Applications for Review (Appeals) - determined Property: Lot 800 (No. 31) Gayton Road, City Beach Proposal: Proposed built strata subdivision of shopping centre On 30 November 2011, the State Administrative Tribunal advised that the application for review was withdrawn. Compliance On 30 September 2011, a Dog Act Prosecution was heard before the Perth Magistrates Court. On that day the accused was convicted on both charges of "Dog Attack". The court agreed with submissions made on behalf of the Town that the attacks were extremely serious. However, in imposing fines in relation to the matters the Magistrate took into account that the accused had paid the complainant's veterinary bills in the sum of $8,900.00. On the first charge, the accused was fined $4,000.00. On the second charge, the accused was fined $2000.00 and ordered to pay costs of $1,476.45. On 4 November 2011, a Dog Act Prosecution was heard before the Perth Magistrates Court. On that day the accused appeared in person and was convicted on three charges of "Dog Attack". The accused pleaded guilty to the charges, the court imposed a fine of $1000.00 on each charge and ordered to pay costs of $1,124.70. On 7 November 2011, a Parking Prosecution came before the Perth Magistrates Court for hearing. On that day the accused did not attend Court and was convicted in her absence pursuant to section 55 of the Criminal Procedures Act 2004. Upon conviction, the accused was fined $200.00 and ordered to pay costs in the amount of $500.00. COUNCIL MINUTES TUESDAY 20 DECEMBER 2011 Procedure Act 2004. The Court imposed a penalty of $200.00 and ordered the accused to pay the Town's costs in the amount of $796.50.
