COUNCIL MINUTES TUESDAY 20 DECEMBER 2011 DV11.116 LOT 196 (NO. 43) DAMPIER AVENUE, CITY BEACH - TWO STOREY DWELLING WITH UNDERCROFT GARAGE PURPOSE OF REPORT: To consider an application for a two storey dwelling with undercroft requiring assessment under the performance criteria of the Residential Design Codes (R Codes) in respect to retaining/fill and wall height. BACKGROUND: BA/DA REFERENCE: 386DA-2011 LANDOWNER: Stephen and Natalie West APPLICANT: Milankov Designs and Project Management ZONING: Residential R12.5 USE CLASS: Dwelling (single) - 'P' (permitted) LAND AREA: 1077 m 2 DETAILS: Development description Total floor area 633.8m2 (including balconies and alfresco areas) Sites slopes down approximately 2.0 metres from front (Dampier Avenue) to rear boundary and approximately 2.0 metres from left (eastern) to right (western) side boundaries. The applicant proposes to level the site to the rear so that the filled ground level is similar to the level of the proposed residence. This requires retaining of up to nearly 3.0 metres at the rear of the site. The fall of the land towards the rear of the site means that the rear portion of the dwelling is overheight with a maximum height of 9.41 metres for the flat roof section. The dwelling has been designed with a basement garage and two storeys above this. The driveway to the garage is at maximum gradient and therefore the dwelling cannot be lowered any further. Applicant's submission The applicant has provided the following justification for the proposed variations:- We have been in discussion with the majority of the neighbouring properties and have obtained their verbal approval. Due to the nature and topography of the site's natural ground line we calculate that we will be over height to the rear portion of our residence. The excess in bulk is predominately within the rear yard will not affect the general streetscape.
