Compliance Training—Streamlining and Removing Barriers<br />

Training and dissemination of information regarding prevailing wage requirements begins in the<br />

contract document itself, with accurate prevailing wage language and wage rates, and continues<br />

throughout the course of the light rail project. Figure 1 illustrates the types of contracting<br />

methods and variations in application of DBA.<br />

By compiling relevant, practical data that can be easily understood and passed on, the<br />

agency’s oversight role is more easily accomplished. TriMet’s goal is to develop and package the<br />

information in a manner that will be most useful to various stakeholders, keeping them in<br />

compliance and on track.<br />

The importance of communicating accurate data cannot be stressed enough. TriMet views<br />

training as a mentoring opportunity, in which the agency educates contractors, so they, in turn,<br />

can train their subcontractors. The preconstruction meeting offers a great first opportunity for<br />

contractors and subcontractors to obtain a package of relevant “how-to” prevailing wage data<br />

from the contracting agency.<br />

The rates in effect at the time the agency advertises a project for bid are rates to be<br />

paid throughout the project, except:<br />

1. Any action modifying the general wage determination is effective if notice of such<br />

action was published before contract award. (FED PW)<br />

2. If a modification is published less than 10 days before bid opening, the modification<br />

is effective unless the agency finds that there is not reasonable time still available<br />

before bid opening to notify bidders and the agency places a report of the finding in<br />

the contract file; or<br />

3. If contract has not been awarded within 90 days after bid opening, a modification<br />

published prior to award is effective unless agency head or designee requests and<br />

obtains extension of 90 day period from the Department of Labor.<br />
