inflammable gas is present or likely to be present, no lamp or light other than an<br />
approved safety lamp or torch shall be used in any such working.<br />
126. Recovery and exploratory work – (1) After an explosion <strong>of</strong> inflammable gas has occurred in a mine<br />
only such persons as are authorise by the manager or by the principal <strong>of</strong>ficial present at the surface, shall be<br />
allowed to enter the mine.<br />
(2) When it is intended <strong>of</strong> proposed to reopen a mine or part there<strong>of</strong>, which has been isolated,<br />
sealed <strong>of</strong>f or flooded with water to deal with a fire or spontaneous heating, the owner, agent or manager<br />
shall, not less than 14 days before the commencement <strong>of</strong> such work, give notice in writing <strong>of</strong> such intention<br />
or proposal t the Regional Inspector and the Chief Inspector.<br />
(3) Where it is intended to carry out any exploratory work in a mine or part belowground likely to<br />
contain irrespirable atmosphere –<br />
(a) no party <strong>of</strong> less than three persons shall be allowed to proceed to carry out such work; and<br />
(b) every such party shall carry a cage containing suitable birds or other means <strong>of</strong> detecting<br />
carbon monoxide gas approved by the Chief Inspector and also an approved flame safety<br />
lamp.<br />
127. Danger from surface water – (1) Where any mine or part there<strong>of</strong> is so situated that<br />
there is any danger <strong>of</strong> inrush <strong>of</strong> surface water into the mine or part, adequate protection<br />
against such inrush shall be provided and maintained. If any dispute arises as to whether<br />
such protection is adequate or not, it shall be referred to the Chief Inspector for decision.<br />
(2) No workings shall be made in any mine vertically below –<br />
(a) any part <strong>of</strong> any river, canal, lake, tank or other surface reservoir; or<br />
(b) any spot lying within a horizontal distance <strong>of</strong> 15 metres from either<br />
bank <strong>of</strong> a river or canal or from the boundary <strong>of</strong> a lake, tank or other<br />
surface reservoir;<br />
except with the permission in writing <strong>of</strong> the Chief Inspector and subject to such<br />
conditions as he may specify therein.<br />
(3) Every application for permission under sub-regulation (2) shall be<br />
accompanied by two copies <strong>of</strong> a plan and section showing the existing position <strong>of</strong><br />
the workings <strong>of</strong> the mine, the proposed layout <strong>of</strong> workings, the depth <strong>of</strong> the<br />
workings from the surface, the position and depth <strong>of</strong> any stoped -out area in the<br />
neighborhood, all faults and other geological disturbances and such other<br />
particulars as may affect the safety <strong>of</strong> the mine or <strong>of</strong> the persons employed<br />
therein.<br />
Explanation. – Where sand or alluvium are lying in the course <strong>of</strong> a river, canal,<br />
lake, tank or reservoir, the depth from the surface shall be reckoned from the<br />
surface <strong>of</strong> hard ground underlying such sand or alluvium.
