OUTLINES OF SOME RECENT ORISSA HIGH COURT JUDGEMENTS
SIBA BAGH & ANR. -V- STATE OF ORISSA.
JCRLA NO.233 OF 2000 (Dt. 17.10.2011)
A. EVIDENCE ACT, 1872 – S.27.
Leading to discovery – P.W.3 in his Examination-in-Chief stated that both the appellants while in
custody made discloser about the incident, led him as well as the other witnesses and the I.O. to the
spot and gave recovery of the stone stained with blood – Evidence of P.W.3 corroborates the evidence of
the I.O. (P.W.10) with regard to recording of the disclosure statement of the appellants and seizure of the
weapon of offence at their instance – Held, prosecution is able to establish the leading to discovery made
U/s.27 of the Act.
B. EVIDCENCE ACT, 1872 – S.134.
Evidence has to be weighed and not counted – P.W.1 is the sole eyewitness to the occurrence –
His evidence appears to be clear, cogent and trust worthy and there is nothing on record to the contrary
– Held, prosecution is able to establish beyond all reasonable doubt that both the appellants in furtherance
of their common intention have committed murder of the deceased.
W.P.(C) NO.2706 OF 2006 (D.19.10.2011)
INDUSTRIAL DISPUTES ACT, 1947 – S.25-B.
Continuous service of workman – The petitioner-workman was disengaged on 1.4.93 and the learned
Tribunal calculated the number of days he worked from that date backward till 1.4.92 and held that the
petitioner-workman did not work for 240 days in 12 calendar months preceding the date of his disengagement,
which is under challenge.
In this case even though the petitioner did not work for 240 days in twelve calendar months
immediately preceding the date of his termination, yet he has worked for more than 240 days in the year
in Court premises on 4.3.2005 around noon and the T.I. Parade of seized ornaments conducted after 4
PM so possibility of the identifying witnesses seeing the alleged stolen properties can not be ruled out
Sub-Jail on 3.3.2005 where P.Ws. 2 & 3 identified the present appellant and another but in the other hand
evidence of P.W.2 discloses that much prior to T.I. Parade Trinath Amanatya and some other dacoits were
