Regional Inspector and to the management <strong>of</strong> all adjoining mines and <strong>of</strong> such other mines<br />

as might be affected by such flooding.<br />

Provided that the Regional Inspector may, be an order in writing and subject to<br />

such conditions as he may specify therein, permit such operations to be commenced on<br />

any day prior to the expiry <strong>of</strong> the said 14 days:<br />

Provided further that the Regional Inspector may, by an order in writing, either<br />

prohibit any such operation or require that such operation shall not be commenced until<br />

such precautions as he may specify therein, have been taken to his satisfaction.<br />

Explanation. – For the purposes <strong>of</strong> this sub-regulation, a mine shall have the<br />

meaning assigned to it under regulation 33.<br />

(2) If the operations in respect <strong>of</strong> which notice is given under sub-regulation (1),<br />

are not commenced within 60 days from the expiry <strong>of</strong> the said 14 days, the<br />

notice shall be deemed to have lapsed and the provision <strong>of</strong> the subregulation(1)<br />

shall apply as if no such notice had been given.<br />

130. Construction <strong>of</strong> a reservoir, dam or other structure. – (1) Where in any mine it is<br />

intended to construct a reservoir, dam or other structure to withstand a pressure <strong>of</strong> water<br />

or other material which will flow when wet, or to control an inrush <strong>of</strong> water (other than a<br />

reservoir, dam or structure for storing small quantities <strong>of</strong> water) the owner, agent or<br />

manager shall give in writing not less than 14 days notice <strong>of</strong> such intention to the<br />

Regional |Inspector. Every such notice shall be accompanied by two copies <strong>of</strong> plans and<br />

sections showing the design and other details <strong>of</strong> the proposed construction.<br />

Provided that where the safety <strong>of</strong> the mine or <strong>of</strong> the persons employed therein is<br />

seriously threatened, the provisions <strong>of</strong> this regulation shall be deemed to have been<br />

complied with if the said notice is given to the Regional Inspector as soon as the work <strong>of</strong><br />

construction is commenced :<br />

Provided further that where such a reservoir, dam or other structure was<br />

constructed before the coming into force <strong>of</strong> these regulations, the said copies <strong>of</strong> the plans<br />

and sections shall be submitted to the Regional Inspector within three months <strong>of</strong> the<br />

coming into force <strong>of</strong> these regulations. Where these details are not available, the Regional<br />

Inspector shall be informed <strong>of</strong> the fact within the aforesaid period.<br />

(2) The Regional Inspector may, by an order in writing, require such modification<br />

or alternations to be made by the design <strong>of</strong> any such reservoir, dam or structure as he may<br />

specify therein.<br />
