ADMINISTRATION RECOMMENDATION:
That:-
(i)
further to Council's approval under Clause 45 'Approval subject to later planning approval
of details' of the Town Planning Scheme No. 1, granted at its meeting on 24 May 2011,
Council APPROVES the application for approval of further details for a multi level office
building with basement car parking and a ground floor café tenancy submitted by
HASSELL at Lots 50 and 500 (Nos. 168-170) Railway Parade, West Leederville as shown
on plans dated 1 December 2011, subject to the following conditions:
(a)
an agreement being entered into between the Town and the owners of the site,
under Clause 49 of the Scheme, to provide for a permanent pedestrian path through
the site, prior to occupation of the building.
The pedestrian path must:
1. provide for unrestricted public access (except for occasional closure
necessary to prevent the establishment of an easement by prescription)
connecting Nicholson Street and Railway Parade;
2. be a minimum of 11 metres in width; and
3. be constructed and maintained as shown on the plans submitted with this
application.
Notification of this planning condition must be lodged against the title to site land
under Section 70A of the Transfer of Land Act;

an agreement being entered into between the Town and the owners of the site
under Clause 49 of the Scheme, under which the owner agrees to cede to the Town
without compensation for the purpose of a future ROW a strip of land six (6) metres
wide across the northern boundary of the site, prior to the issue of the building
licence. This strip of land is to be subdivided from Lot 50 at the time Lots 50 and
500 are amalgamated (to accommodate the development) and ceded free of cost to
the Town at that time;
the amalgamation of Lots 50 and 500 into one lot on the certificate of title prior to
the issue of the building licence;
the preparation of a transport management plan for staff and visitors to the building
to the satisfaction of the Town, prior to the occupation of the building;
The transport management plan is to include incentives for use of alternative modes
of travel including cost subsidy for public transport fares, priority parking for car
pooling, service and delivery vehicle parking, management of the small car bays
and maintenance of the bicycle end of trip facilities;

the operation of, and adherence to, the transport management plan;
submission of detailed construction plans at the building licence stage, for the
approval of the Town, of the proposed 2.7 metre wide painted median to be
