• <strong>On</strong> 5 <strong>and</strong> 6 <strong>July</strong>, a <strong>sem<strong>in</strong>ar</strong> was held<br />

<strong>in</strong> Sarajevo, on the topic <strong>of</strong><br />

Registration <strong>of</strong> Bus<strong>in</strong>ess Entities.<br />

Follow<strong>in</strong>g the transfer <strong>of</strong> competence<br />

for registration <strong>of</strong> bus<strong>in</strong>ess entities<br />

from cantonal to municipal level,<br />

municipal courts were <strong>in</strong>formed<br />

about implementation <strong>of</strong> current<br />

legislation. However, we are soon to<br />

apply new legislation <strong>in</strong> this area.<br />

Along with 16 participants, tra<strong>in</strong>ers<br />

<strong>in</strong>cluded the follow<strong>in</strong>g: judge Predrag<br />

Krsmanovic (CC Tuzla), judge Mesud<br />

Djanic (CC Bihac), judge Braco Stupar<br />

(MC Sarajevo), judge Branka Vidovic<br />

August<br />

FBiH Judicial Tra<strong>in</strong><strong>in</strong>g Centre had no<br />

tra<strong>in</strong><strong>in</strong>g activities <strong>in</strong> the month <strong>of</strong><br />

august, as it was annual leave time.<br />

This time was used for evaluation <strong>of</strong><br />

activities to date, as well as<br />

preparation <strong>of</strong> activities <strong>in</strong> the second<br />

half <strong>of</strong> the year.<br />

September<br />

• <strong>On</strong> 7 <strong>and</strong> 8 September, a <strong>sem<strong>in</strong>ar</strong> was<br />

held <strong>in</strong> Neum on Offences Related to<br />

Domestic Violence <strong>and</strong> the Law on<br />

Protection from Domestic Violence,<br />

with a total <strong>of</strong> 27 participants. The<br />

<strong>sem<strong>in</strong>ar</strong> considered the legislative<br />

framework for <strong>of</strong>fences def<strong>in</strong>ed as<br />

domestic violence <strong>in</strong> crim<strong>in</strong>al<br />

<strong>July</strong><br />

• <strong>On</strong> 3 <strong>July</strong> a <strong>sem<strong>in</strong>ar</strong> was held <strong>in</strong> Banja<br />

Luka on Enforcement Procedure<br />

(application <strong>of</strong> legislation <strong>and</strong><br />

practical problems), which outl<strong>in</strong>ed<br />

the key problems <strong>in</strong> enforcement<br />

procedures that judges deal with <strong>in</strong><br />

their daily work. The topic <strong>of</strong><br />

Enforcement over Immovable<br />

Property triggered numerous<br />

comments <strong>and</strong> questions from<br />

participants, <strong>in</strong> light <strong>of</strong> the situations<br />

aris<strong>in</strong>g <strong>in</strong> enforcement over<br />

immovable property not registered as<br />

such. The <strong>sem<strong>in</strong>ar</strong> was moderated y<br />

judge Rosa Obradovic <strong>of</strong> the Banja<br />

Luka District Court.<br />

• <strong>On</strong> the same day, <strong>in</strong> collaboration with<br />

the M<strong>in</strong>istry for Families, Youth <strong>and</strong><br />

Sports <strong>of</strong> Republika Srpska, the Centre<br />

organised a <strong>sem<strong>in</strong>ar</strong> on<br />

Implementation <strong>of</strong> the Law on<br />

Protection from Domestic Violence,<br />

on Mt. Kozara.<br />

In addition to tra<strong>in</strong>ers from the Centre,<br />

presenters <strong>in</strong>cluded Mr. Dusko<br />

• <strong>On</strong> 14 <strong>and</strong> 15 September, a <strong>sem<strong>in</strong>ar</strong><br />

was held <strong>in</strong> Sarajevo on The Role <strong>of</strong><br />

Judges <strong>in</strong> Enforcement Procedure.<br />

The <strong>sem<strong>in</strong>ar</strong> was attended by 43<br />

judges <strong>and</strong> advisory staff from across<br />

FBiH. Presenters <strong>of</strong> the Centre<br />

<strong>in</strong>cluded judge Jasm<strong>in</strong>ka Kubat (MC<br />

Zenica), judge Milorad Krkljes <strong>and</strong><br />

judge Janja Jovanovic (MC Sarajevo).<br />

Along with practical examples, the<br />

follow<strong>in</strong>g issues <strong>of</strong> enforcement were<br />

considered: bases for enforcement<br />

orders, security measures,<br />

enforcement over immovable<br />

property, determ<strong>in</strong>ation <strong>of</strong> value <strong>of</strong><br />

immovable property, decisions on<br />

sale <strong>of</strong> property, decisions on transfer<br />

<strong>of</strong> property (content <strong>and</strong> mean<strong>in</strong>g),<br />

decision on compensation,<br />

enforcement over movable property<br />

<strong>and</strong> money claims. The participants<br />

showed considerable <strong>in</strong>terest, so that<br />

along with top evaluation results a<br />

request was made to organise more<br />

with the participants, conducted a case<br />

study related to domestic violence.<br />

The participants found the topic very<br />

<strong>in</strong>terest<strong>in</strong>g <strong>and</strong> useful <strong>and</strong> suggested<br />

similar workshops <strong>in</strong> the near future.<br />

• The Centre is active <strong>in</strong> follow<strong>in</strong>g up on<br />

new legislation, <strong>and</strong> on 7 <strong>July</strong> it<br />

organised a <strong>sem<strong>in</strong>ar</strong> for judges<br />

work<strong>in</strong>g <strong>in</strong> the petty <strong>of</strong>fence courts, on<br />

the topic <strong>of</strong> the RS Law on Petty<br />

Offences. Speakers <strong>in</strong>cluded Drago<br />

Seva, president <strong>of</strong> the Banja Luka<br />

Petty Offences Court, <strong>and</strong> Dusko<br />

Miloica, president <strong>of</strong> the Prijedor<br />

Petty Offences Court, who presented<br />

new provisions <strong>in</strong> the RS law which<br />

are to be applied as <strong>of</strong> 1 September<br />

2006. By that date, basic courts <strong>in</strong> RS<br />

will have appo<strong>in</strong>ted judges to deal<br />

specifically with such cases.<br />

Representatives <strong>of</strong> the BiH High<br />

Judicial <strong>and</strong> Prosecutorial <strong>Council</strong><br />

work<strong>in</strong>g on the reform <strong>of</strong> petty <strong>of</strong>fence<br />

courts, Mr. Branko Buzakovic <strong>and</strong> Mr.<br />

Admir Suljagic, <strong>in</strong>formed the<br />

participants that a tra<strong>in</strong><strong>in</strong>g manual is<br />

be<strong>in</strong>g prepared, to cover all the new<br />

laws <strong>in</strong> the area. Follow<strong>in</strong>g the<br />

appo<strong>in</strong>tment <strong>of</strong> judges,<br />

representatives <strong>of</strong> HJPC <strong>and</strong> UNDP<br />

will, <strong>in</strong> collaboration with the Centre<br />

<strong>and</strong> with the aim <strong>of</strong> provid<strong>in</strong>g judges<br />

with new knowledge, organise a<br />

series <strong>of</strong> <strong>sem<strong>in</strong>ar</strong>s <strong>in</strong> this field, to<br />

cover all the new provisions.<br />

August<br />

• <strong>On</strong> 14 <strong>and</strong> 15 September, a <strong>sem<strong>in</strong>ar</strong><br />

was held <strong>in</strong> Sarajevo, <strong>in</strong> collaboration<br />

with CoE – CARDS-CARPО project,<br />

on Application <strong>of</strong> Procedural<br />

Measures for Witness Protection.<br />

The <strong>sem<strong>in</strong>ar</strong> was attended by 38<br />

participants. It considered legal <strong>and</strong><br />

<strong>in</strong>stitutional framework <strong>and</strong><br />

<strong>in</strong>ternational cooperation, receipt <strong>of</strong><br />

reports on <strong>of</strong>fences from the po<strong>in</strong>t <strong>of</strong><br />

view <strong>of</strong> identification <strong>of</strong> cases <strong>of</strong><br />

witness <strong>in</strong>timidation, collection <strong>of</strong><br />

<strong>in</strong>formation from victims <strong>and</strong><br />

witnesses, the use <strong>of</strong> <strong>in</strong>terviews,<br />

collaboration between police <strong>and</strong><br />

prosecutors, specific features <strong>of</strong><br />

tak<strong>in</strong>g statements <strong>and</strong> protection <strong>of</strong><br />

underage witnesses, trauma <strong>and</strong><br />

stress <strong>and</strong> assistance for victims <strong>and</strong><br />

protected witnesses, <strong>in</strong>vestigation<br />

procedures without reveal<strong>in</strong>g the<br />

identity <strong>of</strong> witnesses <strong>and</strong> proposals<br />

for procedural protection measures,<br />

assessment <strong>of</strong> <strong>in</strong>timidation <strong>and</strong><br />

threat, data protection <strong>and</strong> protection<br />

<strong>and</strong> support for protected witnesses<br />

dur<strong>in</strong>g crim<strong>in</strong>al proceed<strong>in</strong>gs,<br />

decisions on protection, <strong>in</strong>terview<strong>in</strong>g<br />

protected witnesses dur<strong>in</strong>g the ma<strong>in</strong><br />

For that purpose, the Centre<br />

distributed questionnaires to all the<br />

courts <strong>and</strong> prosecutors’ <strong>of</strong>fice, <strong>in</strong> order<br />

for judges <strong>and</strong> prosecutors to make<br />

suggestions <strong>and</strong> give proposals <strong>and</strong><br />

thus play an active role <strong>in</strong> design<strong>in</strong>g<br />

programmes for the com<strong>in</strong>g year,<br />

suited to their needs. The Centre<br />

rema<strong>in</strong>s open for all their proposals,<br />

suggestions <strong>and</strong> comments, <strong>and</strong><br />

<strong>in</strong>vites all the parties concerned to<br />

become <strong>in</strong>volved <strong>in</strong> curriculum<br />

design.<br />

September<br />

• In compliance with its programme, on<br />

11 September the Centre organised a<br />

<strong>sem<strong>in</strong>ar</strong> on Jo<strong>in</strong>t Tra<strong>in</strong><strong>in</strong>g for Judges<br />

<strong>and</strong> Civil Servants Responsible for<br />

Implementation <strong>of</strong> Legislation <strong>in</strong><br />

Taxation Procedures <strong>and</strong> Taxation<br />

Adm<strong>in</strong>istration. In addition to judges<br />

<strong>and</strong> court assistants, the <strong>sem<strong>in</strong>ar</strong> was<br />

attended by representatives <strong>of</strong> the Tax<br />

Adm<strong>in</strong>istration <strong>of</strong> Republika Srpska.<br />

The <strong>sem<strong>in</strong>ar</strong> topic ‘Experiences <strong>of</strong> the<br />

RS Supreme Court <strong>in</strong> Application <strong>of</strong><br />

Taxation Legislation <strong>in</strong> Adm<strong>in</strong>istrative<br />

Matters’ was covered by Mr. Janko<br />

N<strong>in</strong>ic, Judge <strong>of</strong> the RS Supreme Court,<br />

<strong>and</strong> ‘Experiences <strong>of</strong> the RS Taxation<br />

Adm<strong>in</strong>istration <strong>in</strong> Application <strong>of</strong><br />

Taxation Legislation through the work<br />

<strong>of</strong> the Appeals Board’ was presented<br />

Related to Customs <strong>and</strong> Tax <strong>and</strong> the<br />

New Taxation System – VAT. The<br />

<strong>sem<strong>in</strong>ar</strong> <strong>in</strong>cluded 28 participants. It<br />

considered the role, organisation <strong>and</strong><br />

competences <strong>of</strong> the Indirect Taxation<br />

Authority, procedures <strong>in</strong> the VAT<br />

system, current situation <strong>in</strong><br />

implementation <strong>of</strong> VAT <strong>and</strong> number<br />

<strong>and</strong> type <strong>of</strong> <strong>of</strong>fences related to<br />

customs <strong>and</strong> VAT, substantive <strong>and</strong><br />

procedural aspects <strong>of</strong> prosecution <strong>of</strong><br />

<strong>of</strong>fences <strong>in</strong> this area, connections<br />

between tax evasion <strong>and</strong> other forms<br />

<strong>of</strong> fraud (customs fraud, forgery <strong>of</strong><br />

value labels, smuggl<strong>in</strong>g, forgery <strong>of</strong><br />

documents, illegal production) –<br />

experiences <strong>of</strong> the Indirect Taxation<br />

Authority <strong>in</strong> BiH. Presenters <strong>in</strong>cluded<br />

• <strong>On</strong> 20 September, a <strong>sem<strong>in</strong>ar</strong> was held<br />

<strong>in</strong> Sarajevo on the Family Law. The<br />

new Family Law <strong>in</strong> BiH ( <strong>in</strong> force as<br />

<strong>of</strong> September 2005) established key<br />

novelties <strong>in</strong> regulat<strong>in</strong>g <strong>and</strong><br />

prosecut<strong>in</strong>g cases <strong>in</strong> the field <strong>of</strong><br />

issues <strong>and</strong> compla<strong>in</strong>ts advisor to the<br />

Director <strong>of</strong> the RS Taxation<br />

Adm<strong>in</strong>istration. Mr. Zlatko Kulenovic,<br />

Judge <strong>of</strong> the RS Supreme Court, spoke<br />

on Observance <strong>of</strong> Rules <strong>of</strong> Procedure<br />

<strong>in</strong> Rul<strong>in</strong>gs <strong>in</strong> Adm<strong>in</strong>istrative Matters.<br />

It was stated by all the participants<br />

that there is a constant need for this<br />

type <strong>of</strong> jo<strong>in</strong>t tra<strong>in</strong><strong>in</strong>g, as it contributes<br />

to greater efficiency <strong>of</strong> taxation<br />

authorities.<br />

• <strong>On</strong> 15 September, the Centre hosted a<br />

<strong>sem<strong>in</strong>ar</strong> on Current Issues <strong>in</strong> the<br />

work <strong>of</strong> District Courts <strong>and</strong><br />

Prosecutors’ <strong>Office</strong>s for the Banja<br />

Luka District’. The <strong>sem<strong>in</strong>ar</strong> was<br />

organised as a two-segment<br />

<strong>in</strong>teractive workshop. The first part<br />

<strong>in</strong>cluded separate workshops for<br />

judges <strong>and</strong> prosecutors. Judges<br />

discussed ‘Confirmation <strong>of</strong><br />

Indictments <strong>and</strong> Acceptance <strong>of</strong> Guilty<br />

Pleas’, <strong>in</strong>troduced by Ms. Svetlana<br />

Maric, judge <strong>of</strong> the Banja Luka District<br />

Court. Follow<strong>in</strong>g an <strong>in</strong>troduction by<br />

Mr. Vitomir Soldat, Chief District<br />

Prosecutor for Banja Luka, the<br />

participants discussed the issue <strong>of</strong><br />

‘Content <strong>of</strong> Indictments <strong>and</strong><br />

Amendments to Indictments at the<br />

Ma<strong>in</strong> Hear<strong>in</strong>g’. The second part was a<br />

plenary, which presented conclusions<br />

from the workshops, followed by a<br />

debate between judges <strong>and</strong><br />

prosecutors.<br />

• <strong>On</strong> 22 <strong>and</strong> 23 September, a <strong>sem<strong>in</strong>ar</strong><br />

was held <strong>in</strong> Banja Luka, <strong>in</strong><br />

collaboration with the CoE CARDS


family relations. In their<br />

presentations, Pr<strong>of</strong>essor Suzana Bubic<br />

(Mostar School <strong>of</strong> Law) <strong>and</strong> Ms.<br />

Ljiljana Zita (FBiH Ombudsman’s<br />

<strong>Office</strong>) <strong>and</strong> Mr. Dzemalud<strong>in</strong><br />

Mutapcic, as well as Ms. Bisera<br />

Hadzajlic (Sarajevo Canton Social<br />

Work Centre) looked at novelties,<br />

current challenges <strong>in</strong> the application<br />

<strong>and</strong> experiences ga<strong>in</strong>ed thus far.<br />

Op<strong>in</strong>ions were exchanged on<br />

experiences <strong>of</strong> courts <strong>in</strong> different<br />

parts <strong>of</strong> FBiH, <strong>and</strong> <strong>in</strong>dividual issues<br />

<strong>of</strong> <strong>in</strong>terest for design<strong>in</strong>g effective<br />

policy were considered. The <strong>sem<strong>in</strong>ar</strong><br />

was attended by 86 participants from<br />

across FBiH. In addition to judges, the<br />

<strong>sem<strong>in</strong>ar</strong> was attended by<br />

representatives <strong>of</strong> social work centres,<br />

police forces, M<strong>in</strong>istry <strong>of</strong> Justice,<br />

schools <strong>of</strong> law, M<strong>in</strong>istry <strong>of</strong> Labour<br />

<strong>and</strong> Social Policy. It was noted that<br />

there was a need for a tra<strong>in</strong><strong>in</strong>g<br />

module <strong>in</strong> this area, <strong>and</strong> more<br />

<strong>sem<strong>in</strong>ar</strong>s on the topic.<br />

• <strong>On</strong> 21 <strong>and</strong> 22 September, a <strong>sem<strong>in</strong>ar</strong><br />

was held <strong>in</strong> Sarajevo on Introduction<br />

to Judicial <strong>and</strong> Prosecutorial<br />

Organisation, Governmental <strong>and</strong><br />

Non-Governmental Institutions, <strong>and</strong><br />

the BiH Social Environment that<br />

Judges Work In, with a total <strong>of</strong> 21<br />

participants. The <strong>sem<strong>in</strong>ar</strong> looked at<br />

the positive role <strong>of</strong> the BiH HJPC, <strong>and</strong><br />

the organisation <strong>of</strong> judicial <strong>and</strong><br />

prosecutorial system <strong>in</strong> BiH,<br />

organisation <strong>and</strong> procedures before<br />

the <strong>Office</strong> <strong>of</strong> the Discipl<strong>in</strong>ary<br />

Prosecutor, pr<strong>of</strong>essional development<br />

system, relations between ord<strong>in</strong>ary<br />

CARPO project, titled Tra<strong>in</strong><strong>in</strong>g on<br />

Application <strong>of</strong> Procedural Protection<br />

Measures. The topics <strong>in</strong>cluded: legal<br />

<strong>and</strong> <strong>in</strong>stitutional framework for<br />

procedural measures <strong>of</strong> witness<br />

protection, repors on <strong>of</strong>fences <strong>in</strong><br />

relation to identification <strong>of</strong> cases <strong>of</strong><br />

witness <strong>in</strong>timidation <strong>and</strong> tamper<strong>in</strong>g,<br />

<strong>and</strong> adequate <strong>and</strong> prompt report<strong>in</strong>g to<br />

relevant services on the need for<br />

measures <strong>of</strong> protection <strong>and</strong> support;<br />

<strong>and</strong> witnesses, utilisation <strong>of</strong> police<br />

<strong>in</strong>terviews, collaboration between<br />

• <strong>On</strong> 25 September, a <strong>sem<strong>in</strong>ar</strong> was held<br />

<strong>in</strong> Sarajevo on Inheritance Procedure<br />

<strong>and</strong> Legislation on Inheritance. The<br />

<strong>sem<strong>in</strong>ar</strong> was attended by 32<br />

participants from across FBiH. Along<br />

with tra<strong>in</strong>ers, judge Sida Jasarspahic<br />

(Court <strong>of</strong> BiH) <strong>and</strong> judge Jasm<strong>in</strong>ka<br />

Kubat (Municipal Court Zenica), <strong>and</strong><br />

us<strong>in</strong>g <strong>in</strong>teractive debates based on<br />

hypothetical approaches to practical<br />

examples, numerous issues were<br />

discussed, <strong>in</strong>clud<strong>in</strong>g procedural <strong>and</strong><br />

substantive aspects <strong>of</strong> the Law on<br />

Inheritance <strong>and</strong> its application. With<br />

superb evaluation results <strong>in</strong> terms <strong>of</strong><br />

quality <strong>of</strong> the <strong>sem<strong>in</strong>ar</strong>, a request was<br />

made to cont<strong>in</strong>ue tra<strong>in</strong><strong>in</strong>g activities<br />

with the same <strong>in</strong>teractive approach.<br />

Determ<strong>in</strong>ation <strong>and</strong> Transfer <strong>of</strong><br />

Rights <strong>of</strong> Disposal <strong>of</strong> Property to<br />

Units <strong>of</strong> Local Self-governance’. In<br />

addition to judges, the <strong>sem<strong>in</strong>ar</strong> was<br />

attended by representatives <strong>of</strong> the<br />

Securities Commission <strong>and</strong> the Central<br />

Register <strong>of</strong> Securities <strong>of</strong> Republika<br />

Srpska. Workshop participants<br />

discussed provisions <strong>of</strong> the law <strong>and</strong><br />

practical problems <strong>in</strong> registration<br />

courts related to entries <strong>of</strong> property<br />

transferred from units <strong>of</strong> local selfgovernance<br />

to companies. The issue <strong>of</strong><br />

full implementation <strong>and</strong> creation <strong>of</strong> all<br />

the preconditions for implementation<br />

<strong>of</strong> the Law on Entry <strong>of</strong> Bus<strong>in</strong>ess<br />

Entities <strong>in</strong> the Court Register was<br />

raised aga<strong>in</strong>, <strong>and</strong> an appeal was sent<br />

to the authorities to provide measures<br />

for its full implementation <strong>and</strong><br />

observance <strong>of</strong> the prescribed<br />

deadl<strong>in</strong>es.


• <strong>On</strong> 25 September, a <strong>sem<strong>in</strong>ar</strong> was held<br />

<strong>in</strong> Sarajevo on L<strong>and</strong> Registry Issues<br />

<strong>and</strong> Lien over Movable Property. 39<br />

judges <strong>and</strong> court assistants attended<br />

the <strong>sem<strong>in</strong>ar</strong>, which considered issues<br />

<strong>of</strong> l<strong>and</strong> registry reform, lien over<br />

movable property, <strong>and</strong> other issues <strong>of</strong><br />

importance for judges work<strong>in</strong>g <strong>in</strong> this<br />

area. Presenters <strong>in</strong>cluded judge Goran<br />

Salihovic (President <strong>of</strong> the Sarajevo<br />

Cantonal Court), lawyers, experts <strong>in</strong><br />

economics <strong>and</strong> IT from GTZ/ CIDА/<br />

Jasm<strong>in</strong>a Kurbasic. Mr. Milan Bajic<br />

<strong>and</strong> Ms. Azra Crnkic considered<br />

different aspects <strong>of</strong> reform <strong>and</strong><br />

experiences <strong>in</strong> this area.<br />

Jo<strong>in</strong>t Activities <strong>of</strong> the Centres <strong>in</strong> the Period<br />

from <strong>July</strong> to September<br />

• 13-14 <strong>July</strong>, <strong>in</strong> collaboration with CIDA/CoE <strong>and</strong> the JTC RS, a <strong>sem<strong>in</strong>ar</strong> was held<br />

<strong>in</strong> Gracanica, on Tra<strong>in</strong> the Tra<strong>in</strong>ers – Justification <strong>of</strong> Judgements. The <strong>sem<strong>in</strong>ar</strong><br />

<strong>in</strong>cluded 13 participants. Topics <strong>in</strong>cluded justification <strong>of</strong> judgements <strong>and</strong> rul<strong>in</strong>gs,<br />

requests based on the law – constitutional, <strong>in</strong>ternational <strong>and</strong> general aspects,<br />

determ<strong>in</strong>ation <strong>and</strong> assessment <strong>of</strong> facts <strong>and</strong> their presentation, justification <strong>of</strong><br />

judgements with different outcomes <strong>and</strong> the burden <strong>of</strong> pro<strong>of</strong>. Presenters<br />

<strong>in</strong>cluded Pr<strong>of</strong>essor Eduard Kuntisek from the University <strong>of</strong> Rijeka, Croatia <strong>and</strong><br />

Dr. Horst Proetel, retired judge <strong>of</strong> the Higher Regional Court <strong>of</strong> Thuer<strong>in</strong>ger<br />

Oberl<strong>and</strong>esgericht-Jena.<br />

• <strong>On</strong> 4–8 <strong>July</strong> <strong>in</strong> Tuzla, 11-15 <strong>July</strong> <strong>in</strong> Teslic, 18-22 <strong>July</strong> <strong>in</strong> Bihac, <strong>and</strong> 25–29 <strong>July</strong> <strong>in</strong><br />

Sarajevo, as part <strong>of</strong> jo<strong>in</strong>t activities <strong>in</strong> collaboration with JTC RS <strong>and</strong> HJPC, the<br />

Centre organised a series <strong>of</strong> <strong>sem<strong>in</strong>ar</strong>s on Improv<strong>in</strong>g Management Capacities at<br />

First <strong>and</strong> Second Instance Courts. The outcome <strong>of</strong> the <strong>sem<strong>in</strong>ar</strong>s, which <strong>in</strong>cluded<br />

all the presidents <strong>of</strong> municipal <strong>and</strong> cantonal courts, is a set <strong>of</strong> tra<strong>in</strong><strong>in</strong>g materials<br />

which will be available through a special l<strong>in</strong>k at the Centre’s web site. The<br />

materials will deal with topics <strong>of</strong> <strong>in</strong>terest for the courts, such as case


management, human resources management, <strong>and</strong> change management.<br />

• In the period 7-8 <strong>July</strong>, JTC FBiH <strong>and</strong> JTC RS, <strong>in</strong> collaboration with the IRZ<br />

foundation, organised a series <strong>of</strong> <strong>sem<strong>in</strong>ar</strong>s on Mt. Kozara, deal<strong>in</strong>g with the topic<br />

<strong>of</strong> Law <strong>in</strong> the Market Economy. The <strong>sem<strong>in</strong>ar</strong> was attended by judges from both<br />

Entities.<br />

• Sem<strong>in</strong>ars were held on 6-9 September <strong>in</strong> Neum, <strong>and</strong> on 12-14 September on Mt.<br />

Jahor<strong>in</strong>a, on Manag<strong>in</strong>g Difficult Proceed<strong>in</strong>gs – Case Presentation Skills,<br />

organised by the American Bar Association / Central <strong>and</strong> Eastern <strong>Europe</strong>an Law<br />

Initiative – АBА CEELI, the US M<strong>in</strong>istry <strong>of</strong> Justice, UNDP, JTC FBiH <strong>and</strong> JTC<br />

RS, on collaboration with the National Institute for Trial Attorneys (NITA),<br />

lead<strong>in</strong>g organisation <strong>in</strong> this field <strong>in</strong> the US. Topics <strong>in</strong>cluded preparation for<br />

trials, witness statements, direct <strong>and</strong> cross-exam<strong>in</strong>ation. Presenters <strong>in</strong>cluded Mr.<br />

Јаmes Gailey, Mr. Charles Brown, Mr. Steven Kessler, <strong>and</strong> Mr. Peter Schenck.<br />

• A <strong>sem<strong>in</strong>ar</strong> was held on Mt. Vlasic, 18-20 September, organised by UNDP <strong>in</strong><br />

collaboration with JTC FBiH <strong>and</strong> JTC RS, on the topic <strong>of</strong> War Crimes, attended<br />

by 21 participants from FBiH. The <strong>sem<strong>in</strong>ar</strong> considered the role <strong>of</strong> courts <strong>in</strong> BIH<br />

<strong>in</strong> light <strong>of</strong> the legal tradition <strong>in</strong> cases <strong>of</strong> war crimes, <strong>and</strong> sentenc<strong>in</strong>g practices <strong>in</strong><br />

such cases. The <strong>sem<strong>in</strong>ar</strong> was organised as a series <strong>of</strong> workshops, <strong>and</strong> at the end<br />

<strong>of</strong> each day the groups presented their results. Presenters <strong>in</strong>cluded Mr. Zoran<br />

Pajic, Mr. William Schabas, judge Azra Miletic <strong>and</strong> judge Shireen Avis Fisher<br />

(Court <strong>of</strong> BiH), <strong>and</strong> rapporteurs for the groups <strong>in</strong>cluded Mr. Hilmo Vucetic, Mr.<br />

Salem Miso, Ms. Zorica Gogala <strong>and</strong> Mr. Dragomir Vukoje. Introductory address<br />

was made by Ms. Medzzida Kreso, President <strong>of</strong> the Court <strong>of</strong> BiH.<br />

• <strong>On</strong> 22 September, JTC FBiH <strong>and</strong> JTC RS organised a tra<strong>in</strong> the tra<strong>in</strong>ers <strong>sem<strong>in</strong>ar</strong> <strong>in</strong><br />

collaboration with CIDA/CoE, at Mt. Jahor<strong>in</strong>a, on How to Identify A Mediation<br />

Case. The <strong>sem<strong>in</strong>ar</strong> <strong>in</strong>cluded 14 participants. Tra<strong>in</strong>ers <strong>in</strong>cluded Mr. Adnan Novo<br />

(BiH Mediators’ Association) <strong>and</strong> judge Yvonne Telenga (judge <strong>and</strong> mediator<br />

from Holl<strong>and</strong>). The <strong>sem<strong>in</strong>ar</strong> covered issues related to mediation <strong>in</strong> BiH – current<br />

legislative framework <strong>and</strong> experience thus far, as well as issues related to<br />

identification <strong>of</strong> cases suitable for mediation, as well as different elements <strong>of</strong><br />

mediation.<br />

• With<strong>in</strong> the Regional CARDS 2003 Project, a Module 2 <strong>sem<strong>in</strong>ar</strong> was held <strong>in</strong> Berl<strong>in</strong>,<br />

<strong>and</strong> a Module 3 <strong>sem<strong>in</strong>ar</strong> on Recognition <strong>and</strong> Enforcement <strong>of</strong> Rul<strong>in</strong>gs <strong>in</strong> Civil<br />

Matters, was held <strong>in</strong> Milocer, Montenegro. The <strong>sem<strong>in</strong>ar</strong>s were attended by<br />

judges from both Entities.<br />

• The Centres cont<strong>in</strong>ued their collaboration with the expert mission <strong>of</strong> the <strong>Council</strong><br />

<strong>of</strong> <strong>Europe</strong>, on build<strong>in</strong>g capacities <strong>of</strong> the judicial tra<strong>in</strong><strong>in</strong>g centres, f<strong>in</strong>anced by<br />

CIDA, <strong>and</strong> implemented by the <strong>Council</strong> <strong>of</strong> <strong>Europe</strong>. As part <strong>of</strong> the expert mission,


oth centres were visited by Dr. Kathleen Houch<strong>in</strong>, who prepared a report <strong>and</strong> a<br />

set <strong>of</strong> recommendations aimed at <strong>in</strong>stitutional development. The report was<br />

forwarded to the centres on 15 June, based on exam<strong>in</strong>ation <strong>of</strong> documents related<br />

to the centres as well as <strong>in</strong>terviews with all the staff. Dr. Houch<strong>in</strong>’s overall<br />

impression was that centres were productive <strong>and</strong> that the reference texts they<br />

produce <strong>and</strong> the tra<strong>in</strong><strong>in</strong>g methodology they utilise reflect the centres’<br />

pr<strong>of</strong>essionalism, although both centres cont<strong>in</strong>ue to work under considerable<br />

pressure. As part <strong>of</strong> the expert mission, from 27 to 29 September the centres were<br />

visited by Mr. Pasquale Pr<strong>of</strong>iti, prosecutor from Italy <strong>and</strong> a CoE expert. The aim<br />

<strong>of</strong> the mission was to develop tra<strong>in</strong><strong>in</strong>g needs assessment methodologies.<br />

• <strong>On</strong> 3 <strong>and</strong> 4 <strong>July</strong>, the Director took<br />

part at a regional conference <strong>of</strong> JTC<br />

presented the work <strong>of</strong> JTC FBiH. The<br />

conference covered issues <strong>of</strong> <strong>in</strong>ter<strong>in</strong>stitutional<br />

collaboration <strong>in</strong> the<br />

region, judicial tra<strong>in</strong><strong>in</strong>g development<br />

perspectives <strong>and</strong> the importance <strong>of</strong><br />

judicial tra<strong>in</strong><strong>in</strong>g on the path towards<br />

<strong>Europe</strong>an <strong>in</strong>tegration. The Centre<br />

proposed a set <strong>of</strong> jo<strong>in</strong>t tra<strong>in</strong><strong>in</strong>g<br />

programmes on issues <strong>of</strong> common<br />

<strong>in</strong>terest for judges <strong>and</strong> prosecutors <strong>in</strong><br />

the region, a common approach to<br />

texts, etc. A regional work<strong>in</strong>g<br />

• Director <strong>and</strong> assistant directors held a<br />

series <strong>of</strong> meet<strong>in</strong>gs with local <strong>and</strong><br />

foreign organisations, discuss<strong>in</strong>g the<br />

Centre’s activities, its tasks <strong>and</strong> aims.<br />

• As <strong>of</strong> 1 January 2007, <strong>in</strong> collaboration<br />

with UNDP, the Centre is plann<strong>in</strong>g to<br />

launch a project titled Legislative<br />

<strong>On</strong>e-stop Shop. Primarily aimed at<br />

the legal pr<strong>of</strong>ession <strong>in</strong> BiH, judges<br />

<strong>and</strong> prosecutors, a common electronic<br />

platform was established, conta<strong>in</strong><strong>in</strong>g<br />

all the laws <strong>and</strong> regulations <strong>of</strong><br />

Republika Srpska, Federation BiH,<br />

<strong>and</strong> Brcko District BH. In this way,<br />

BiH constitutions, changes <strong>and</strong><br />

amendments, all the laws, regulations<br />

<strong>and</strong> their changes <strong>and</strong> amendments,<br />

as well as decisions <strong>of</strong> the High<br />

Representative for BiH, can be found<br />

at a s<strong>in</strong>gle location. It should be noted<br />

that the data base will be updated<br />

regularly, with all the changes <strong>and</strong><br />

amendments to exist<strong>in</strong>g laws <strong>and</strong>


submit their proposals for jo<strong>in</strong>t<br />

project, <strong>and</strong> several meet<strong>in</strong>gs with<br />

UNDP covered activities related to<br />

jo<strong>in</strong>t organisation <strong>of</strong> <strong>sem<strong>in</strong>ar</strong>s on<br />

issues related to war crimes, as well<br />

as cont<strong>in</strong>uation <strong>of</strong> the Centre’s<br />

successful collaboration with UNDP<br />

on the ‘e-legislation’ project.<br />

Among other activities, we want to<br />

note the Director’s meet<strong>in</strong>gs with<br />

representatives <strong>of</strong> the HJPC BiH,<br />

representatives <strong>of</strong> АBА/CEELI, <strong>and</strong><br />

a meet<strong>in</strong>g with representatives <strong>of</strong><br />

CIDA (Canadian International<br />

Development Agency), all for the<br />

purpose <strong>of</strong> plann<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g <strong>and</strong><br />

other activities <strong>of</strong> the Centre <strong>in</strong> the<br />

forthcom<strong>in</strong>g period.<br />

with all the new laws <strong>and</strong><br />

regulations, as they are adopted. As<br />

<strong>of</strong> 2007, there will be an Internetbased<br />

search option for <strong>in</strong>dividual<br />

laws <strong>and</strong> other regulations, <strong>in</strong> a very<br />

user-friendly way.<br />

• <strong>On</strong> 3. August, a meet<strong>in</strong>g was held at<br />

the Centre, with representatives <strong>of</strong><br />

EUPM, <strong>in</strong> relation to cont<strong>in</strong>uation <strong>of</strong><br />

the project aimed at improv<strong>in</strong>g<br />

collaboration between police forces<br />

<strong>and</strong> prosecutors, though jo<strong>in</strong>t<br />

tra<strong>in</strong><strong>in</strong>g events. It was agreed that<br />

jo<strong>in</strong>t tra<strong>in</strong><strong>in</strong>g activities would be<br />

<strong>in</strong>cluded <strong>in</strong> the Centre’s annual work<br />

plan for 2007, <strong>and</strong> details would be<br />

specified <strong>in</strong> collaboration with the RS<br />

M<strong>in</strong>istry <strong>of</strong> Interior <strong>and</strong> prosecutors’<br />

<strong>of</strong>fices <strong>in</strong> RS.<br />

• <strong>On</strong> 7 September, the Director met<br />

with representatives <strong>of</strong> ICTP, on<br />

future collaboration <strong>and</strong> judges <strong>and</strong><br />

prosecutors’ tra<strong>in</strong><strong>in</strong>g needs <strong>in</strong> IT.<br />

• <strong>On</strong> 29 September, a meet<strong>in</strong>g was held<br />

<strong>in</strong> Sarajevo with representatives <strong>of</strong><br />

ABA/CEELI, which looked at the<br />

successes <strong>of</strong> collaboration thus far, as<br />

well as future activities <strong>of</strong> this<br />

organisation with the Centre.<br />

• An agreement <strong>in</strong> pr<strong>in</strong>ciple was<br />

reached that the 2007 programme<br />

should <strong>in</strong>clude several tra<strong>in</strong><strong>in</strong>g<br />

events to <strong>in</strong>clude judges, prosecutors,<br />

<strong>and</strong> practic<strong>in</strong>g lawyers, through<br />

three or five day <strong>sem<strong>in</strong>ar</strong>s, <strong>and</strong> one<br />

tra<strong>in</strong> the tra<strong>in</strong>ers <strong>sem<strong>in</strong>ar</strong>. An

Collected Judgements on War<br />

Crimes, soon to be promoted at the<br />

Court <strong>of</strong> BiH.<br />

• Immediately after the Law on<br />

Changes <strong>and</strong> Amendments <strong>of</strong> the<br />

Law on Suppression <strong>of</strong> Organised<br />

Crime <strong>and</strong> Worst Forms <strong>of</strong> Fraud<br />

came <strong>in</strong>to force, follow<strong>in</strong>g adoption<br />

at the RS National Assembly, HJPC<br />

BiH announced a public competition<br />

for the vacant position <strong>of</strong> <strong>in</strong> the<br />

special prosecutor’s <strong>of</strong>fice. It was first<br />

decided on the number <strong>of</strong> special<br />

prosecutors. The appo<strong>in</strong>tment<br />

decision was made on 14 September<br />

2006, <strong>and</strong> on 29 September, a solemn<br />

oath was given by the follow<strong>in</strong>g<br />

judges, before the President <strong>of</strong> HJPC<br />

<strong>On</strong> its part, the Centre has already<br />

implemented by the Centre <strong>in</strong><br />

collaboration with ABA/CEELI, on<br />

advocacy skills. As part <strong>of</strong> the tra<strong>in</strong><strong>in</strong>g<br />

organised by ICTP for SIPA, on WIN


XP, the Centre managed to <strong>in</strong>clude a<br />

number <strong>of</strong> special judges <strong>and</strong><br />

prosecutors, as well as prosecutors <strong>of</strong><br />

the District Prosecutors’ <strong>Office</strong> Banja<br />

Luka.<br />
