br />

comforts, or convenience <strong>of</strong> o<strong>the</strong>r Unit Owners<br />

b. Unit Owners, tenants, guests <strong>and</strong> invitees shall keep <strong>the</strong> volume <strong>of</strong> any radio,<br />

television, stereo, or musical instrument in <strong>the</strong>ir apartments sufficiently low <strong>at</strong> all<br />

times so as not to disturb o<strong>the</strong>r Unit Owners. The volume <strong>of</strong> noise th<strong>at</strong> constitutes a<br />

viol<strong>at</strong>ion <strong>of</strong> this rule shall be left <strong>at</strong> <strong>the</strong> sole discretion <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion.<br />

c. Unit Owners, tenants, guests <strong>and</strong> invitees shall not place stereo speakers directly on <strong>the</strong><br />

floor. Residents may place speakers on blocks or st<strong>and</strong>s <strong>at</strong> least 2 inches above <strong>the</strong><br />

floor <strong>and</strong> 1 inch from <strong>the</strong> walls.<br />

d. Unit Owners, tenants, guests <strong>and</strong> invitees may not conduct any vocal or instrumental<br />

instruction in <strong>the</strong>ir Units; however, this does not prohibit taking vocal or instrumental<br />

lessons in <strong>the</strong> Units for no more than one hour a day <strong>and</strong> such lessons must end no<br />

l<strong>at</strong>er 9:00 p.m.<br />

e. Any viol<strong>at</strong>ion <strong>of</strong> <strong>the</strong>se noise <strong>rules</strong> <strong>and</strong> o<strong>the</strong>r Resident's right <strong>of</strong> quiet enjoyment,<br />

including repe<strong>at</strong>ed minor viol<strong>at</strong>ions <strong>of</strong> <strong>the</strong>se <strong>rules</strong>, is a direct viol<strong>at</strong>ion <strong>of</strong> your lease<br />

<strong>and</strong> may result in a fine.<br />

18. All garbage <strong>and</strong> refuse are to be deposited only in <strong>the</strong> facilities provided for th<strong>at</strong> purpose.<br />

19. There shall not be kept in any Condominium Unit or in any storage facility any inflammable,<br />

combustible or explosive fluid, m<strong>at</strong>erial, chemical or substance, except for normal household use. The<br />

Associ<strong>at</strong>ion will not be responsible for loss <strong>of</strong> or damage to any property in <strong>the</strong> storage rooms.<br />

20. Pets are allowed in <strong>the</strong> Condominium; provided, however, th<strong>at</strong> it is clearly understood th<strong>at</strong><br />

<strong>the</strong> keeping <strong>of</strong> a pet <strong>at</strong> <strong>the</strong> Condominium is a conditional license subject to revoc<strong>at</strong>ion. Lessees, tenants<br />

or guests are permitted to keep pets only in accordance with <strong>the</strong>se <strong>rules</strong>. The maintaining <strong>of</strong> a pet in <strong>the</strong><br />

Condominium is subject to <strong>the</strong> following st<strong>and</strong>ards <strong>and</strong> guidelines:<br />

a. There shall be no more than two (2) household pets Pets must be registered with <strong>the</strong><br />

Associ<strong>at</strong>ion.<br />

b. The following breeds <strong>of</strong> dogs are not permitted Pit Bulls, Rottweilers, German<br />

Shepherds, Huskies, Alaskan Malamutes, Doberman Pinchers, Chows, Gre<strong>at</strong> Danes,<br />

Saint Bernards, Akitas <strong>and</strong> Dalm<strong>at</strong>ians. O<strong>the</strong>r than dogs, household pets are restricted to<br />

fifteen (15) pounds.<br />

c. Pets shall not in any way disturb any o<strong>the</strong>r Condominium Unit Owners <strong>and</strong> shall be kept<br />

on leashes <strong>of</strong> no more than six (6) feet long <strong>at</strong> all times or h<strong>and</strong> carried through <strong>the</strong><br />

Common Elements <strong>of</strong> <strong>the</strong> Condominium Property. Pets must be with <strong>the</strong>ir owners <strong>at</strong> all<br />

times.<br />

d. Pets are not allowed in <strong>the</strong> pool area, clubhouse, or o<strong>the</strong>r recre<strong>at</strong>ional areas.<br />

e. There shall be no breeding or maintenance <strong>of</strong> household pets for commercial purposes.<br />

f. Fish or caged domestic (household-type) birds may be kept in Units subject to <strong>the</strong>se<br />

Rules <strong>and</strong> Regul<strong>at</strong>ions, <strong>and</strong> no reptiles or wildlife may be kept in or about <strong>the</strong><br />

Condominium Property.<br />

g. No pet shall be allowed on a balcony or terrace <strong>of</strong> a Unit when <strong>the</strong> Unit is not occupied.<br />

h. Pet walk areas have been provided in <strong>the</strong> Condominium. All pet owners are required to<br />

pick up after <strong>the</strong>ir pets. Pet st<strong>at</strong>ions have been provided for your convenience. Failure to<br />

clean up after your pet may result in a $25.00 clean up fee.<br />

21. If a Unit Owner finds it necessary to have authorized personnel unlock apartments after<br />

hours, <strong>the</strong>y will be charged a fee <strong>of</strong> $25.00, payable in check form <strong>at</strong> <strong>the</strong> time <strong>of</strong> entry. If <strong>the</strong> Unit<br />

Owners change or add locks on <strong>the</strong>ir Unit, <strong>the</strong>y must give <strong>the</strong> Associ<strong>at</strong>ion a copy <strong>of</strong> <strong>the</strong> key(s). The<br />

Unit Owner may also request th<strong>at</strong> <strong>the</strong> Associ<strong>at</strong>ion, for a fee, change or add locks on <strong>the</strong>ir Unit in which<br />

event <strong>the</strong> Associ<strong>at</strong>ion will retain a copy <strong>of</strong> <strong>the</strong> key(s).<br />

22. If a Unit Owner loses <strong>the</strong> electronic opener for any security g<strong>at</strong>e or security system, <strong>the</strong>y<br />

will be charge a fee <strong>of</strong> $50.00 to replace <strong>the</strong> same.<br />

23. All motor vehicles – which include automobiles, vans <strong>and</strong> trucks - are to be properly<br />

aligned in parking areas. This includes cars <strong>and</strong> vans. Bo<strong>at</strong>, Jet Ski, motorcycle <strong>and</strong> trailer parking is<br />

not available on <strong>the</strong> property. Commercial motor vehicles <strong>and</strong> commercial trucks may not be parked on<br />

<strong>the</strong> property. Campers, recre<strong>at</strong>ional vehicles, or motor homes may not be parked on <strong>the</strong> property.<br />

Viol<strong>at</strong>ors will be stickered <strong>and</strong> towed away <strong>and</strong> resident (s) will pay all fees incurred.<br />

24. Repair <strong>and</strong> washing <strong>of</strong> motor vehicles is prohibited on <strong>the</strong> property, except for minor<br />

repairs <strong>and</strong> washing <strong>at</strong> <strong>the</strong> design<strong>at</strong>ed car care center. If it becomes evident th<strong>at</strong> your car is leaking oil<br />

on our asphalt parking area, you will be asked to remove it as it is damaging <strong>the</strong> integrity <strong>of</strong> <strong>the</strong> space<br />

<strong>and</strong> cre<strong>at</strong>ing an unsightly appearance within our community. You may also be assessed a fee for <strong>the</strong><br />

cleanup <strong>of</strong> <strong>the</strong> oil leak.<br />

25. Parking on <strong>the</strong> grass, curb areas or in <strong>the</strong> car care center is not permitted. Viol<strong>at</strong>ors will be<br />

stickered <strong>and</strong>/or towed <strong>at</strong> <strong>the</strong> expense <strong>of</strong> <strong>the</strong> viol<strong>at</strong>or <strong>and</strong> a charge <strong>of</strong> $ 100.00 will be assessed to <strong>the</strong><br />

viol<strong>at</strong>or.<br />

26. All motor vehicles parked on <strong>the</strong> premises must be operable <strong>and</strong> have valid current license<br />

pl<strong>at</strong>es. "Operable" means <strong>the</strong> vehicle must have air in <strong>the</strong> tires, have all major components intact,<br />

including windows <strong>and</strong> windshields, <strong>and</strong> be reasonably clean. Motor vehicles may not be used to store<br />

bulky personal items on a permanent basis. The determin<strong>at</strong>ion <strong>of</strong> whe<strong>the</strong>r a vehicle is inoperable shall<br />

be within <strong>the</strong> discretion <strong>of</strong> management, however a motor vehicle will be autom<strong>at</strong>ically deemed to be<br />

inoperable if it is not "street legal."<br />

27. Unit Owners th<strong>at</strong> are assigned parking spaces in <strong>the</strong> <strong>at</strong>tached garages <strong>and</strong> corresponding<br />

parking spaces shall not park in guests parking spaces <strong>and</strong> shall instruct <strong>the</strong>ir guest <strong>and</strong> invitees to,<br />

whenever possible, park in <strong>the</strong> Unit Owners assigned garage or t<strong>and</strong>em parking spaces.<br />

28. The owner/management assumes no liability or responsibility for loss, damage or claims <strong>of</strong><br />

any n<strong>at</strong>ure for any motor vehicle or personal property parked or stored by Unit Owners, <strong>the</strong>ir family<br />

members <strong>and</strong> guests.<br />

29. All motor vehicles <strong>of</strong> any type must be registered with management including inform<strong>at</strong>ion<br />

on: make, model, year, tag number, <strong>and</strong> description.<br />

30. Employees <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion are not to be sent out <strong>of</strong> <strong>the</strong> building by Unit Owners for<br />

personal err<strong>and</strong>s. The Board <strong>of</strong> Administr<strong>at</strong>ion <strong>and</strong>/or its management agent shall be solely responsible<br />

for supervising employees <strong>of</strong> this Associ<strong>at</strong>ion.<br />

31. The personal property <strong>of</strong> Unit Owners must be stored ei<strong>the</strong>r in <strong>the</strong>ir respective Units, or (if<br />

applicable) assigned storage areas.<br />

32. No Unit Owner shall make or permit any disruptive noises or noxious fumes in or about <strong>the</strong><br />

Units <strong>and</strong> <strong>the</strong> Condominium Property, or permit any conduct by any persons th<strong>at</strong> will interfere with <strong>the</strong><br />

rights, comforts, or conveniences <strong>of</strong> o<strong>the</strong>r Unit Owners.<br />

33. A Unit Owner who plans to be absent during <strong>the</strong> hurricane season, must prepare his Unit<br />

prior to his departure by:<br />

a. Removing all furniture, plants <strong>and</strong> o<strong>the</strong>r objects from his p<strong>at</strong>io, terrace, <strong>at</strong>rium, ro<strong>of</strong> deck<br />

or balcony; <strong>and</strong><br />

. Design<strong>at</strong>ing a responsible firm or individual if o<strong>the</strong>r than <strong>the</strong> Associ<strong>at</strong>ion, to care for his<br />

Unit, should <strong>the</strong> Unit suffer hurricane damage, <strong>and</strong> furnishing <strong>the</strong> Associ<strong>at</strong>ion with <strong>the</strong><br />

names <strong>of</strong> such firm or individual. Such firm or individual shall contact <strong>the</strong> Associ<strong>at</strong>ion<br />

for clearance to install or remove hurricane shutters, <strong>and</strong> such parties shall be subject to<br />

<strong>the</strong> approval <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion.<br />

34. Food <strong>and</strong> beverages may not be consumed outside <strong>of</strong> a Unit <strong>and</strong> its appurtenant p<strong>at</strong>io,<br />

balcony or ro<strong>of</strong> deck, except in design<strong>at</strong>ed areas. There shall be no cooking on balconies, breezeways, or<br />

ro<strong>of</strong> decks.<br />

35. No drilling <strong>of</strong> floors or ceilings is allowed for <strong>at</strong>tachment or hanging <strong>of</strong> any m<strong>at</strong>erial,<br />

including, without limit<strong>at</strong>ion, planters <strong>and</strong> hammocks, unless reviewed <strong>and</strong> approved under competent<br />

engineering supervision as required by management.<br />

36. Fire Exits shall not be obstructed in any manner.<br />

37. No commercial or business purpose shall be conducted in any Unit. No Unit Owner may<br />

actively engage in solicit<strong>at</strong>ion for commercial purposes.<br />

38. Before a Unit is to be occupied by guests in <strong>the</strong> absence <strong>of</strong> <strong>the</strong> Unit Owner, a written guest<br />

identific<strong>at</strong>ion notice listing names <strong>and</strong> length <strong>of</strong> stay must be furnished to <strong>the</strong> Manager.<br />

39. No Unit Owner or Occupant may alter, change or remove any furniture, furnishings or<br />

equipment in <strong>the</strong> Common Elements.<br />

40. A Unit Owner shall be liable for <strong>the</strong> expense <strong>of</strong> any maintenance, repair, replacement or<br />

damage to <strong>the</strong> Common Elements rendered necessary by his or her acts or by those <strong>of</strong> any member <strong>of</strong><br />

such Unit Owner's family or <strong>the</strong> guests, employees, agents or lessees <strong>of</strong> <strong>the</strong> Unit Owner or his family.<br />

41. No Unit Owner or lessee shall invite in his absence any person not in residence to use <strong>the</strong><br />

Condominium facilities.<br />

42. A Unit Owner seeking to make an alter<strong>at</strong>ion, addition or improvement to his Unit shall<br />

submit <strong>the</strong> plans <strong>and</strong> specific<strong>at</strong>ions for same to <strong>the</strong> Board <strong>of</strong> Administr<strong>at</strong>ion whe<strong>the</strong>r or not <strong>the</strong> approval<br />

<strong>of</strong> <strong>the</strong> Board is required under <strong>the</strong> terms <strong>of</strong> <strong>the</strong> Declar<strong>at</strong>ion <strong>of</strong> Condominium or <strong>the</strong> Bylaws <strong>of</strong> <strong>the</strong><br />

Associ<strong>at</strong>ion. O<strong>the</strong>r than <strong>the</strong> Developer <strong>and</strong> as o<strong>the</strong>rwise provided herein, Owners may not do any<br />

construction or renov<strong>at</strong>ion without <strong>the</strong> written approval <strong>of</strong> <strong>the</strong> Associ<strong>at</strong>ion. The Associ<strong>at</strong>ion may<br />

reasonably restrict <strong>the</strong> time <strong>and</strong> manner <strong>of</strong> construction, except as it rel<strong>at</strong>es to <strong>the</strong> Developer. O<strong>the</strong>r than<br />

<strong>the</strong> Developer, Unit Owners must provide <strong>the</strong> Associ<strong>at</strong>ion with a $500.00 security deposit prior to<br />

commencing construction or renov<strong>at</strong>ion. The owners must provide <strong>the</strong> Associ<strong>at</strong>ion with copies <strong>of</strong> proper<br />

permits, licenses, <strong>and</strong> insurance certific<strong>at</strong>es before commencing with construction or renov<strong>at</strong>ions <strong>and</strong><br />

must use only properly licensed workers.<br />

43. Unit Owners may only perform construction or renov<strong>at</strong>ion work on Monday to Friday from<br />

9:00 a.m. to 5:00 p.m. Unit Owners may not perform construction or renov<strong>at</strong>ion work on holidays or<br />

weekends.<br />

44. A Unit Owner who causes damage to ano<strong>the</strong>r Unit or to Common Elements as a result <strong>of</strong> his<br />

making an alter<strong>at</strong>ion, addition or improvement to his Unit shall be liable for damages to <strong>the</strong> Owner <strong>of</strong><br />

such o<strong>the</strong>r Unit or to <strong>the</strong> Associ<strong>at</strong>ion as <strong>the</strong> case may be.<br />

45. A Unit Owner is responsible for repairing plumbing problems, i.e. clogged drains, within<br />

<strong>the</strong>ir Units.<br />

46. Park only in spaces marked for residents <strong>of</strong> <strong>the</strong> Condominium. Advise guests <strong>and</strong> visitors to<br />

avoid reserved spaces, even for a few minutes, <strong>and</strong> to park in guest spaces. The Associ<strong>at</strong>ion reserves <strong>the</strong><br />

right to tow any <strong>and</strong> all improperly parked vehicles. All costs associ<strong>at</strong>ed with towing such vehicle will be<br />

paid by <strong>the</strong> owner <strong>of</strong> <strong>the</strong> towed vehicle.<br />

47. The speed limit throughout <strong>the</strong> property is 10 miles per hour.<br />

48. Make all minor repairs as needed <strong>and</strong> comply with <strong>the</strong> following maintenance requirements:<br />

a. General Maintenance<br />

i. Regularly inspect b<strong>at</strong>hroom fixtures to make certain th<strong>at</strong> <strong>the</strong>y are all properly<br />

sealed with b<strong>at</strong>hroom grout in order to prevent damage to <strong>the</strong> walls, floors <strong>and</strong><br />

ceilings <strong>of</strong> units on <strong>the</strong> lower floors.<br />

ii. Regularly inspect walls <strong>and</strong> ceilings to check for stains caused by w<strong>at</strong>er, filtr<strong>at</strong>ion<br />

or humidity.<br />

iii. If you experience problems with your circuit breakers contact a licensed<br />

electrician.<br />

iv. If you feel a slight electric shock when touching <strong>and</strong> electrical appliance, unplug<br />

<strong>and</strong> repair <strong>the</strong> appliance.<br />

v. If your lights flash on <strong>and</strong> <strong>of</strong>f or fluctu<strong>at</strong>e in strength, contact a licensed<br />

electrician.<br />

b. Plumbing Maintenance<br />

i. Regularly check <strong>the</strong> faucets <strong>and</strong> w<strong>at</strong>er valves for leaks.<br />

ii. Regularly make certain th<strong>at</strong> <strong>the</strong>re are no w<strong>at</strong>er leaks in <strong>the</strong> tub or sinks.<br />

iii. Clean any sediments which have collected in <strong>the</strong> w<strong>at</strong>er he<strong>at</strong>er monthly or as<br />

recommended in <strong>the</strong> w<strong>at</strong>er he<strong>at</strong>er’s manual.<br />

c. Air Conditioner <strong>and</strong> He<strong>at</strong>ing Unit Maintenance<br />

i. Regularly change <strong>and</strong>/or clean <strong>the</strong> filters on <strong>the</strong> air conditioner <strong>and</strong> he<strong>at</strong>ing unit.<br />

ii. Service <strong>the</strong> units annually or as recommended in <strong>the</strong> unit’s manual.<br />

49. Recre<strong>at</strong>ion facilities may be reserved for priv<strong>at</strong>e parties only through <strong>the</strong> Associ<strong>at</strong>ion. All<br />

reserv<strong>at</strong>ions shall be on a first come, first served basis <strong>and</strong> all functions must conclude by 11:00 p.m.<br />

50. The owners <strong>of</strong> <strong>the</strong> adjacent apartment complex (<strong>the</strong> “Venezia Property”) may utilize <strong>the</strong><br />

recre<strong>at</strong>ional facilities loc<strong>at</strong>ed <strong>at</strong> <strong>the</strong> Docks for priv<strong>at</strong>e parties one weekend per month. The owners <strong>of</strong><br />

Venezia Property must contact <strong>the</strong> Associ<strong>at</strong>ion to reserve <strong>the</strong> dock area for priv<strong>at</strong>e parties. All<br />

reserv<strong>at</strong>ions shall be on a first come, first served basis <strong>and</strong> all functions must conclude by 11:00 p.m.<br />

51. The Developer <strong>and</strong>/or <strong>the</strong> Associ<strong>at</strong>ion may use <strong>the</strong> power, w<strong>at</strong>er facilities <strong>and</strong> tie downs<br />

<strong>at</strong>tached to <strong>the</strong> three pl<strong>at</strong>forms which are part <strong>of</strong> <strong>the</strong> Bellagio Condominium Dock Components for <strong>the</strong><br />

temporary parking <strong>of</strong> guest bo<strong>at</strong>s.<br />

52. Additional <strong>rules</strong> regarding recre<strong>at</strong>ional facilities <strong>and</strong> special amenities, if any, <strong>of</strong>fered in <strong>the</strong><br />

<strong>condominium</strong> (e.g. use <strong>of</strong> pool, tennis courts, clubhouse, kayaks, jet skis, etc.) will be posted on site or<br />

available <strong>at</strong> <strong>the</strong> management <strong>of</strong>fice.<br />

53. Notwithst<strong>and</strong>ing anything herein to <strong>the</strong> contrary, <strong>the</strong> Associ<strong>at</strong>ion may not amend <strong>the</strong>se Rules<br />

<strong>and</strong> Regul<strong>at</strong>ions or adopt new <strong>rules</strong> <strong>and</strong> <strong>regul<strong>at</strong>ions</strong> whose effect will be to detrimentally affect <strong>the</strong> rights<br />

<strong>of</strong> <strong>the</strong> owners <strong>of</strong> <strong>the</strong> Venezia Property.<br />

54. No Unit Owner may move into a Unit except on Monday through Friday from 9:00 a.m. to<br />

7:00 p.m. <strong>and</strong> on S<strong>at</strong>urdays from 10:00 a.m. to 8 p.m. No moving vans larger than fifty (50) feet are<br />

permitted on <strong>the</strong> property.<br />

55. Every Owner <strong>and</strong> occupant shall comply with <strong>the</strong>se Rules <strong>and</strong> Regul<strong>at</strong>ions as set forth herein,<br />

any <strong>and</strong> all <strong>rules</strong> <strong>and</strong> <strong>regul<strong>at</strong>ions</strong> which from time to time may be adopted or amended, <strong>and</strong> <strong>the</strong> provisions<br />

<strong>of</strong> <strong>the</strong> Declar<strong>at</strong>ion, By-Laws <strong>and</strong> Articles <strong>of</strong> Incorpor<strong>at</strong>ion or <strong>the</strong> Associ<strong>at</strong>ion, as amended from time to<br />

time. Failure <strong>of</strong> an Owner or occupant to so comply shall be grounds for action which may include,<br />

without limit<strong>at</strong>ion, an action to recover sums due for damages, injunctive relief, or any combin<strong>at</strong>ion<br />

<strong>the</strong>re<strong>of</strong>. In addition to all o<strong>the</strong>r remedies, in <strong>the</strong> sole discretion <strong>of</strong> <strong>the</strong> Board <strong>of</strong> Directors <strong>of</strong> <strong>the</strong><br />

Associ<strong>at</strong>ion, a fine or fines may be imposed upon an Owner for failure <strong>of</strong> an Owner, his family, guests,<br />

invitees, lessees or employees, to comply with any covenant, restriction, rule or regul<strong>at</strong>ion herein or in <strong>the</strong><br />

Declar<strong>at</strong>ion, Articles <strong>of</strong> Incorpor<strong>at</strong>ion or By-laws, provided <strong>the</strong> following procedures are adhered to:<br />

a. Notice: The Associ<strong>at</strong>ion shall notify <strong>the</strong> Owner or occupant <strong>of</strong> <strong>the</strong> infraction or<br />

infractions. Included in <strong>the</strong> notice shall be a d<strong>at</strong>e <strong>and</strong> time <strong>of</strong> <strong>the</strong> next Board <strong>of</strong> Directors<br />

meeting <strong>at</strong> which time <strong>the</strong> Owner or occupant shall present reasons why penalties should<br />

not be imposed.<br />

b. Hearing: The non-compliance shall be presented to <strong>the</strong> Board <strong>of</strong> Directors after which <strong>the</strong><br />

Board <strong>of</strong> Directors, <strong>and</strong> a committee or o<strong>the</strong>r Unit owners, shall hear reasons why<br />

penalties should not be imposed. A written decision <strong>of</strong> <strong>the</strong> Board <strong>and</strong> committee shall be<br />

submitted to <strong>the</strong> Owner or occupant by not l<strong>at</strong>er than twenty-one (21) days after <strong>the</strong><br />

meeting.<br />

c. Fines: The Board <strong>of</strong> Directors may impose fines against <strong>the</strong> applicable Unit up to <strong>the</strong><br />

maximum amount permitted by law from time to time.<br />

d. Viol<strong>at</strong>ions: Each separ<strong>at</strong>e incident which is grounds for a fine shall be <strong>the</strong> basis <strong>of</strong> one<br />

separ<strong>at</strong>e fine. In <strong>the</strong> case <strong>of</strong> continuing viol<strong>at</strong>ions, each continu<strong>at</strong>ion <strong>of</strong> same after a<br />

notice <strong>the</strong>re<strong>of</strong> is given shall be deemed a separ<strong>at</strong>e incident.<br />

e. Payment <strong>of</strong> Fines: Fines shall be paid not l<strong>at</strong>er th<strong>at</strong> fifteen (15) days after notice <strong>of</strong> <strong>the</strong><br />

imposition <strong>the</strong>re<strong>of</strong>.<br />

f. Applic<strong>at</strong>ion <strong>of</strong> Fines: All monies received from fines shall be alloc<strong>at</strong>ed as directed by <strong>the</strong><br />

Board <strong>of</strong> Directors.<br />

g. Non-exclusive Remedy: The fines shall not be construed to be exclusive <strong>and</strong> shall exist in<br />

addition to all o<strong>the</strong>r rights <strong>and</strong> remedies to which <strong>the</strong> Associ<strong>at</strong>ion may be o<strong>the</strong>rwise<br />

legally entitled; however, any penalty paid by <strong>the</strong> <strong>of</strong>fending Owner or occupant shall be<br />

deducted from or <strong>of</strong>fset against any damages which <strong>the</strong> Associ<strong>at</strong>ion may o<strong>the</strong>rwise be<br />

entitled to recover bylaw from such Owner or occupant.<br />

56. These <strong>rules</strong> <strong>and</strong> <strong>regul<strong>at</strong>ions</strong> shall be cumul<strong>at</strong>ive with <strong>the</strong> covenants, conditions <strong>and</strong><br />

restrictions set forth in <strong>the</strong> Declar<strong>at</strong>ion <strong>of</strong> Condominium, provided th<strong>at</strong> <strong>the</strong> provisions <strong>of</strong> same shall<br />

control over <strong>the</strong>se <strong>rules</strong> <strong>and</strong> <strong>regul<strong>at</strong>ions</strong> in <strong>the</strong> event <strong>of</strong> conflict or a doubt as to whe<strong>the</strong>r a specific practice<br />

activity is not permitted. These <strong>rules</strong> <strong>and</strong> <strong>regul<strong>at</strong>ions</strong> shall not apply to <strong>the</strong> Developer, nor its agents or<br />

employees <strong>and</strong> contractors, nor <strong>the</strong> Units owned by <strong>the</strong> Developer. All <strong>of</strong> <strong>the</strong>se <strong>rules</strong> <strong>and</strong> <strong>regul<strong>at</strong>ions</strong> shall<br />

apply to all o<strong>the</strong>r Owners <strong>and</strong> occupants even if not specifically so st<strong>at</strong>ed in portions here<strong>of</strong>. The Board <strong>of</strong><br />

Directors shall be permitted (but not required) to grant relief to one or more Unit Owners from specific<br />

<strong>rules</strong> <strong>and</strong> <strong>regul<strong>at</strong>ions</strong> upon written request <strong>the</strong>refor <strong>and</strong> good cause shown in <strong>the</strong> sole opinion <strong>of</strong> <strong>the</strong><br />

Board.<br />

In <strong>the</strong> event <strong>of</strong> conflict between <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se Rules <strong>and</strong> Regul<strong>at</strong>ions <strong>and</strong> <strong>the</strong> Bylaws <strong>of</strong><br />

<strong>the</strong> Associ<strong>at</strong>ion or <strong>the</strong> Declar<strong>at</strong>ion <strong>of</strong> Condominium, <strong>the</strong> Bylaws shall supersede <strong>the</strong> Rules <strong>and</strong><br />

Regul<strong>at</strong>ions <strong>and</strong> <strong>the</strong> Declar<strong>at</strong>ion <strong>of</strong> Condominium shall supersede both.<br />
