Regulation<br />

The electronic Commerce Regulations 2002:<br />

• Scope: These regulations apply <strong>to</strong>:<br />

− advertising goods and services online (using the internet,<br />

mobile phones and interactive TV)<br />

− selling goods and services <strong>to</strong> business and individuals online<br />

− transmitting and s<strong>to</strong>ring electronic information.<br />

• Information requirements: The regulations lay down detailed<br />

requirements about the information which must be provided<br />

<strong>to</strong> end users of online marketing and sales services. You should<br />

check these carefully before starting. They include obligations <strong>to</strong><br />

provide (among other items of information):<br />

− full contact details of the business<br />

− the VAT number<br />

− clear price information, inclusive of tax and delivery costs<br />

− full information in email advertising about the sender and the<br />

promotion<br />

− specified and detailed information about the electronic<br />

contract which is on offer <strong>to</strong> private cus<strong>to</strong>mers (this is optional<br />

for business cus<strong>to</strong>mers, and not applicable at all <strong>to</strong> one-<strong>to</strong>-one<br />

contracts agreed by email).<br />

• Penalties: The Office of Fair Trading can issue “s<strong>to</strong>p now”<br />

orders, and the courts can order businesses <strong>to</strong> publish<br />

information (failure <strong>to</strong> comply is contempt of court).<br />

Consumer Protection (Distance Selling) Regulations 2000: In<br />

addition <strong>to</strong> the provisions above, these regulations give individuals<br />

rights <strong>to</strong> cancel contracts.<br />

Other regulations: Third sec<strong>to</strong>r traders are also subject <strong>to</strong> rules on:<br />

• data protection and privacy<br />

• advertising standards<br />

• the code of practice on premium rate phone services.<br />
