(iii) public art up to a value of one percent of the cost of the development be
incorporated in the development, or, in lieu of the applicant being unable to provide
this to the satisfaction of the Town, a contribution of one percent of the cost of the
development be made to the Town, prior to the occupation of the building, for
expenditure on public art in the near vicinity of the development.
Footnotes:
The applicant be advised that:-
1. Crossovers that are not required to access the development shall be removed and
the footpath and kerbing reinstated.
2. Stormwater must be contained on-site.
3. Adjacent residents along Nicholson Street have raised concerns of disruption and
vibration during building construction and are to be taken into consideration during
the preparation of the Construction Management Plan.
4. Access from Nicholson Street may be closed in the future when the east and west
right of way to Abbotsford Street and Southport Street is achieved.
