The pedestrian path must:
1. provide for unrestricted public access (except for occasional closure
necessary to prevent the establishment of an easement by prescription)
connecting Nicholson Street and Railway Parade;
2. be a minimum of 11 metres in width; and
3. be constructed and maintained as shown on the plans submitted with
this application.
Notification of this planning condition must be lodged against the title to site
land under Section 70A of the Transfer of Land Act;

an agreement being entered into between the Town and the owners of the site
under Clause 49 of the Scheme, under which the owner agrees to cede to the
Town without compensation for the purpose of a future ROW a strip of land
six (6) metres wide across the northern boundary of the site, prior to the issue
of the building licence. This strip of land is to be subdivided from Lot 50 at
the time Lots 50 and 500 are amalgamated (to accommodate the development)
and ceded free of cost to the Town at that time;
the amalgamation of Lots 50 and 500 into one lot on the certificate of title
prior to the issue of the building licence;
the preparation of a transport management plan for staff and visitors to the
building to the satisfaction of the Town, prior to the occupation of the
building;
The transport management plan is to include incentives for use of alternative
modes of travel including cost subsidy for public transport fares, priority
parking for car pooling, service and delivery vehicle parking, management of
the small car bays and maintenance of the bicycle end of trip facilities;
All visitor parking to the building is to be provided on the upper basement
accessed from Railway Parade.

the operation of, and adherence to, the transport management plan;
submission of detailed construction plans at the building licence stage, for
the approval of the Town, of the proposed 2.7 metre wide painted median to
be provided within the Railway Parade road reserve to facilitate right turn
movements associated with the development. All associated works are to be
at the expense of the applicant;
submission of details of the proposed barriers adjacent to the vehicle access
to Railway Parade to provide for adequate vehicle and pedestrian sightlines to
the satisfaction of the Town;
submission of a detailed landscaping and reticulation plan, prior to the issue
of a building licence, including the specification of plant types and installation
methods to the satisfaction of the Town;
the landscaped areas, as shown on the landscaping plan, to be installed and
reticulated prior to the occupation of the building and thereafter maintained to
the satisfaction of the Town;
