PURPOSE OF REPORT:
To consider a request to use "Surfmist" Colorbond roofing material.

Open Space: 533sqm (60%)
Existing Floor Area: 315sqm
Proposed Floor Area: 431sqm (includes 42sqm carport)
An application has been received for additions to the existing single storey dwelling;
There is little change to the existing building footprint;
A new loft area is proposed with a floor area of approximately 74sqm;
The applicant proposes a new 'Surfmist' Colourbond roof to replace the existing tiled roof;
A carport is proposed set back 1.0 metre from the western boundary and 1.5 metres from
the front boundary.
Background
Local Law 43
Local Law 43 (Building on Endowment lands and Limekilns Estate) is based on the
Cambridge Endowment Lands Act 1920 which was gazetted to assist the development of
the area known as the Endowment Lands and Limekilns Estate. The area comprises most
of Floreat and City Beach.
Local Laws were enacted under this Act, including Local Law 43. The contents of the
Local Law reflect the development control needs and statutory processes available at the
time of its gazettal (1950's). At that time, the former City of Perth had no Town Planning
Scheme, and thus the Local law was necessary to control land use and introduce
development standards for the area.
The land use provisions have been made redundant by the Town Planning Scheme,
which reinforces the same requirements as the Local Law.
Clause 8 of Local Law 43 states "All buildings shall be roofed with materials constructed
of terracotta, concrete, slate, metal or other incombustible material approved by the
Council provided that metal roofs with a pitch of more than 5 degrees shall not be
