SALIENT' FEATURES OF SOME MAJOR LABOUR LAWS APPLICABLE TO<br />

ESTABLISHMENTS ENGAGED IN BUILDING AND OTHER CONSTRUCTION WORI(<br />

a) Workrnen Crrrnfiansafinn Act f923: The Act provides for compensetion ix<br />

case of inju.y by accident arising out of and during the course of employment.<br />

b) Payment of Gr<strong>at</strong>uity Act L972: Gr<strong>at</strong>uity is payable to an employee under the<br />

Act on s<strong>at</strong>isfaction of certain conditions on separ<strong>at</strong>ion if an employee has<br />

completed 5 years service or more on de<strong>at</strong>h, the r<strong>at</strong>e of 15 days wages for<br />

every completed year of service. The Act is applicable to all establishments<br />

employing 10 or more employees.<br />

c) Employees P.F. and Mlscellaneous Provislon Act 1952: The Act Provides for<br />

monthly contributions by the employer plus workers @1O% or 8.33%. The<br />

benefits payable under the Act are:<br />

Pension or family pension on retirement or de<strong>at</strong>h, as the case may be.<br />

Deposit linked insurance on the de<strong>at</strong>h in harness of the worker.<br />

(iii) Payment of P.F. accumul<strong>at</strong>ion on retirement/de<strong>at</strong>h etc.<br />

e) Contract Labour (Regul<strong>at</strong>ion & Abolitionf Act l97O: The Act provides for<br />

certain welfare measures to be provided bv the Contractor to contract labour<br />

and in case the Contractor t"it" to prouid., the same are required to be<br />

provided, by the Principal Employer by Law. The Principal Employer is<br />

required to take Certific<strong>at</strong>e of Registr<strong>at</strong>ion and the Contractor is required to<br />

take licence from t]re design<strong>at</strong>ed Officer. The Act is applicable to the<br />

establishments or Contractor of Principal Employer, if they employ 20 or more<br />

contract labour.<br />

0 Minimun Wages Act 1948: The Employer is supposed to pay not less than<br />

the Minimum Wages fixed by appropri<strong>at</strong>e G<strong>over</strong>nment as per provisions of the<br />

Act, if the employment is a scheduled employment. Construction of Buildings,<br />

Roads and Runways are scheduled employments.<br />

g) Pa5zment of Wages Act 1936: It lays down as to by wh<strong>at</strong> d<strong>at</strong>e the wages are<br />

to be paid, when it will be paid and wh<strong>at</strong> deductions can be made from the<br />

wages of the workers.<br />

h) Equal Remuner<strong>at</strong>ion Act 1979: The Act provides for payment of equal wages<br />

for work of equal n<strong>at</strong>ure to Male and Female workers and for not making<br />

discrimin<strong>at</strong>ion against Female employees in the m<strong>at</strong>ters of transfers, training<br />

and promotions etc.
