Clarific<strong>at</strong>ion of Financtal Bids<br />
To assist in the exFmin<strong>at</strong>ion, evalu<strong>at</strong>ion, and comparison .f Brd", the Employer may,<br />
<strong>at</strong> his discrefion, ask any Bidder for ciarific<strong>at</strong>ion of his Bid, including breakdowns of<br />
unit r<strong>at</strong>es. The request for clarific<strong>at</strong>ion and the response shall be in writing or by<br />
cable, but no change in the price or substance of the R.irl shall be sought, offered, or<br />
perrnitted except as required to confirm the correction of rittrmetic errors disc<strong>over</strong>ed<br />
by the Employer in the eva-lu<strong>at</strong>ion of the Bids in accordance with clause 27.<br />
Subject to sub-clause 25.1, no Bidder shall contact the Employer on €rny m<strong>at</strong>ter<br />
rel<strong>at</strong>ing to his bid from the time of the bid opening to the time the contract is awarded.<br />
If the Bidder wishes to bring additional inform<strong>at</strong>ion to the notice of the Employer, it<br />
should do so in writing.<br />
Any effort by the Bidder to influence the Employer in the Errrployer's bid evalu<strong>at</strong>ion,<br />
bid comparison or contract award decisions maj' result in the rejection of the Bidders,<br />
bid.<br />
Dramin<strong>at</strong>ion of Bids and Determin<strong>at</strong>ion of Responsiveness.<br />
During the detailed evalu<strong>at</strong>ion of "Technica-l Bids", the Employer will determine<br />
whether each Bid (a) meets the eligibiLity criteria defined in Clause 3 and 4; (b) has<br />
been properly signed; (c) is accompanied by the required securities and; (d) is<br />
substantially responsive to the requirements of the Bidding documents. During the<br />
detailed evalu<strong>at</strong>ion of the "Financial Bid", the rgspgnsivenes.s of the bid-s will be<br />
further determined with respect to the remaining bid conditions, i.e., priced bill of<br />
quantities, technical specific<strong>at</strong>ions, and drawings.<br />
A substantially responsive "Financial Bid" is one which conforms to all the terms,<br />
conditions, and specific<strong>at</strong>ions of the Bidding documents, without m<strong>at</strong>erial devi<strong>at</strong>ion or<br />
reserv<strong>at</strong>ion. A m<strong>at</strong>erial devi<strong>at</strong>ion or reserv<strong>at</strong>ion is one (a) which affects in amy<br />
substantia,l way the scope, quakfy or performance of the Works; (b) which limits in any<br />
substa:rtial wa5r, inconsistent with the Bidding documents, the Employer's rights or<br />
the Bidder's oblig<strong>at</strong>ions under the Contract; or whose rectific<strong>at</strong>ion would affect<br />
unfairly the competitive position of other Bidders presenting substantially responsive<br />
Bids.<br />
If a "Financial Bid" is not substantially responsive, it will be rejected by the Employer,<br />
and may not subsequently be made responsive by correction or withdrawal of the nonconforming<br />
devi<strong>at</strong>ion or reserv<strong>at</strong>ion.<br />
27.<br />
Corection<br />
of Errors<br />
27.1.<br />
27.2.<br />
"Financial Bids" determined to be substaretially responsiv€, it will be checked by the<br />
Employer for any arithmetic errors. Errors will be corrected by the Employer as<br />
follows:<br />
(a) where there is a discrepancy between the r<strong>at</strong>es in figures and in words, the r<strong>at</strong>e<br />
in words will g<strong>over</strong>n; ald<br />
(b) where there is a discrepancy between the unit r<strong>at</strong>e and the line item total<br />
resulting from multiplying the unit r<strong>at</strong>e by the quantity, the unit r<strong>at</strong>e as quoted<br />
will g<strong>over</strong>n.<br />
The anount st<strong>at</strong>ed in the<br />
'Financial<br />
Bid" will be corrected by the Employer in<br />
accordance with the above procedure and the bid amount adjusted with the<br />
concurrence of the Bidder in the following manner:<br />
(a)<br />

If the Bid price increases as a result of these corrections, the amount as st<strong>at</strong>ed<br />
in the bid will be the 'bid price'and the increase will be tre<strong>at</strong>ed as reb<strong>at</strong>e;<br />
If the bid price decreases as a result of tlee corrections, the decreased amount<br />
will be tr"e<strong>at</strong>eri as tlre 'leicl mice'<br />
