Disposal, Minimum st<str<strong>on</strong>g>and</str<strong>on</strong>g>ard, etc.<br />

The key points of the government positi<strong>on</strong> regarding the opini<strong>on</strong> of the CTOA<br />

are:<br />

‣ The collecti<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> disposal (incinerati<strong>on</strong> as a method of<br />

disposal <str<strong>on</strong>g>and</str<strong>on</strong>g> l<str<strong>on</strong>g>and</str<strong>on</strong>g>filling) of <strong>household</strong> <strong>waste</strong> are a utility<br />

functi<strong>on</strong>. The government must ensure that facilities for<br />

performing this utility functi<strong>on</strong> are present <str<strong>on</strong>g>and</str<strong>on</strong>g>, in the last<br />

resort, must provide them itself. In principle, parties other than<br />

the government may also exercise the utility functi<strong>on</strong>, but this<br />

must not jeopardize the c<strong>on</strong>tinuity of <strong>waste</strong> management or the<br />

government’s resp<strong>on</strong>sibility for it;<br />

‣ Resp<strong>on</strong>sibility for c<strong>on</strong>trolling <strong>waste</strong> is becoming more<br />

centralized <str<strong>on</strong>g>and</str<strong>on</strong>g> there is a shift in powers from the provincial to<br />

the nati<strong>on</strong>al level. This change is mainly a c<strong>on</strong>sequence of the<br />

changing scale of the facilities required for <strong>waste</strong> management<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> the expected increasing disappearance of geographic<br />

borders. Producer resp<strong>on</strong>sibility means that producers or<br />

importers are resp<strong>on</strong>sible or share resp<strong>on</strong>sibility for the<br />

management of the products they have or will put <strong>on</strong> the<br />

market <str<strong>on</strong>g>and</str<strong>on</strong>g> that have reached the end-of-life stage. This<br />

resp<strong>on</strong>sibility may be exp<str<strong>on</strong>g>and</str<strong>on</strong>g>ed into a chain resp<strong>on</strong>sibility, in<br />

which other links are also given resp<strong>on</strong>sibilities.<br />

‣ There will be <strong>on</strong>e <strong>waste</strong> management plan covering both<br />

hazardous <str<strong>on</strong>g>and</str<strong>on</strong>g> n<strong>on</strong>-hazardous <strong>waste</strong> that will apply to the<br />

entire <strong>waste</strong> management chain. The individual parts will be<br />

formulated in or following c<strong>on</strong>sultati<strong>on</strong> with the parties<br />

c<strong>on</strong>cerned. The Minister for Housing, Spatial Planning <str<strong>on</strong>g>and</str<strong>on</strong>g> the<br />

Envir<strong>on</strong>ment will lay down the plan, for which a legal basis will<br />

be created;<br />

‣ Provincial boundaries for <strong>waste</strong> management can be abolished<br />

if certain c<strong>on</strong>diti<strong>on</strong>s are met. Provided the envir<strong>on</strong>mentally
