Clause 45 'Approval Subject to Later Planning Approval of Details' of Town Planning Scheme
No.1 and decided:
That Council declines to deal with the application (dated 17 February 2011), requiring a later
approval under Clause 45 of the Town Planning Scheme No. 1: Approval Subject to Later
Planning Approval of Details submitted by the Western Australian Local Government
Association (WALGA) for an office building on lots 50 and 500, 168/170 Railway Parade, West
Leederville for the following reasons:-
(i)
(ii)
the application does not meet the requirements of the Town Planning Scheme in
relation to plot ratio and on-site parking provision; and
the proposal put forward in the letter from WALGA dated 15 March 2011 does not
offer the ceding of a 6.0 metre wide strip of land across the rear of the site for a road
reservation free of cost.

Following the Council decision in March 2011 above, a request was received from WALGA for
the matter to be reconsidered. WALGA offered to cede a full 6 metre strip of land free of cost
to the Council for access purposes and also reaffirmed their undertaking to provide the
pedestrian access. Council reconsidered the application and decided:
That in accordance with Part 4 of Town of Cambridge Town Planning Scheme No. 1, the
application for approval subject to later planning approval of details under Clause 45 of the
Scheme submitted by the Western Australian Local Government Association dated 17 February
2011, and subsequent submission dated 20 May 2011 for the development of Lots 50 and 500
(Nos. 168-170) Railway Parade, West Leederville for a multi level office building with basement
parking, be approved subject to:-
(i)
(ii)
the conditions set out in paragraph 1; and
the matters set out in paragraph 2 requiring the subsequent approval of the Council.
1. Conditions
The application is approved subject to the following conditions, each to be satisfied in a
manner, form and substance satisfactory to the Town:-
1.1 The building to include no more than 5,100 m² of commercial office floor space
and up to a further 1,000 m² of floor space to be used for incidental purposes.
1.2 The building to include an undercroft carpark yielding a minimum carparking
provision of 162 car bays, which is accepted by the Council as being sufficient for
the volume of floor space specified in condition 1.1 subject to the following:-
(a)
To offset the reduced provision for on-site car parking, as it relates to the
Town's Parking Policy (up to 41 bays), the following measures must be put
in place to facilitate and encourage the use of alternate transport modes to
access the office development:-
(i)
Provision of suitable end of trip bicycle facilities to include bicycle
parking, lockers and showers with associated change room facilities
to the satisfaction of the Town; and
