<strong>EL7211</strong> - Exploration Strategy<br />
• Exploration to commence February 2009 after negotiation of<br />
access agreements, further approvals and procurement of<br />
exploration services<br />
• Purpose in 2009 is to establish the potential of the coal<br />
resource down to the Bowfield Seam (up to 650m deep)<br />
• Depending on the results obtained from the initial drilling the<br />
programme will be progressively expanded to establish a<br />
250m grid of boreholes that will enable a definition of the<br />
resource to a measured status according to the JORC Code*<br />

Ore Reserves (2004), utilised by analysts and investors for investment purposes

<strong>EL7211</strong> Access Agreements and Compensation<br />
• Governed by Sections 138 to 158 of Mining Act 1992<br />
• To make provision for:<br />
- Periods during which permitted to access land<br />
- Land where prospecting may take place and means of entry<br />
- Types of prospecting allowed<br />
- Conditions to be observed while prospecting<br />
- Things that have to be done to protect the environment<br />
- Compensation payable to the landholder<br />
- Manner of resolving disputes that arise<br />
- Manner of varying the agreement<br />
- Other matters agreed to be included<br />
• Compensation will be negotiated with each land holder as appropriate and<br />
will be based on duration of entry and benchmark payments in the area
<strong>EL7211</strong> <strong>Peabody</strong> Undertakings<br />
• Compliance with <strong>EL7211</strong> conditions<br />
• Drilling and other intrusive exploration activities will not be undertaken in<br />
the precincts of the convict pit, cemetery, community hall and historic<br />
buildings<br />
• Forming a working group representing landholders on whose properties<br />
exploration will take place to establish exploration protocols:<br />
- Entry notification<br />
- Drill site standards<br />
- Liaison programme (addressing inquiries and complaints)<br />
- Final Inspections<br />
- Feedback sheets<br />
• Regular feedback on progress with exploration activities and resultant<br />
changes to exploration area through community meetings, Wambo<br />
Community Consultative Committee and newsletters
