Currencies<br />

All payments shali be made in Indian Rupees.<br />

Price Adjustment<br />

Contract price shall be adjusted for increase or decrease in r<strong>at</strong>es and price of<br />

labour, m<strong>at</strong>erials, fuels and lubricants in accordance with the following<br />

principles and procedures and as per formuia given in the contract d<strong>at</strong>a:<br />

(a) The price adjustment shali apply for the work done from the start d<strong>at</strong>e<br />

given in the contract d<strong>at</strong>a upto end of the initial intended completion<br />

d<strong>at</strong>e or extensions granted by the Engineer and shall not apply to the<br />

work carried out beyond the stipul<strong>at</strong>ed time for reasons <strong>at</strong>tributable to<br />

the contractor.<br />

The price adjustment shall be determined during each month from the<br />

formula given in the contract d<strong>at</strong>a.<br />

Following expressions and meanings are assigned to the work done<br />

during each month:<br />

R= Total value of work done during the month. It would include the amount of<br />

secured advance granted, if any, during the month, less the amount of<br />

secured advance rec<strong>over</strong>ed, if any during the month. It will exclude value<br />

for works executed under vari<strong>at</strong>ions for which price adjustment will be<br />

worked separ<strong>at</strong>ely based on the terms mutually agreed.<br />

To the extent th<strong>at</strong> full compens<strong>at</strong>ion for any rise or fall in costs to the<br />

contractor is not c<strong>over</strong>ed by the provisions of this or other clauses in the<br />

contract, the unit r<strong>at</strong>es and prices included in the contract shall be deemed to<br />

include amounts to c<strong>over</strong> the contingency of such other rise or fall in costs.<br />

Retention<br />

The Employer shall retain from each payment due to the Contractor the<br />

proportion st<strong>at</strong>ed in the Contract D<strong>at</strong>a until Cornpletion of the whole of the<br />

Works.<br />

In Completion of the whole of the Works half the total amount retained is<br />

repaid to the Contractor and half when the Defects Liability Period has passed<br />

and tJ:e Engineer has c.ertified th<strong>at</strong> all Defects noffied by the Engineer to the<br />

Contractor before the end of this period have been corrected.<br />

On completion of the whole works, the contractor may substitute retention<br />

money with an "on derntrrd" Bank guarantee.<br />

Liquid<strong>at</strong>ed<br />

The Contractor shall pay liquid<strong>at</strong>ed damages to the Employer <strong>at</strong> the r<strong>at</strong>e per<br />

day st<strong>at</strong>ed in the Contract D<strong>at</strong>a for each day th<strong>at</strong> the Completion D<strong>at</strong>e is l<strong>at</strong>er<br />

than the Intended Completion D<strong>at</strong>e (for the whole of the works or the<br />

milestone as st<strong>at</strong>ed in the contract d<strong>at</strong>a). The total amount of li.quid<strong>at</strong>ed<br />

damages shall not exceed the amount defined in fhe Contract D<strong>at</strong>a. The<br />

Employer may deduct liquid<strong>at</strong>ed damages from payments due to the<br />

Contractor. Payment of liquid<strong>at</strong>ed damages does not affect the Contractor's<br />

liabilities.
