CONDITIONS OF CONTRACT<br />

A. GENERAL<br />

Definitions<br />

Terms which are defined in the Contract D<strong>at</strong>e are not also defined in the<br />

Conditions of Contract but keep their defined meanings. Capital initials are<br />

used to identify defrned terms.<br />

The Adjudic<strong>at</strong>or (synonymous with Dispute Review E\*pert) is the person<br />

appointed jointly by the Employer and the Contractor to resolve disputes in<br />

the first instance, as provided for in Clauses 24 and 25. The narne of the<br />

Adjudic<strong>at</strong>or is de{ined in the Contract D<strong>at</strong>a.<br />

Bill of Quantities<br />

Events are those defined in Clause 44 hereunder.<br />

The Completion D<strong>at</strong>e is the d<strong>at</strong>e of completion of the Works as certified by<br />

the Engineer in accordance with Sub Clause 55.1.<br />

The Contract is the contract between the Employer and the Contractor to<br />

execute, complete and maintain the Works. It consists of the documents listed<br />

in Clause 2.3 below.<br />

The Contract D<strong>at</strong>a defines the documents and other inform<strong>at</strong>ion which<br />

comprise the Contract.<br />

The Contractor is a person or corpor<strong>at</strong>e body whose Bid to carr5,' out the<br />

Works has been accepted by the Employer.<br />

The Contractor's Bid is the completed Bidding document submitted by the<br />

contractor to the Employer and includes Technical and Financial bids.<br />

The Contract price is the price st<strong>at</strong>ed in the Letter of Acceptance and<br />

thereafter as adjusted in accordance with the provisions of the contract.<br />

A Defect is any part of the works not completed in accordance with the<br />

Contract.<br />

The Defects r iahflitJr Period is the period named in the Contract d<strong>at</strong>a and<br />

calcul<strong>at</strong>ed from the Complelion D<strong>at</strong>e.<br />

The Employer is the party who will employ the contractor to carry out the<br />

Works.<br />

The Engineer is the person named in the contract D<strong>at</strong>a (or any other<br />

competent person appointed and notified to the Contractor to act in<br />

replacement of the Engineer) who is responsible for supervising the<br />

Contractor, administr<strong>at</strong>ing the Contract, certifying pa5rments due to the<br />

contractor, issuing and valuing vari<strong>at</strong>ions to the contract, awarding<br />

extensions of time, and valuing the Compens<strong>at</strong>ion Events.<br />
